DECEMBER 11, 1957
The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews and Assistant City Attorney Carl Loy present on roll call.
The minutes of the regular meeting of December 4, 1957, were approved as read.
This being the time for hearing on Resolution No. C- 1546, a resolution of intention to
construct an irrigation system to serve certain described property situated in the City
of Yakima and there being several protests recorded, it was moved by Schutt and seconded
by Alderson that the protests be taken under advisement by the Commission and the hearin
be postponed until the regular meeting of December 18, 1957, at the hour of 2 o'clock P.,
Moved by Mathews and, seconded by Schutt that Resolution No. C -1548 authorizing the City
Attorney to compromise and settle the condemnation action for the acquisition of land
for an industrial wastes disposal site in the amount of $40,000.00, be passed as read;
carried, Alderson, Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C -1548. A RESOLUTION authorizing the City Attorney to compromise and
settle the condemnation action for the acquisition of land for an industrial wastes
disposal. site.
WHEREAS, on October 1, 1957, the City of Yakima filed its
Petition and Notice in Condemnation (cause No. 42087 in the Superior Court of Yakima
County) for the acquisition of approxitately 65 acres of land for use as an industrial
wastes disposal site:, said condemnation action being taken pursuant to Ordinance No.
B -2077 passed and approved by the City Commission on'September 23, 1957; and
WHEREAS, a petition for a Writ of Certiorari has been filed in
the Supreme Court of the State of Washington by the owners of said land, it being their
contention that the acquisition of said land is not for public use and hence cannot be
legally condemned by the city, and
WHEREAS, it is deemed to be in the best interests of the City
to enter into a compromise settlement with the owners of said land,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA:
Section 1. That the City Attorney is hereby authorized and
directed to compromise and settle said condemnation action for the sum of $4.0,000.00,
said amount to be in full payment for all land taken, as more particularly described in
Ordinance No. B -2077, and for all severance damages to the remainder of respondents? land;
Section 2. That upon receipt of the court's Decree of Approp-
riation, the City.Treasurer is hereby authorized and directed to pay the aforementioned
sum into the registry of the court in and for Yakima County for distribution to the
owners of record of said land.

This being the time for hearing on Resolution No. C -1545 providing for the construction
of a domestic water system in the Swan tracts and other property in said district more
particularly described in said resolution and there being no objection in writing or
otherwise to said improvements or any part thereof, it was moved by Schutt, seconded by
Mathews that Ordinance No. B -2104 creating L.I.D. x860, be passed as read; carried,
Alderson, Schutt and. Mathews voting aye on roll call.
ORDINANCE NO. B- 21.04.. AN ORDINANCE providing for the improvement of property in the City
of Yakima by.the construction of necessary mains, fire hydrants, valves and other
appurtenances for the purpose of supplying water for domestic use and fire protection,
establishing a Local. Improvement District, providing for the method of payment therefor,
and creating a special fund;
It was moved by Schutt and seconded by Mathews that Ordinance No. B -2105, confirming
L.I.D. #853, being the South Front Street, Petzel Avenue and Logan Avenue Curb, Gutter
and Paving District, said hearing having been continued from week to week since November
13th, be passed in its original form; carried, Alderson, Schutt and Mathews voting aye
on roll_ call.
ORDINANCE NO. B -2105. AN ORDINANCE confirming the assessment roll covering Local Improve.
ment District No. 853 as created and established by Ordinance No. B -2023 of the Ordinance;
of the City of Yakima.
'Ordinance No. B -2106 read for the first time on December 4th and now having its second
readirku, by the Clerk:, it was moved by Schutt, seconded by Mathews that said Ordinance
providing for the expenditure of x'3,000.00 to be used for the construction costs within
L.I.D. #852,said monies not provided for in the 1957 Budget of the Irrigation Department,
be passed as read; carried, Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2106. AN ORDINANCE providing for the expenditure of funds not provided"
for in the 1957 Budget in the Irrigation Department for Local Improvement District 852;
and declaring an emE!rgency.

At the request of Commissioner Kenneth Schutt, I have caused to be
written two letters which are attached hereto, which will assist in
classifying the fire insurance that applies to the properties of the
city of Yakima.
The first letter sets forth the exclusions as are contained in the
policy and also calls attention to certain properties now excluded,
which we feel perhaps should not be excluded and which you may wish
to reconsider and perhaps have them included for coverage under the
policy.
The second letter sets forth the actual premium that applies on an
annual basis to each building owned by the City of Yakima, and which
is insured under the policy. This premium is also shown as a per-
centage figure of the total cost of insurance.
I trust these two letters will be of some assistance to you.

We would like to point out to the new members of the City Council
the various properties which are excluded from coverage under the
two Fire Insurance Policies.
These exclusions, which are no addition to the.normal exclusions
usually attached to a Fire Insurance policy, were included on
pages 7 and 8 of our Survey dated January 1, 1955 and are set
forth again in case they may want some of these included in the
coverage at this time.
(14) Stacks when outside of and not forming part of any
building;
(15) That portion of concrete foundations of machinery
and equipment which are below the surface of the
ground;
(16) bridges, water flumes, wells;
(17) dikes and dams, concrete, earthen or masonry reservoirs,
concrete settling tanks;
(18) tennis courts in the open;
(19)unhoused playground equipment more than fifty (50)
feet from any building or structure;
(20) concrete and masonry portion of swimming pools;
(21) chlorination and filtration tanks in the bleacher
.and tank building at the South Fifth Avenue swim-
ming pool and the North Fourth Street swimming pool;
(22) building known as "Digester House ", "Control House"
and Thickening and Settling Tanks" and contents there-
in at sewage disposal plant;
(23) parking meters installed on streets; fire hydrants
installed on streets;
(24) building known as "Incinerator Building" and contents
therein at garbage disposal plant;
(25) motor trucks and their trailers and motorized
fire apparatus but not detached parts and equip-
ment for same nor hose, chemical extinguishers or ladders.
(26) rollers, sweepers, sprinklers, mixers, power shovels,
ditch diggers and other similar repair and maintenance
equipment, all only of a type which is motor propelled
and motor drawn but not detached parts and equipment for same
fior power lawn mowers;
(27) street wiring, street fire and police alarm systems, street
traffic lights and control systems, including poles and
other supporting construction, where outside buildings either
underground or above ground;
(28) stock of pipe, valves and fittings when outside building;
(29) unhoused materials and equipment in open storage yard west of
Warehouse No. 402. Division Street;
(30)stock of merchandise held for sale;
(31) manuscripts, bullion and public records of every description
excepting library cataloging and index systems and Police
Department fingerprinting records (but not excluding binders,
covers and containers of such excluded records, all of which
are covered hereunder);
(32) architects fees(excepting the portion thereof to cover the cost
of construction or reconstruction);
(33) mansoleum and contents therein situated at Tahoma Cemetery,
Yakima, Washington;
(34) Sewage lift station and equipment on Rudkin Road adj. to
Bonneville Right of Way.
The above list of exclusions should be carefully gone over by the members
of the City Council to be sure they want this property to-be left uninsured.

We particularly want to call attention to the following properties
now excluded which we feel can be seriously damaged by a severe
Fire or Explosion:
(No. 21) Chlorinator and filtration tanks in the bleacher
and tank buildings at the Fifth Avenue South swimming
pool and the North Fourth Street swimming pool;
(No „26) Rollers, sweepers, sprinklers, mixers, power shovels,
ditch diggers and other similar repair and maintenance
equipment which can be insured under All Risk form of Inland
Marine Policy;
(No,.22) Buildings known as Digester House and Control House
and their contents at the Sewage Disposal Plant which are
subject to severe explosion hazard;
(No-31) Manuscripts and Public Records can be insured under
Valuable Papers policy giving much broader coverage
than the Fire and Extended Coverage policy without
the use of an average clause. Library books presently
insured under the Fire Insurance policy is also eligible
for this broader policy;
(No.32) Architects fees excepting the portion thereof to cover
the cost of supervision during construction or reconstr-
uction. Many of the buildings are rather old and we doubt
if the blueprints even if they are still available would
be used to rebuild any building except possibly the newest
structures.
(No-34) Sewage Lift Station and equipment on Rudkin Road adj. to
Bonneville Right of Way. This could possibly be damaged
by a severe explosion.
If after perusing the various exclusions the City Council has any question,
please let us know and we will be glad to discuss it with them.

to severe insurance hazard, be insured as recommended in Section 22 of.the Colvin
Insurance Agency letter; carried, Alderson, Schutt and Mathews voting aye on roll call.

the Mayor and City Clerk to enter into an agreement with Holiday Motels, Inc. located
adjacent to the City, for construction of water and sewer lines, be passed as read;
carried, Alderson, Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C :1549. A RESOLUTION authorizing the Mayor and the City Clerk to enter
into an agreement with Holiday Motels, Inc., providing for the construction of water
and sewer lines to serve said establishment.
WHEREAS, Holiday Motels, Inc., located adjacent and contiguous
to the City of Yakima desires city water and sewer service and
WHEREAS, Holiday Motels, Inc., has agreed to pay all costs and
expenses including engineering, in connection with the construction of the necessary
water and sewer lines to serve its property, and
WHEREAS, it is deemed to be iii the best interests of the City
to enter into an agreement with Holiday Motels, Inc.; for the construction of said
facilities,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA:
Section 1. That the Mayor and the City Clerk be and the same
are hereby authorized on behalf of the City to enter into an agreement with Holiday
Motels, Inc., a copy of which is attached hereto, providing for the construction by the
city of water and sewer lines to serve certain real property located adjacent to the
City of Yakima.

Moved by Schutt and seconded by Alderson that the City Clerk be authorized to advertise
for bids for a truck chassis with fire pump for the Fire Department of the City of
Yakima, said bids to be received at 10:00 a.m. Wednesday, January 8, 1958: carried,
Alderson, Schutt and Mathews voting aye on roll call.
Moved by Schutt and seconded by Alderson that we do now adjourn to meet again at the
hour of 10:00 A.M. on Wednesday the 18th day of December, 1957: carried, Alderson,
