Commissioner Mathews absent. The minutes of the regular meeting of October 9, 1957, and adjourned meetings thereof were approved as read. Bids having been received October 9th for the purchase of one four wheel tractor backhoe with frontend loader for the Water Department, it was moved by Schutt, seconded by Alderson that, in accordance with recommendations of,the superintendent of the Water Department, the bid be awarded to Burrows Motor Company, Yakima, in amount of $8436;00; carried, Alderson and Schutt voting aye on roll call. Commissioner Mathews absent. This being the time for a hearing on Resolution No. C -1522 providing for a hearing on the petition of John H. Vandiver for vacation of specific property on 38th Avenue North and Mavis Avenue and Mr. Vandiver now requesting the cancellation of said petition and procedure for vacation, it was moved by Schutt, seconded by Alderson that said vacation procedure be dropped; carried, Aldersoni; Schutt voting aye on roll call. Mathews absent. This being the time for the hearing on the assessment roll for Local Improvement District No. 847 being the Buwalda Lane Curb and Gutter District and there being written object- ions filed by Robert and Cleo Adeline and Elmer Gray and said objections having been duly considered, it was moved by Schutt, seconded by Alderson that Ordinance No.B -2087 confirming said assessment roll and every part thereof be passed as read; carried, Alderson and Schutt voting aye on roll call. Mathews absent. ORDINANCE NO. B -2087, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 847 as created and.established by Ordinance No. B -1944 of the Ordinances of the City of Yakima. An ordinance providing for the expenditure of funds to be used for the payment of State Business and Occupation Taxes for the Municipal Garbage Department.in amount of $5500.00 was read in its entirety by the City Clerk and being an emergency ordinance will be read again and considered,at the regular meeting on October 23rd. The Statewide City Employees Retirement System having notified the City Clerk that John West and Roy Wisner, city employees, will reach compulsory retirement age in December of 1957 and said employees praying for extension of employment in accordance with the retirement law, it was moved by Schutt, seconded by.Alderson that the employment of these men be extended for one year and the City Clerk is hereby instructed to notify the Retirement System of said action; carried, Alderson and Schutt voting aye on roll call. Moved by Schutt, seconded by Alderson that Resolution No. C -1530 denying the claim of Kenneth Cyr against the City of Yakima in the.sum of $575.00, be passed as read., and the City Clerk be and is hereby instructed to notify said claimant of such action; carried, Alderson and Schutt voting aye on roll call. Mathews absent. RESOLUTION NO. C -15309 WHEREAS, on August 16, 1957, a claim was filed by Kenneth Cyr against the City of Yakima in the sum. of $575.00, and WHEREAS, consideration has been given to the merits of said claim, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: st11 Section 1. That the claim of Kenneth Cyr in the sum of $575.00 filed August 16, 1957, be and the same is hereby denied. day of October, 1957. ATTEST: J. A. Alderson Mayor Moved by Schutt, seconded by Alderson that Ordinance No. B -2088 granting permitssion,to construct, maintain and operate .a railway spur track across South Fifth Avenue and West Pine Street to W. P. Fuller and Company, be passed as read; carried, Alderson and'Schutt voting aye on roll call. Mathews absent. ORDINANCE NO. B -2088, AN ORDINANCE granting to W.P. Fuller & Co. I permission to construct maintain and operate a railway spur track across South Fifth Avenue and West Pine Street within the City of Yakima. The City Engineer reporting the completion by the contractor of the South Front Street, Petzel Avenue, Logan Avenue, Curb, Gutter and Paving District, being L.I.D.. No. 853, it was moved by Schutt, seconded by Alderson that the City Engineer be authorized to prepare the assessment roll for said district and the City Clerk be and is hereby instructed to give notice by publication and to each property owner as required by law of hearing on said assessment roll at the hour of 10:00 otclock A.M. on Wednesday the 13th day of November, 1957; carried, Alderson and Schutt voting aye on roll call. An ordinance providing for the expenditure of $1250.00 for truck maintenance in the Irrigation Department, being an emergency ordinance, was read in its entirety for the first time by the City Clerk and held for its second reading and consideration on October 23 ,. 1957. An ordinance.providing for the expenditure of $2500.00 for auto maintenance in the Garbage Department, being an emergency ordinance, was read in its entirety for the first time and held for its second reading and consideration on October 23, 1957. Moved by Schutt, seconded by Alderson that we do now adjourn to meet again in regular session on October 23, 1957 at the hour of 10:00 otclock A .; carried, Alderson and Schutt voting aye on roll call.
