The City Commission met in regular session, Mayor Alderson and Commissioner Schutt and
Assistant Attorney Loy present on roll call. Commissioner Mathews absent.
The minutes of the regular meeting of September 11, 1957 and the adjourned.meeting
thereof were approved as read.
A hearing having been held September 4, 1957 on Resolution No. C -1505, being a resolution
of intention to cover the P.P. & L. Ditch and the Old Union Ditch Company Canal and
there being considerable protest to said project and the City Engineer now reporting thai
the protest amounts to 4 7% of the total valuation of said district and Mayor Alderson
believing that the property owners do not want the project under the original proposal,
it was MOVED by Schutt, seconded by Alderson that since Commiss ioner Mathews was not
present, the matter be set aside and taken up again at the regular meeting of September
25, 1957, at the hour of 10 o ►clock a.m., at which time Mr. Mathews could explain any
alternate proposal for said project: carried, Alderson and Schutt voting aye on roll
call. Mathews absent.
Moved by Schutt, seconded by Alderson that Resolution No. C -1522 fixing the time for
hearing on the petition filed by John H; Vandiver, prayLngfo.r the vacation of the road-
way from North 30th Avenue into lots 10, 11, 12, 13 and 14 Glenview Addition, at the
hour of 10 o1clock a.m. on Wednesday the 16th day of October, 1957, be passed as read:

RESOLUTION NO. C- 1522', A RESOLUTION fixing the time for hearing on the petition for the
vacation of the property beginning at the SW corner of 38th Avenue North and Mavis
Avenue, thence West 185 feet, thence Northwesterly 57.1 feet', thence East 226 feet,
thence South 40 feet to the point of beginning.
WHEREAS', a petition has been filed with the City Commission of
the City of Yakima, a municipal corporation, praying for the vacation of a portion of
Mavis Avenue described as follows, to -wit;
NOW, THEREFORE,
Beginning at the SW corner of 38th Avenue North and Mavis Avenue
thence West 185 feet, thence Northwesterly 57.1 feet, thence
East 226 feet, thence South 40 feet to the point of beginning.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That said petition shall be brought'on for hearing an determin-
ation on'Wednesday, the 16th day of October, 1957, at the hour of 10:00 o1clock a.m.,
on the said day at the office of the City Commission of the City of Yakima, at the-City
Hall, Yakima, Yakima County, L%Tashington, or as soon thereafter as the same may be heard,
and that notice of such hearing be give as provided by law. .

transfer of $5,000.00 with the 1957 Street Department Budget be passed.,`a's:,.read;: carried

RESOLUTION NO. C -1523, A RESOLUTION providing f or the transfer of funds within the
1957 appropriation of the Street :Department.
WHEREAS, a surplus of funds exists in the Crushed Rock and Road
Oil items of the Street Department appropriation of the 1957 budget, while a shortage
exists in the Auto equipment and Parts item of said Street Department appropriation, and
WHEREAS, the City Commission deems it in the best interests of
the City to make the transfers provided for herein,. and
WHEREAS, the action contemplated herein is authorized by R.C.W.
35.33.120,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That $1500.00 and $3500.00 be and the same is hereby transferred
from the Crushed Rock item and the Road Oil item, respectively of the Street Department
appropriation for 1957, to the Auto Equipment and Parts item, all of said items being
within the Maintenance and Operation classification in said appropriation, and the City
Treasurer is hereby authorized to make the aforementioned transfers set forth herein.

Moved by Schutt, seconded by Alderson that the City Clerk is hereby authorized and in-
structed to give notice to bidders by publication as required by law for the construction
of an irrigation system in L.I.D. No. 857, being the Revised Swan Tract & 29th Avenue
district, said bids to be received at the hour of 10 o1clock on Wednesday,,the 2nd day
of October, 1957: carried, Alderson,and Schutt voting -aye on roll call. Mathews absent.
Bids having been received on Wednesday the 11th day of September, 1957 for the purchase
of a 1/2 ton, 6 cylinder pickup truck for the Street Department and the bid of Hahn
Motor Company in the amountof $1920.00 plus federal and state taxes, being the only bid
received, it was moved by,Schutt, seconded by-Alderson that said bid be rejected and
Resolution No. C -1524 authorizing the purchase of said pick up without calling for bids,
be passed as read: carried, Alderson and Schutt voting aye on roll call. Mathews absent

RESOLUTION NO. C -1524, A RESOLUTION authorizing purchase by the Street Department of a
1957 one -half ton pickup truck without calling for bids.
WHEREAS, on September 11, 1957 the Street Department requested
bids for a 1957 model one -half ton pickup truck, and
WHEREAS, pursuant to said call for bids one bid only was re-
ceived, to -wit: from Hahn Motor'Company, which bid exceeded the amount of money avail-
able for said purpose, and
WHEREAS, said bid has been rejected by the City Commission,
and
WHEREAS, informal bids have been received on the basis of
modified specifications for said pickup truck, Wagner Chevrolet Company, Yakima, being
the low bidder thereon, and
WHEREAS, there is an immediate need for such truck by the Street
Department, and it is deemed to be in the best interests of the City to purchase said
pickup truck from Wagner Chevrolet Company without again calling for formal bids there-
for ;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA:
Section 1® That the Street Department is hereby authorized to
purchase from Wagner Chevrolet Company, Yakima, without calling for bids, a 1957 model
one -half ton pickup truck in the amount not to exceed $1800.00.
Section 2. That an-emergency is hereby declared ''to exist making
necessary the immediate purchase of said truck.

The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Schutt
and Mathews present on roll call. City Attorney Hawkins absent.
Moved by Mathews, seconded by Schutt that Ordinance No. B -2077 providing for the acqui-
sition of certain property, fully described in said ordinance, by condemnation or
purchase, said property to be used for a disposal site for industrial waste system, be
passed as read: carried, Alderson, Schutt and Mathews voting aye on roll_ call.
ORDINANCE NO. B :2077, AN ORDINANCE providing for the acquisition by condemnation or
purchase of certain real property more particularly described below, °for use by the city
of Yakima as a disposal site for industrial wastes; providing for the method of .payment
therefor; and declaring an emergency.

RESOLUTION NO. C- 1525,, A RESOLUTION appointing Traffic Board Members,
WHEREAS, Ordinance No. B -2058, passed by the City CorLTission
29th -of July, 1957, created a Traffic Board consisting of five members to be appointed
by certain designated department heads subject to the approval of the City Commission7;
and
WHEREAS, the various department heads have now designated their
appointees, NOW,FTHEREFORE, °
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY_ OF YAK:IMA:

The petition of Edward D. Craig et al praying for the annexation of certain property in
the vicinity of West Chestnut Street af3d-SSouth 39th Avenue.having been duly processed
and the proceedure having been defaulted due to failure to publish the noticein the
matter of the petition of said annexation, it was MOVED by Mathews, seconded by Schutt
that the new hearing date be fixed at the hour of 10 o'clock a.m. on Wednesday, the
9th day of October, 1957: carried, Alderson, Schutt and Mathews voting aye on roll call,
ORDINANCE N0. B -2078, AN ORDINANCE repealing Ordinance No. B -20 �4 entitled:: "An
Ordinance providing for the annexation by the City of Yakima, Washington, of certain
property contiguo.us to the City of Yakima, Washington. ", and declaring an emergency.
Moved by Mathews, seconded by Schutt that, Resolution No. C -1526 being a resolution of
intention to improve certain property in suburban Acre Homes by constructing a pipe
sewer with the necessary appertenances and fixing the time for hearing at the hour of
10 o ►clock a.m. on Wednesday, the 9th day'of,0etober,` 1957, be passed as read: carried

RESOLUTION NO. C -1526, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That it is its intention to improve the property within the
following described district by constructing a pipe sewer with the necessary wye branches
and manholes; all of said improvement to be constructed in full accordance with the
plans and specifications to be prepared by the Office of the City Engineer and filed
with' the City 'Clerk.,
The district to be served by and specially benefitted by and
assessed for the above- described improvement is situate.in the City of Yakima, Yakima
County,. Washington, and described as follows:
Lots l'to 20 inclusive of suburban Acre Homes
Lots 12 to 29 inclusive of Suburban Acre Homes
Lots 32 to 35 inclusive of Suburgan Acre Homes

All persons who may desire to object to said proposed improvement
are hereby notified to appear and present such objection, if any, at a meeting of the
City Commission to be held at its office in the City.Hall in the City of Yakima, Yakima
County, Washington, at the hour of 10 otclock on Wednesday, the 9th day of October, 1957;
which time and place are hereby fixed for the hearing of all matters relating to said
proposed improvement or objections thereto, and for determining the method of payment
for said improvement; and the City Clerk is hereby directed to give due notice of said
hearing and of the intention to make the aforesaid improvements.
All costs and expenses in connection with the construction of
said improvement, including the engineering, inspection, advertising publication of
notices, and all other expenses incident thereto, shall be levied and assessed against
the above - described property.
The City Engineer is hereby directed to submit to the City
Commission at or prior to the date herein fixed for said hearing, all of the data and
other information required by law to be by jim submitted.
That said assess ments shall be made according to special
benefits derived from the improvement without regard to the zone and termini method.
