AUGUST 7, 1957
The City Commission met in regular session, Mayor..Alderson, Commissioners Schutt and
Mathews and City Attorney Hawkins, present on roll call.
The minutes of the regular meeting of July 29 , and the special meeting of July 30, 1957
were approved as read.
A petition for :•..vac=ation having been filed by Richard C. Focht and others, said petitio
praying for the vacation of the West Half of 39th Avenue South adjoining Lot 16 of
Walnut Grove Addition, it was MOVED by Mathews, seconded by Schutt that Resolution No.
C- 1498_fixing the time for hearing on said petition at the hour of 10 o'clock a.m. on
Wednesday, the 28th day of August, 1957, be passed as read: carried, Alderson, Schutt
and Mathews voting aye on roll call.
RESOLUTION NO. C -14981 A RESOLUTION fixing the time for hearing on the. Petition for
Vacation of the West-Half of the North 139.44 feet of 39th Avenue South, adjacent to
Lot 16 of Walnut Grove Addition, as shown on the plat of said Addition.
WHEREAS, a Petition has been filed with the City Commission of
the City of Yakima; a municipal corporation, praying for the vacation of a portion of
a city street, described as follows, to -wit:
The West Half of 39th Avenue South adjoining Lot 16
of Walnut Grove Addition, as recorded in Volume N. of
plats, at page 7, at the Office of the Auditor of
Yakima County, Washington, being the north 139.44 feet,
more or less, of the west 25 feet, more or less, of 39th
Avenue South, which is all of that portion of the north
139.44 feet of 39th Avenue South, dedicated as a public
street in said plat of Walnut Grove Addition (only the
West one -half of 39th Avenue South being purportedly
dedicated in the aforementioned plat of Walnut Grove
Addition).
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the
City of Yakima that said .Petition shall be brought on for hearing and determination on
WEDNESDAY, AUGUST 28, 1957, at the hour of 10 :00 o1clock A.M., at the office of the
City Commission of the City of Yakima at the City Hall, Yakima, Yakima County, Washingto.
or as soon thereafter as the same may be heard, and that notice of such hearing be giver
by posting by the City Clerk in three of the most public places in the city, and a like
notice in a conspicuous place on the street sought to be vacated, as provided by law.

Moved by Mathews, seconded by Schutt that Resolution No. C -1499 authorizing the Street
Department on behalf of the City to bid upon a strip of land 290 by 20 feet on the
South side of Lenox Avenue between'8th and 9th Avenues,.said land being offered for
sale at a tax sale to be held by Yakima County, be passed as read: carried, Alderson
Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C*1499, WHEREAS, Yakima County is offering at a tax sale a strip of
land 290 by 20 feet on the south side of Lenox Avenue, between 8th and 9th Avenues,,
said land being situated within the corporate limits of the City of Yakima, and
WHEREAS,-the City of Yakima has'need for said strip of land,
and it is deemed to be in the best interest of the City to attempt to acquire by
purchase said land, and
WHEREAS, it appears that the delinquent taxes and costs out-
standing against said strip of land is not more than $100.00, NOW, THEREFORE, BE IT
RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the STREET DEPARTMENT is hereby authorized on behalf of
the City to bid upon that certain strip of land 290 by 20 feet on the south side of
Lenox Avenue between 8th and 9th Avenues at the tax sale to be held by Yakima County,
and if the City is the successful bidder, the City Treasurer is hereby authorized to
make payment for said land out of the Street Department appropriation for 1957.

Treasurer to accept an advancement of $12,925.00 from the Yakima Valley Regional
Library, 112 of said amount to be applied on the semi- annual interest upon general
obligation bonds due and payable on September 1; 1957 and the remainder to be. applied
to the interest payment due on March 1, 1958, be passed as read: carried, Alderson,
Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C -1500, A RESOLUTION authorizing the City Treasurer to accept an
advancement of funds from the Board of Trustees of the Yakima Valley Regional Library
for the payment of interest to become due upon the .General Obligation Library Bonds,
and authorizing the Treasurer to provide for the repayment of said advances.
WHEREAS, at a special election held on November 6, 1956, the
electors of the City of Yakima authorized the issuance of general obligation bonds in
the sum of $400,000.00 for the purpose of providing _funds to be used with like funds
from the Rural County Library District of Yakima County for the purpose of building
a new regional library building a new regional library buildin within the City of

i HEREAS, pursuant to the terms of Ordinance No, B -1993, the
City provided for the issuance and the sale of said library bonds-with interest payable
semi - annually on the 1st day of March and September of each year; and
WHEREAS, said Ordinance B -1993 authorized annual tax levies upon
all of the taxable property within the City without limitation as to rate or amount and
in amounts sufficient to pay the principal and interest upon said general. obligation
bonds; and
WHEREAS, semi - annual interest payments are due upon said bonds
on September 1, 1957 and March 1, 1958 in the sum of $6,462.50 for each interest pay-
ment period; and
WHEREAS, real property tax collections from said special levies
are not due and payable until February 15, 1958; and
WHEREAS, the Board of Trustees of the Yakima Valley Regional
Library has consented to an advancement of funds to the City of Yakima for the purpose
of paying said semi - annual interest payments referred to hereinabove; and
WHEREAS, it is deemed to be in the best interest of the City to
accept said advancements; now, therefore
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That the City Treasurer is hereby authorized to
accept from the Board of Trustees of the Yakima Valley Regional Library the total sum
of $12,925.00, one -:half of which shall be applied to the semi- annual interest upon said
general obligation library bonds due and payable on September 1, 1957, and the remainder
to be applied to the interest payment due and payable on March 1, 1958.
Section 2. That the aforementioned monies to be received from
the Yakima Valley Regional Library shall be deposited in the "City of Yakima 195'7
General Obligation :Library Bond Redemption Fund ", and all disbursements for interest
payments shall be made from said Fund.
Section 3. That the Treasurer is hereby authorized and directed,
upon receipt of real property tax collections derived from the excess levies as provid-
ed for in Ordinance No. B -1933, to repay the sum of $12,925.00 to the Board of Trustees
of the Yakima Valley Regional Library, said payment to be made from the Bond Redemption
Fund mentioned hereinabove.

Primary and General elections for the purpose of establishing the City Manager plan in
the City of Yakima, in accordance with the amendment to the City Charter duly voted on
and, approved on the 13th day of March, 1956, be passed as read: carried; Alderson,
Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C -1501, A RESOLUTION directing the amity Clerk to call an election for
the purpose of establishing the City Manager plan in the City of Yakima.
BE IT RESOLVED by the City Commission of the*City of Yakima;
THAT WHEREAS, on the 13th day of March, 1956, an amendment to the
City Charter of the City of Yakima was duly voted on and approved amending Articles II
and III of the City Charter of the City of Yakima, thereby providing for the adoption
by the City of Yakima of the Council- Manager form of government, effective on and after
the first Monday in June, 1958.
1. The City Clerk of the City of Yakima, be,and is hereby,
directed to call the primary election provided for in said amendment on the second
Tuesday in February, 1958, and the general election provided for by said amendment for
the second Tuesday of March, 1958, for the purpose of electing the seven councilmen who
shall constitute the council of the City of Yakima on and after the first Monday in June,
1958, all in the manner required by the Constitution of the State of Washington, the
Charter of the `'ity of Yakima as amended, and the Statutes of the State of Washington.
2. The 'ity Clerk be, and he is hereby, authorized-and directed
to notify the public, in the manner required by law, that filings for the office of
councilman will be .received in the manner provided by law, and to post notice of said
elections in the manner provided by law, and to take all steps necessary under law to
hold the primary election and the general election provided for in said amendment to the
Charter of the City of Yakima.

conditions -in addition:to those provided for in Resolution No. C -1482 for the constructs
of a mausoleum at at Tahoma Cemetery, be passed as read: carried, Alerson and Schutt
voting aye on roll call. Mathews voting no.
RESOLUTION NO. C- 15020 WHEREAS, Resolution No. C-1482 adopted by-the City Commission on
June 10, 1957, authorized Robert E. Wallingford to construct a mausoleum upon the
property of the Tahoma Cemetery in the.City of Yakima; and

_WHEREAS, it is deemed to be in the best interests.of the City
to provide for additional terms and conditions,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA:
Section 1.- That upon the completion of the construction of
said mausoleum the said Robert E. Wallingford shall pay to the City of Yakima, the sum
of 30.00 per crypt, in consideration of which the City of Yakima shall.extend perpetual
care to said mausoleum. Of said sum of $30.00 per crypt, $15.00 shall be credited to
the Cemetery Fund and $15.00 to the Prepetual Care.Fund.
Section 2. That Robert E. Wallingford be, and he is hereby,
authorized to execute Certificates of Ownership to the various crypts in said mausoleum,
with copies thereof to be delivered to the cemetery superintendent to be made a part of
the permanent file of Tahoma Cemetery, and further, that,said certificates be signed as
approved by said superintendent. That after the original issuance of said certificates,
all assignments thereof shall be made by the City of Yakima through its cemetery
superintendent, or such other persons as the City of Yakima may designate.
Section 3. That saidtmausoleum shall be constructed within the
bounds of Tahoma Cemetery upon that portion" "thereo.ff more particularly described as
follows:

The walls of said Mausoleum shall be at least 351 distant from
the edge of each of the existing roadways (20th Avenue South
and Tahoma Ave.)

RESOLUTION NO. C -1503, A RESOLUTION providing for the transfer of funds within the
Engineering Department Budget.
WHEREAS, a surplus of funds exists in the Draftsman item of the
Engineering Department appropriation in _the 1957 Budget, while there is a need of
additional funds in the Deputy Engineer item in said appropriation, all being within the
"Salaries" classification; and
WHEREAS, the pity Commission deems it in the best; interests of
the City to make such transfer within said Engineering Department appropriation; and
WHEREAS, the action contemplated herein is authorized by RCW
35.33.120,
NOW, THEREFORE, BE I'T RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That,$2,350.00 be, and the same is hereby, trans-
ferred from the Draftsman item to the Deputy Engineer item, all within the "Salaries"
classification of the Engineering Department 1957 Budget, and the City Treasurer is
hereby authorized, empowered and directed to make the aforementioned transfer within
said appropriation.
