The minutes of the regular meeting of July 1, 1957, were approved as read. Moved by Schutt and seconded by Alderson that an extension of time be granted to Olson Electric Company to- August 15, 1957, for completion of the High Intensity Lighting at the Airport, subject to approval by the C.A.A., as recommended by the City Engineer: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Schutt, seconded by Alderson that the Treasurer's Investment Report showing purchases for the month of June be approved as read: carried, Alderson, Schutt and Mathews voting aye on roll call. The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Schutt and Mathews and Assistant Attorney Loy present on roll call. Moved by Mathews and seconded by Schutt that Resolution No. -C -1492 providing for the compromised settlement of $300.00 to John 0. Stephens for damages occurring during the South Interceptor Sewer Project and authorizing the City Clerk to pay the same, be passed as read: carried, Alders, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1492. WHEREAS, o---"'J , 1955, a claim was timer filed against the City of Yakima by John 0. Stephens, allegi g damages in the sum of 4250.00 occurring during the construction of the South Interceptor Sewer Project: and WHEREAS, subsequently, to -wit, on May 18, 1956, said John 0. Stephens brought suit against the City of Yakima and the Great American Indemnity Company, a New York Corporation, in the Superior Court in and for Yakima County, seeking damages in the amount aforesaid; and WHEREAS, it is deemed to be in the best interests of the City to enter into a compromise settlement with said John 0. Stephens, NOW, THERMRE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. The City Attorney is hereby authorized to compromise and settle said lawsuit for the sum of $300.00. Section 2. That the City Clerk is hereby authorized and direct- ed to pay to John 0. Stephens the sum of $300.00, said payment to be from the SEWER Construction Fund; provided, however, that no amount shall be paid to said claimant until a release of all claims arising out of said subject' matter has been executed by the claimant and filed with the City Clerk.
