The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews and City Attorney Hawkins present on roll call.
The minutes of the regular meeting of June 24, 1957 were approved as read.
This being the time for the hearing on Resolution No. C- 1480,being a resolution of
intention to improve certain property by the construction of sidewalks in the vicinity
of Nob Hill School, the Eisenhower.Hi_gh School and the Wilson Jr. High School, said
property to be served fully described in said resolution, and there being some eighty
(80) to one hundred (100) property owners present, being both for and against said
project, an ordinance creating a Local Improvement District was read, the property owne .
heard and ask to register all protests with the City Engineer and .said ordinance was
tabled until such time as a report on said protests could be completed by the City
Engineer.
Moved by Mathews, seconded by Alderson that Resolution No. C -1489 being a resolution
authcxdzing the institution of action against Jake Leingang and Homer Young, said action
to be taken to restrain them from the construction of a cleaning establishment at 3804
Summitview Avenue since said building is in violation of the zoning Ordinance and the
Building Code of the,'City of Yakima and it being desirable to establish in a courtof
law a fair and proper rule which will be appli'ca'ble in all cases of building and zoning
in newly annexed areas, be passed as read: carried, Alderson, Schutt and Mathews
voting aye on roll call.
RESOLUTION NO. C -1489, A RESOLUTION,authorizing institution of action against, Jake
Leingang and Homer 'Young.
WHEREAS, Jake Leingang is undertaking the construction of a
cleaning establishment contrary to and in violation of a Stop Work. Order issued by the
Building Inspector; and
WHEREAS, said building is and will be in violation of the
Zoning Ordinance of the City of Yakima and in violation of the Building Code of the
City of Yakima; and
WHEREAS, Jake Leingand and Homer Young, by and through their
attorney, Harry Hazel, have represented their intention to prodeed with the constructi
and
WHEREAS,, construction is, in fact, proceeding; and
WHEREAS, the City Attorney has advised that the legal status of
property annexed to the City with respect to.the Building Code and the Zoning Ordinance
is in some respects uncertain; and
WHEREAS, it ,is desirable to establish in a court of law a fair
and proper- rule which will be applicable in . all cases, NOW, THEREFORE,
IT IS HEREBY RESOLVED that the City Attorney be, and he is
hereby,, directed to institute an action against Jake Leingang and Homer Young wherein
to restrain them from the.construction of a cleaning establishment at the property
known as'3804 Summitview Avenue.

The time for hearing on Resolution No. C- 1479,being a resolution of intention to improve
40th Avenue and Arlington Avenue by surfacing and installing concrete curbs and gutters,
having been set for the hour. of 10 o'clock a.m. on this day and it being impossible to
accomplish said hearing at that hour, although protests were heard at the same time as
the hearing on sidewalks in this area and referred to the City Engineer for tabulation
and recommendation, and the City Engineer now reporting that there is only.35.3% protest
and that at least 60% protest must be registered before it is mandatory 'that the distric
not be formed, it was MOVED by Mathews, seconded by Schutt that Ordi.nance_:No. B -2043
creating L.I.D. No. 854,bbe passed as read:, carried, Alderson, Schutt and'Mathews

ORDINANCE NO. B -2043, AN ORDINANCE providing for the improvement of certain property
by grading, ballasting, surfacing with asphaltic concrete, and constructing concrete
curbs and gutters, together with the necessary drainage features; establishing a Local
Improvement District, providing for the method of payment thereof, and creating a
special fund.

and changing the regular meeting time of the City Commission to the hour of 10 o'clock

ORDINANCE NO. B -2044, AN ORDINANCE amending Ordinance No. A -2 entitled "AN ORDINANCE
fixing the time for the regular meeting of the City Commission, providing for the
calling of special meetings and the manner of giving notice thereof, and declaring an

amendment to Ordinance No. B -297; known as the Taxicab Ordinance, said ordinance changing
the rates that may be charged or collected in the City of Yakima in the City of Yakima,
be passed as-read: carried, Alderson, Schutt and Mathews voting aye on roll call..
ORDINANCE NO. B -2045, AN ORDINANCE amending Section 3 of Ordinance No. B -712, entitled:
"AN ORDINANCE amending Ordinance No. B -297, entitled: AN ORDINANCE relating to the
licensing for the purpose of regulation and revenue, the carrying of passengers for hire
by certain vehicles in the City of Yakima, and to the regulation of taxicabs, for -hire
cars, sightseeing cars; providing for the inspection and control thereof and for licens-
ing and control of drivers thereof, defining offenses, prescribing penalties, and re-
pealing Ordinance No. B -280, and all other ordinances in conflict herewith, and declar-
ing an emergency;" by amending Section 1 and by adding new sections thereto to be desig-
nated "Section 3 "; "'Section 5 -A "; "Section 5 -B "; "Section 5 -C "; Section 11 -A ";• and
Section 11 -B "; and providing penalties for violation hereof;" repealing Ordinance No.
B -1212 and declaring an emergency.

to call for bids for the purchase of 300 gallons more or less of permanent type anti-
freeze to be delivered in one gallon containers, said bids to be received on or before

property, anmely Lots 9 to 16 inclusive, Block 66, Original Townsite of North Yakima
and Lots 1 and 2,Block 66, Original Townsite of North Yakima from Area 2 to Area 4, be
passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2046, AN ORDINANCE rezoning certain specific property situate in the
City of Yakima, County of Yakima, Washington.
An Ordinance rezoning that property situated at 4008 summitview Avenue, said location
fully described in said ordinance, from a Limited Business, Area 4 to "C" Residence,
Area 1, was read by the Clerk and tabled.'

A -132, said ordinance reducing the License Fees for Theatres from $150.00 'to $10.00 per
year and $200.00 to $20.00 per year said licenses payable annually or quarterly or by
the day, as. the licensee desires, be passed as read: carried, Alderson, and Mathews
voting aye on roll call. Schutt not voting. - - ,
ORDINANCE NO. BQ20472 AN ORDINANCE amending Ordinance No. A -132 entitled "AN ORDINANCE
to license and regulate theatres and public performances therein and exhibitions and
entertainments at which moving pictures are displayed or exhibited:: repealing Ordinance
No. A -122, passed by the City Commission on the 9th day of June, 1913, and all other
ordinances and parts of ordinances in conflict herewith; providing a penalty for the
violation of this ordinance; and declaring an emergency. "; and repealing Ordinance Nos.
A -351 and A -357•
A hearing having been held on Resolution No C -1480, at the hour of 10 o'clock a..m., on
Monday the 1st day of July, 1957 and there being considerable protest to the formation
of the Nob Hill sidewalk Improvement District as described in said resolution, and said
protests having been, referred to the City Engineer for tabulation and recommendation
and the City Engineer now reporting that there is only 35.3/ protest and that at least
60% protest must be registered before it is mandatory that the district not be formed;
it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -2048, creating L.I.D.
No. 855, to be known as the Nob Hill Sidewalk District, be passed as read: carried
Alderson, Schutt and Mathews voting aye on roll call.

ORDINANCE NO. B -20481 AN ORDINANCE providing for the improvement of certain property
by constructing concrete sidewalks, with necessary.grading and other incidental work,
establishing a Local Improvement District, providing for the method of payment thereof,
and creating a special fund.

call for bids for the construction of concrete sidewalks for L.I.D. No. �55,.said bids
to be received on or before the 17th day of,July, 1957 at the hour of 10 o'clock a.m.

call for bids for the construction of concrete curb and gutters together with surfacing

bids to be.received at the hour of'10 o'clock a.ma on Wednesday, the 17th day. of July,
1957 :: carried, Alderson, Schutt and Mathews voting aye on roll call.
Moved by Mathews, seconded by Schutt that Ordinance No. B -2049 amending Ordinance No.
B -585 said ordinances providing for the collection of admission tax, be passed as read:
carried, Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2049, AN ORDINANCE amending Ordinance No. B -585 entitled "AN ORDINANCE
levying an admission tax on persons paying admissions, or who are admitted free or at
reduced rates to any place; fixing the amount and-providing for the collection thereof;
prescribing penalties; and declaring an emergency."
Moved by Mathews, seconded by Schutt that Resolution No. C -1490 providing for the com-
promise settlement of $4000,.00 for a claim of damages filed against the City by Alfred
J. Scheuffele for $8000.00, said claim arising from the flooding of claimant's property
on or about the 11th day of March, 19570 and authorizing the City Clerk to draw the
necessary warrant in payment upon the filing of a release by the claimant, be passed
as read: carried, Alderson, Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C -14909 WHEREAS, a claim for damages has been timely filed against the
City ,by Alfred J. Scheuffele in the sum of $8,000.00, arising from the flooding of
claimant's property on or about March 11, 1957; and
WHEREAS, a compromise settlement has been agreed upon between
the City and the claimant in the sum of $4,000.00 and
WHEREAS, it is deemed to be in the best interests of the City
of Yakima to compromise said claim; NOIJ THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the claim of Alfred J. Scheuffele in the sum of $8,000.00
be, and the same is hereby, compromised for the sum of $4,000.00, and the City Treasurer
is hereby authorized and directed to issue a warrant in payment of said claim chargeable
against the Water Fund; provided, however that the Treasurer shall not deliver said
warrant to the claimant until a release is' executed and filed with the City Clerk by
the above -named claimant relieving and releasing the City from any additional and further
liability in connection with this subject matter.
