HomeMy WebLinkAbout02/25/1957 Business Meeting201 FEBRUARY 25, 1957 The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and Mathews and Assistant Attorney Carl Loy present on roll call. The minutes of the regular meeting of February 1$, 1957 were approved as read. This being the time for the receiving and considering bids for the $400,000 issue of library bonds, the following bids were received: The National Bank of Commerce, Seattle, the effective rate of interest 3.246% Pacific Northwest Company�Exchange Building, Seattle, net interest 3.11$% Seattle First National Bank of Seattle, a total interest bid of 3.116% It was Moved by Mathews, seconded by Schutt that the City Commission meet with the City and County Library Boards to consider said bids -and meet again at 2 p.m. this same day and make the award: carried, Alderson, Schutt and Mathews voting aye on roll call.. This being the time for receiving bids on Turbine pump for the Irrigation Department, the following bids were received: DeCoto Bros. Yakima $ 1,66$.32 Hall - Harmon Equipment Company 1,650.$1 Pomona Serv. & Supply Company 12792.83 Food Machinery & Chemical 1,95$.02 It was moved by Mathews and seconded by Schutt that the bids be referred to the Engineers and Irrigation Department for recommendation: carried, Alderson, Schutt and Mathews voting aye on roll call. This being the date for receiving bids for the 1957 supply of chlorine for the Water Department, the following were received: Pennsylvania Salt Manufacturing Company of Tacoma Van Waters and Rogers, Inc. of Seattle Moved by Mathews, seconded by Schutt that said bids be referred to the Superintendent of the Water Department for recommendation: 'carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Schutt, seconded by Mathews that the City Clerk be and is hereby authorized to advertise for bids for the sale and removal of municipally owned property at the Yakima Municipal Airport, namely one complete dwelling unit, to be sold "as is" and "where is" and to be paid for at the time of acceptance of bid, sale of said property being to further improve the,Airport, said bids to be received on March 11, 1957, at the hour of 10 o1clock a.m.: carried, Alderson, Schutt and Mathews voting aye on roll call. C -145$, A RESOLUTION authorizing the Street Dept. to purchase corrugated metal pipe without calling for bids; and declaring an emergency. WHEREAS, it is necessary to rebuild the bridge spanning the. irrigation ditch at 16th Avenue and Cherry Street, said bridge being one -half in the City and one -half in the County, and WHEREAS, an arrangement has been entered into with Yakima County to share the costs of re- building said bridge and WHEREAS, approximately 400•lineal feet of corrugated metal pipe is required to reconstruct said bridge, and WHEREAS, the total cost of said corrugated metal pipe will be approximately $2500.00, and WHEREAS, insufficient time remains before water will be flowing in said irrigation ditch to call for bids for said pipe and complete the necessary repairs, and WHEREAS,•the only local suppliers of said corrugated pipe is Rankin Equipment Company, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. This resolution is necessary for the immediate .preservation of the public peace, health, welfare and safety, and an emergency is hereby declared to exist. Section 2. The City— Engineer is hereby authorized and directed to purchase from Rankin Equipment, without calling for bids, approximately 400 lineal feet of 3611 x 2211 standard Armco corrugated metal pipe, 14 gauge, said pipe to be used to construct the bridge spanning the irrigation ditch at 16th Avenue and Cherry Street, the total cost of said pipe to be in the approximate sum of ?2500.00. Section 3. 'The payment for said corrugated metal pipe shall be made from the Rehabilitation of Bridges. ORDINANCE NO. B -2003, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 844, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Mathews and seconded by Schutt that Ordinance No. B -2004 fixing the time of delinquency and prescribing the form of bonds for L.I.D. No. 845, being the Westover Terrace Sewer District, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -2004, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Impro vement District No. 845, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Mathews and seconded by Schutt that Resolution No. C -1459 being a Resolution authorizing settlement and payment of $200.00 in the case of Steve Pavlick vs. City of Yakima, and designating the fund out of which payment is to be made, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1459, A RESOLUTION authorizing settlement and payment in the case of Pavlick vs. City of Yakima, and designating the fund out of which payment is to be made. WHEREAS, on January 23, 1957, a complaint was filed in the Superior Court of Yakima County by Steve Pavlick, alleging painful injuries sustaine as the result of a fall upon a sidewalk within the city, and alleging that said fat wa.s caused by the negligence of the City of Yakima, all occurring on January 24, 1954; and WHEREAS, that a notice of claim was timely filed against the City by said plaintiff as more particularly provided for in Article X of the City Charter; and WHEREAS, the.amount of said claim was in the sum of $9,002.95; and WHEREAS, it is deemed to be in the best interests of the City to compromise this law suit for the sum of $200.00, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. The City Commission hereby confirms the compromise settlement in the case Pavlick vs. City of Yakima, being cause No. 41451, in the sum of 8200.00, the payment of said amount to be in full and complete satisfaction of all claims against the City arising out of this litigation, including interest and court costs. Section 2. That the City Attorney is hereby authorized and directed to take whatever steps are necessary to conclude this settlement. Section 3. That the City Treasurer is hereby authorized to pay the sum of `200.00 to Steve Pavlick, c/o Brown, Hovis & Cockrill, Attorneys at Law, Miller Building, Yakima, Washington, in full satisfaction of all claims against the city arising out of this litigation. RESOLUTION NO. 1460, A RESOLUTION authorizing the Mayor to execute an agreement on behalf of the City of Yakima in connection with the compromise of a condemnation action entitled City vs. McCutcheon, et al. WHEREAS, the City of Yakima has instituted a condemnation action in Superior Court against the owners of certain real property located within the City for the purpose of widening and otherwise improving Buwalda Lane, said improvement being within Local Improvement District No. $47, and WHEREAS, representatives of the City and the owners have been negotiating for a compromise settlement of this case, the terms of said settlement being incorporated in a formal written agreement, and WHEREAS, it is deemed to be in the best interests of the City of Yakima to accept the terms of said agreement, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the Mayor is hereby authorized and directed to execute on behalf of the City that certain agreement with M. C. McCutcheon and Zetta B. McCutcheon, husband and wife, and James D. Bouyear and Frances M. Bouyear, husband and wife, the owners of the real property in question, said agreement containing the terms of settlement and wherein the city will acquire a 15 foot strip for the purpose of improving Buwalda Lane, a street within the City of Yakima. i 1 1 FEBRUARY 25, 1957 ADOPTED BY THE CITY COMMISSION this 25th day of February 1957. C -14611 A RESOLUTION accepting the bid of Seattle First National Bank for the purchase of $400,000.00 of general obligation library bonds of the City of Yakima.' WHEREAS, pursuant to notice of bond sale for the issuance of $400,000.00 of general obligation bonds, the city duly received three bids, said bids being submitted by Seattle First National Bank, Pacific Northwe -st Company, and National Bank of Commerce, and WHEREAS, each of said bids was in compliance with all statutory requirements pertaining to the sale of general obligation bonds, and WHEREAS, the effective rates of interest contained in said bids by Seattle First National Bank, Pacific Northwest Company, and National Bank of c Commerce were 3.116 %, 3.118%, and 3.246% respectively, and WHEREAS, after an examination of-all bids and after arithmetic computations therein, it has been determined that Seattle First National Bank was the low bidder on said library bonds, NOW,.THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the City Commission hereby accepts the bid of Seattle First National Bank for the purchase of,$400,000.00 of general obligation library bonds of the City and the proper city officers are hereby authorized and directed to proceed with.the printing and issuance of said bonds as provided for by law.
