Thel,City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews and Assistant City Attorney Carl Loy present on roll call.
The minutes of the regular meeting of February 4, 1957 and adjourned meeting thereof,,
were approved as read.
A hearing having been held on Resolution No. C -1449 on February 4, 1957 and there being
considerable protest to the formation of a Local Improvement '.,-District known ,as 36th
Avenue South Irrigation District and the City Engir;eer now reporting that the protests
represented only $.73% of the total assessed valuation for the 36th Aven South Area_.and
'51.89% for the Swan Tracts Area, both areas included is said Local Improvement District,
and since it is necessary that protests equal or exceed 60% of the total assessed valua-
tion before it is mandatory not to form an L.I.D., it was MOVED by Mathews, seconded by
Alderson that Ordinance No. B -1999 creating Local Improvement District 852 be passed
as read: carried, Alderson, Schutt and Mathews present on roll call.
ORDINANCE NO. B -1999, AN ORDINANCE providing for the improvement of property in the
City of Yakima, Washington by the construction of an irrigation system establishing a
Local Improvement District, providing for the method of payment, and creating a specil
fund..
This being the time-for the hearing on the assessment roll covering Local Improvement
District No. 833, being the 5th Avenue South Domestic Water Disrict and there being no
protests in writing or otherwise, it was MOVED by Mathews, seconded by Schutt that
Ordinance No. B -2000 confirming said assessment roll and every part thereof be passed as
read: carried,'-Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2000, AN ORDINANCE confirming the assessment roll covering Local
Improvement District No. 833 as created and established by Ordinance Rio. B -1836 of the
Ordinances of the LLCity of Yakima.
This being th "d4�me for receiving and considering bids for the purchase of approximately
25 tons of Kiln Dried Salt for the Street Department, bids were received from neseret'
Salt Company, Leslie Salt Co., Morton Salt Company, and Solar Salt Co., and it being
determined that all four salt bids are identical on F.O.B. Yakima prices, it was MOVED
by._Mathews, seconded by Schutt that the bid of Deseret Salt Comizany be accepted as the
best bid: carried, Alderson, Schutt and Mathews voting aye on roll call.
Bids for the purchase of crushed rock for the Street Department's 1957 operation having
been received on February 4, 1957 and referred to the City Engineer for tabulation and
recommendation, said tabulation shows that the bid of Yakima Cement Products Company
under Alternate A in the amount of $9,720.00, evaluation of bids for hauling the material
indicating that as much as possible should be hauled by the City's own forces, is the'
lowest and best bid. Moved by Alderson, seconded by Mathews said bid be awarded:
carried, Alderson, Schutt and Mathews voting aye on roll call.
Moved by Schutt, seconded by Mathews that the City Clerk be and is hereby authorized to
call for bids for a turbine pump for the Irrigation Department, said'pump to deliver
1,000 gallons per minute at 85 feet head, said bids to be received and considered at the
hour of 10 o t clock a.m. on Monday the 25th day of February, 1957: carried, Alderson,
Schutt and Mathews voting aye on roll call.
Moved by Mathews, seconded by Schutt that the City Clerk be and is hereby authorized to
call for bids for 100,000 pounds of Chlorine delivery F.O.B. sellers stockpoint at
Tacoma for the Water Department; said bid,9 t.Q 'be :,received and considered at the hour o-i'
10 otclock a.m. on Monday the 25th day of February, 1957: carried, Alderson, Schutt and
Mathews voting aye on roll call.
Mr. Albert B. Kurbitz requesting that he be allowed to hook up to the City Water mains
on his property located at the corner of Wright Avenue and Fruitvale Blvd., said property
being outside the city limits of Yakima, it was MOVED by•A19erson, seconded by Mathews
that this hookup be allowed. and the City Planning Commission, hereby instructed to prepare
the necessary agreement to cover this transaction: carried, Alderson, Schutt and Mathews
voting aye on roll call.
The City of Yakima seeking permission to construct, maintain, and operate a sewer line
across the railroad right -of -way- at Lenox Avenue and agreements having been submitted to
the City Commission by the Oreong- Washington Railroad & Navigation Company and its...Lessee
the Union Pacific Railroad Company, it was MOVED by Mathews, seconded by Schutt that
Resolution No. C -1457 authorizing the Mayor and City Clerk to execute said pipe line
crossing agreement,.=be`,.passed as read: carried, Alderson, Schutt and Mathews voting
aye on roll call.
RESOLUTION NO. C -1457, A RESOLUTION authorizing the execution of a pipe line crossing
agreement between the City of Yakima, a municipal corporation, and the Oregon - Washingtor
Railroad & Navigation Company, a corporation of the State of Oregon and its Lessee, Union
Pacific Railroad Company a corporation of the State of Utah.
WHEREAS, the City of Yakima a municipal corporation, desires',to
construct, maintain and operate one twenty -four (24� inch galvanized corrugated metal
sewer pipe line and twenty -four (24) inch reinforced concrete sewer pipe across the right
of way and underneath the road bed and track or tracks of the Railroad Companies at or
near Yakima, in the county of Yakima, State of Washington, in the location described as
follows:
The Engine erts Station 2893 plus 72 on the YakiiYia Branch,
Ordgon Division, of said Railroad Companies, and
WHEREAS, it is necessary that an agreement be entered into between
the City of Yakima, a municipal corporation, and.the Oregon - Washington Railroad &
Navigation Company and its Lessee, Union Pacific Railroad Company, granting to the said
City of Yakima, a municipal corporation, the right to construct, maintain and operate
said pipe line;

line and twenty -four (24) inch reinforced concrete sewer pipe across the right of way and
underneath the roadbed and track or tracks of the said Railroad Companies at the point
hereinbefore described.
