City Attorney absent. The minutes of the regular meeting of January 28, 1957 and the adjourned meeting thereof were approved as read. Moved by Alderson, seconded by Schutt that Resolution No. C -1453 providing for a special election to be held in the City of Yakima on Tuesday, March 26, 1957 and prescribing the form of ballot, said Resolution being.in accordance with the City-Charter and further negotiating a non - exclusive franchise to D.S.Peck to establish and operate a bus transportation service over the streets of the City of Yakima as set forth in Ordinance No. B -1992, passed January 28, 1957, be :passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -14532 A RESOLUTION providing for a special election to be held in the City of lakima on Tuesday, March 26, 1957, and prescribing the form of ballot therefor. WHEREAS, on January 28, 1957, Ordinance No. B -1992 relating to the granting of. a non - exclusive franchise.to D. S. Peck to establish and operate a bus transportation service over the streets of the City of Yakima was duly passed and approved by the City Commission; and WHEREAS, pursuant to the provisions of Article XI, Section 21 of the City Charter, said Ordinance is required to be submitted to a vote of the electors of the City for approval or disapproval; and WHEREAS,. the City Commissi.on is of the opinion and hereby de- clares that an emergency exists requiring said ordinance to be submitted to and voted upon by the electors of the City at a special election to be held thereon on March 26, 19571 NOW, THEREFORE, polling places in the 8:OOc-olclock A.M. and low. position to be submit" BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That a special City election shall be held at the City of Yakima on Tuesday, March 26, 1957, between the hours of 8:00 o 1 clock P.M. for voting upon the proposition set forth be- Section 2. That the caption of the ballot and the ballot pro - �ed to the voters at such special election shall be as follows: PROPOSITION NO. BUS FRANCHISE ,ORDINANCE Shall Ordinances No. B -1992, granting a non - exclusive franchise to D.S. Peck for a term of fifteen years to establish and operate a bus - transportation service over the streets of the City of Yakima, be approve? YES. . . . . . . NO. . . . . . . . . ALDERSON City Clerk Mayor Moved by Schutt, seconded by Alderson that Resolution No. C -1454 fixing the hours of work of employees of the Police Department of the City of Yakima at 40 hours per week instead of 44 hours per week as previously established, be passed as read:c'arried, Alderson, Schutt and - Mathews voting aye on roll call. RESOLUTION NO. C -1454, A,_RESOLUTION fixing.the hours of work of employees of the Police Department of the City of Yakima, Washington. WHEREAS, the hours of work of employees of the Police Department of the City of Yakima have heretofore been established at 44 hours per week; and WHEREAS, it is now deemed in the best interests of the City to reduce the weekly hours of said employees, . N.OW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the working hours of all employees. of the Police Department shall be, and the same are hereby established, 40 hours per week. ATTEST: J. A. ALDERSON Mayor Moved by Mathews, seconded by Alderson that the City Clerk be and is hereby authorized to advertise for bids for the purchase of an Asphalt Pressure Distributor Spray Bar and Pump Assembly for the Street Department, specifications for said equipment having been prepared by the Engineer and filed with the City Clerk, said bids to be received on or before 10 otclock a.m. on February 18, 1957 at which time they will be opened and considered: carried, Alderson, Schutt and Mathews voting aye on roll call. The City Engineer reporting for payment, estimate No. 1 on the Airport Extension for C. & E. Construction Company in the amount of $8,102.07, it was Moved by Mathews, seconded by Schutt that said estimate be paid: carried, Alderson, Schutt and Mathews voting aye on roll call. It was also reported by the City Engineer that the 4th and Final estimate for work performed by Carroll & Sanislo on the Jr.Sr. High School Sewer, amounted to $1,679.63 and that this payment would be paid directly to the contractor by the School Board. FEBRUARY. 41 1957 Moved by Schutt, seconded by Mathews that Resolution No. C -1455 prescribing the form of contract for the city advertising for the ensuing year and fixing the time for-re ceiving bids as February 18, 1957 at the hour of 10 o'clock a.m., be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1455, WHEREAS., by ordinance, it is provided that on the first Monday in February of each year, the City Commission of the City of Yakima, Washington, shall pass a resolution prescribing the form of contract for the city advertising for the en- suing year; NOW, THEREFORE, BE IT RESOLVED, by the City Commission that the form of contract for the city printing for the ensuiing year shall, be in substantially the form hereto attached and made a part hereof, and the City Clerk, is hereby directed to give notice for sealed proposals for a contract for doing the city advertising for the ensuingi, year by publishing the same for two consecutive issues in the newspaper dloin the city printing, which notice shall contain a general statement of the terms of the contract to be let, together with the time and place when said bids will be 'opened, and providing that any and all bids may be rejected. ADJOURNED MEETING, MONDAY, FEBRUARY 8, 1957, 8 O'CLOCK P.M. The.City.Cominission met pursuant to adjournment, Mayor Alderson,:Commi.ssioner Mathews and City Attorney Hawkins present on roll call. Commissioner Schutt absent. This being the time for the hearing on.Resolution No. C- 1449,'an ordinance creating a Local Improvement District to be known as the 36th Avenue South Irrigation District was read by the City Clerk. There being considerable protest from residents of certain Additions in this district, it was MOVED by Mathews, seconded by Alderson that the City Engineer evaluate the protests and make recommendations and report at the next regular meeting of the City Commission: carried, Alderson and Mathews voting aye on roll call. Schutt absent. No action was taken on the above memtioned ordinance. This being the time for the hearing -on the _.assessment .roll (for L.I.D. 834, being the 5th Avenue South Sewer District and there being no protests in writing or otherwise, it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -1997 co nfirming said assessment roll and every part thereof, be passed as read: carried,,Alderson,and Mathews voting aye on roll call. Schutt absent. - I ORDINANCE NO. B- 1997,• AN ORDINANCE confirming ,the ,assessment roll covering Local Improvement District No. 834 as created and established by Ordinance No. B -1848 of the Ordinances of the City of Yakima. RESOLUTION NO. C -1456, A RESOLUTION providing for the transfer of funds within the Police Department Budget. WHEREAS, -a shortage existed in the Gas, Oil and Grease item of the - Police Department appropriation in the 1956 budget, while there existed a surplus of funds in the General Expenses item in said appropriation, and WHEREAS, the City Commission deems it in the best interests of the City to make certain transfers within said Police Department appropriation, and WHEREAS, the action contemplated herein is authorized by R.,C.IW.. 35.33.120, i NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY' OF YAKIMA: Section 1. That $700.00 be and it is hereby transferred from the General Expense item to the Gas, Oil and Grease item, all within the "Maintenance and Operation" classification of the Police Department 1956 Budget, and the City Treasurer is hereby authorized, empowered and directed to make the aforementioned transfers within said fund. B -1998, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 830, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Mathews, seconded by Schutt that Ordinance No. B -1996 relating to residential and commercial driveway approaches and curb cuts; regulating size, location, number and gonstruction of same, be passed as read: carried, `Sch utt and Mathews voting aye on roll call. B -1996, AN ORDINANCE relating to residential and commercial driveway approaches and curb cuts; regulating size, location, number and construction of same; providing for variances; providing a penalty for the violation of this ordinance and re- pealing all ordinances and parts: of ordinances in conflict herewith.
