Mayor Behnke absent. The minutes of the regular meeting of October 29th and special meeting of October 31, 1956 were ap:)roved as read. Behnke absent. - ORDINANCE NO. B -1955, AN ORDINANCE amending Section 4502 of Ordinance No. B -1827, commonly known-as the Uniform Building Code. Moved.by Mathews, seconded by Schutt that Resolution No. C- 1428 being a resolution of intention to improve certain properties by constructing an irrigation system and fixing Monday the 26th day of November, 1956 for the hearing thereof, be adopted as read: carried, Schutt and Mathews voting aye on roll call. RESOLUTION NO. 01428, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That it is its intention to construct an irrigation system to serve the following described property, situate in the City of Yakima, Yakima County, Washington, to -wit: The East half of the Northwest Quarter, Southeast Quarter, Southeast Quarter,.of Section 22, Township 13, North, Range 18, E.W.M., except the South 65 feet of the North 90 feet of the W West 135.9 feet of the East 162.5 feet and except the right -of- way for streets. Also, Lots 1 to 14 of Heyduck Park Addition No, 2. said improienent to consist of the construction of'the necessary mains, laterals, service connections and other appurtenances for the purpose of delivering water for irrigation purposes�-to each lot and tract within the proposed district; and to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proppsed improve- ment are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 a.m. on Monday, the 26th day of November, 1956; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto; and for determining the method of pay- ment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the --ity Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. B -1956, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 838 as created and established by Ordinance No. B -1868 of the Ordinances of the City of Yal�ima. ORDINANCE NO. 5-1957, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 818 as created and established by Ordinance No. B -1730 of the Ordinances of the City of Yakima. This being the time for the hearing on Resolution No -: C -142.1 providing for the construc- of a domestic water system to be known as the Tahoma Avenue domestic Water District, and there being no protests in writing or otherwise to said improvemnt or any part thereof, it was MOVED by Mathews, seconded by Schutt that Ordinance No. B -1958 creating Local Improvement District No. 850, be passed as read: carried, Schutt and Mathews voting aye'on roll call. Behnke absent. ORDINANCE NO. B -1958, AN ORDINANCE providing 'for the improvement of property in the City of Yakima by the construction of necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection, establishing a Local Improvement District., providing for the method of payment therefor, and creating a special fund; This being the time for the hearing on assessment roll providing for the construction of the Swan Avenue Curb, Gutter and Surfacing District, L.I.D. No. 840 and there,bein.g vigorous protests from the property owners on the cost and benefits received from the project, it was MOVED by Schutt, seconded by Mathews that the ordinance confirming said assessment roll be tabled and that the City Engineer review the proceedings on the formation of this district and recheck said assessment roll and report his findings at the regular meeting of November 26, 1956: carried, Schutt and Mathews voting aye on roll call. C -1429, BE IT RESOLVED I?Y THE CITY COMMISSION OF THE CITY OF YAKIMA: That, WHEREAS, the untimely death of Carl Behnke, the duly elected mayor of the City of Yakima has left the City of Yakiaia without a mayor and WHEREAS, the charter and the State law is not clear as to who shall act as may until the selection and formal appointment by the surviving members of the Ci #y Commission, aryl WHEREAS, there are may matters requiring immediate action, and WHEREAS, it will take several days to select a qualified succes- sor to the office of mayor, NOW, THEREFORE, Kenneth Schutt be and is hereby designated acting mayor of the City of Yakima to perform the duties of the Mayor without any additional compensation until such time as the surviving members of the said City' Commission select and duly appoint a mayor and such appointee is duly qualified and sworn in in the manner provided by law. SCHUTT Acting Mayor 9 An Ordinance providing for the expenditure of funds not budgeted for the Street Depart- ment was introduced and read by the Clerk, said ordinance requiring the expenditure of the total sum of $43,432.00. It was ordered laid on the table to be read again and considered at the regular meeting on Tuesday, the 13th day of November, 195.
