The minutes of the regular meetin of October 8, 1956 and adjourned meeting thereof were approved as read. Moved by Mathews, seconded by Behnke that this being the time for the hearing on Resolution No. C -1412 providing for the construction of the necessary mains, fire hydrant and other appurtenances for the purpose of a domestic water system, and Waiver and Agreements having been signed by each and every property owner in said district, said agreement waiving any further hearings upon this local improvement district and author - izing the City to proceed forthwith, and there being no objection in writing or other- wise to said.improvement or any part thereof; it is ordered that Ordinance No. B -1943 creating L.I.D. Moved by Mathews, seconded by Behnke that, since it is mandatory not to form the districi if the protests equal 60 %, the above described deletion be made and that Ordinance No. B -1944 creating L.I.D. No. 847 be passed as read: carried, Behnke, and Mathews voting aye on roll call. Schutt not voting. / ORDINANCE NO. B -1944, AN ORDIMANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with the necessary drainage features and constructing-concrete sidewalks on one side of the streets, establishing a local improvement district pro- viding for the method of payment therefor, and creating a special fund. This being the time for the hearing on the assessment roll covering L.I.D. No. 815, being the 21st Avenue South Curb & Gutter District, and there being no objections in writing or otherwise to said assessment roll or any part thereof, it was MOVED by Mathews, seconded by.Schutt that Ordinance No. B -1945 confirming said assessment roll and every part thereof be passed as read: carried, Behnke, Schutt and Mathews present on roll call. Moved by Mathews, seconded by Schutt that Resolution No. C -1421, being a resolution of intention to improve all of `bract 56 and the South 125 feet of Tract 65 of First Addition to Suburban Acre Homes and other property more fully described in said resolution, by the constructing of a water system for domestic use and fire protection and fixing the date of hearing as Monday the 5th day of November, at 8 o'clock p.m., be passed as read: carried, Behnke, Schutt and Mathews voting eye on roll call. RESOLUTION NO. C -1421, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: t That it is its intention to improve the following described property by constructing the necessary mains, fire hydrants, valves and other appurten- ances for the purpose of supplying water for domestic use and fire protection: All of Tract 56 and the South 125 feet of Tract 65 of First Addition to Suburban Acre Homes; Also the N1 E2, S1, S2f NE4, NE1.of Section 35, Township 13 North, Range 18, E.W.M. The proposed Local Improvement District is to embrace all property adjacent to the above mentioned improvements which are. subject to assessment. All persons who may desire to object to said proposed improve- ments are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yal�ima County, Washington, at the hour of 8 o'clock p.m., on Monday, the 5th day of November, 1956, which time and place are here -:;y fixed for the hearing of all matters relating to said proposed improvements or objections thereto, and for determining the method of payment for said improvements; and the City Clerk is hereby directed to give notice of said hearing and of the intention to make the aforesaid improvements. A portion of the costs and expenses of said improvement includ- ing engineering, inspection, advertising, publication of notices, if any, and all other . expenses incident thereto shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the remainder of the said costs and expenses shall be borne'by the said Water Department and the City Engineer is hereby directed to submit to the City Commission all of the data and any other information required by law to be by him submitted; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the pity Clerks ATTEST: J. B-194&.9,_' AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the-improvement in Local Improvement District No. 819, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof, Moved by Mathews,,seconded by Behnke that Resolution No. C -1422 authorizing the settle- ment and payment of the claim of Casper Huber and Frances Huber from the sewer fund, claim being for damages by reason of flooding of premises at 318 North 29th Avenue., be passed as read: carried, Behnke,:Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1422, A RESOLUTION authorizing the settlement and payment of claim of Casper. Huber and Frances Huber from the sewer fund,. WHEREAS, on the 26th day of June, 1956, Casper Huber and Frances Huber filed a claim with the City of Yakima for damages by reason, of flooding of their premises at 318 North 29th Ave. , Yakima, Washington, and WHEREAS, without admitting liability, and solely for the purpose of.compromise, a settlement of-said claim has been accomplished in the sum of $300.00, and WHEREAS, to litigate said claim would cost substantially a larger sum, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the City hereby confirms the compromise settle- ment of said .claim of Casper Huber and Frances Huber in the sum of $300.00, the payment of said amount to be in full and complete satisfaction of all claims against the City arising out of this alleged flooding or subsequent floodings as shown by the attached release. Section 2. The City Treasurer is hereby authorized_ and directed to made the following payment out of the sewer fund: Casper Huber, Frances Huber, and Tunstall & Hettinger, their attorneys, $300.00.
