SEPTEMBER 17, 1956
The City Commission met in regular session, Mayor Behnke, Commissioners Schutt and
Mathews. and Assot Attorney Loy present on roll call.
The minutes of the regular meeting of Monday, September 10, 1956 were approved as read:
The Ordinance providing for the borrowing of $1,200,000.00 anal issuing and selling
negotiable general obligation bonds for the purpose of constructing a railroad grade
separation at Lenox Avenue, referred to as the "Lenox Avenue Overpass" and for certain
Improvements to city streets, arterials, and sidewalks to be.a part of a general plan a
portion of the cost of which shall be paid by Local Improvement District funds; and pro-
viding for the submission of the proposition of incurring such indebtedness and issuing
such general obligation bonds to the qualified electors of the city in a special election
to be held therein on November, 6, 1956, was read by caption only and this bein the
second reading of said ordinance, it was then tabled to be read again on the 2}th day of
September, 1956:

quency of installments and prescribing the form of bonds for L.I.D. No. 829, being the
26th Avenue South Curb and Gutter District, be passed as read: carried, Behnke, Schutt

quency of installments and prescribing the form of bends for L.I.D. No. 836, being Plath
Avenue Sewer District, be passed as read: carried, Behnke, Schutt and Mathews voting
aye on roll call.
Moved by Mathews, seconded by.Schutt that,a full width street having been dedicated
since the public hearing August 6, 1956 on the proposed plat submitted by R. E. Maddox,
Sr. and Frances B. Maddox, the Plat of West Walnut Addition be accepted as corrected:

RESOLUTION_NO ��,C- 1406;,.r:,A- :RESOLUTION providing for a special city election to be held in
the City of Yakima on tuesday, November 6, 1956, and prescribing the form of ballot
therefor.
WHEREAS, On August 27, 1956, Ordinance No. B -1924 relating to the
Regional Library building bond issue was passed and approved by the City Commission of
the City of Yakima, and a certified copy thereof was duly transmitted to the County
Auditor of Yakima County; and said ordinance;_provides for a special election to be held
thereon on November 6, 1956, and prescribes the form of ballot proposition therefor;
Now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That an emergency with reference thereto exists by
'readon of the urgent need for funds for the purpose of contributing towards the cost of
constructing and equipping of a new regional library building; and that a special city
election shall be held at the polling places in the City of Yakima on Tues'day, November
60 1956, between the hours of 8:00 o'clock a.m. and 8:00 o'clock p.m. for voting upon
the said proposition and for approval or disapproval of said regional library bond
issue.
Section 2. That as provided in Section 3 of said Ordinance No.
B -1924, the caption of the ballot and the ballot proposition used at said special
election with reference to said Regional Library bond issue shall,be as follows:
"PROPOSITION NO.
REGIONAL LIBRARY IMPROVEMEENT BONDS - $4009000.00
Shall the City of Yakima, Washington, issue its general obligation bonds
in the principal sum of $400,000.00, said bonds to bear 'interest at a rate of not to
exceed 6% per annum, to mature in from two to twenty years from date of issue,'and to
be payable both principal and interest by annual tax levies to be made without limita-
tion-as to rate or amount, for the purpose of contributing toward the cost of construct-
ing and equipping a new regional library building, with sufficient additional funds to-
be provided bythe Rural County Library District of Yakima County, said regional library
building to be located in the vibinity of the corner of North 3rd Street and East A
Street, in the City of Yakima, as more specification provided by an ordinance of the
City, passed and approved August 27, 1956.

The alley between South 7th Street and South 8th Street, from
East Beech Street to Race Street.
The'proposed Local Improvement District is to embrace all proper-
ty adjacent to the above mentioned improvements which are subject to assessment.
All persons who may desire to object to said proposed improve-
ments are hereby notified to appear and present such objections, if any, at a meeting of
the City Commission to be held at its office in the City Hall in the City of Yakima,
Yakima County, Washington, at the hour of 10 o1clock a.m., on Monday, the 8th day of'
October, 1956, which time and place are hereby fixed for the hearing of all matters re-
lating to said proposed improvements or objections thereto, and for determining the
method of payment•for said improvements; and the City Clerk is hereby directed to give
due notice of said hearing and of the intention to make the aforesaid improvements.
✓ All costs and expenses in connection with the construction of
said improvement, including the engineering, inspection, advertising, publication of
notices and all other expenses incident thereto, shall be levied and assessed against
all of the property legally and properly assessable therefor as provided by law and as
above described; and the City Engineer is hereby directed to submit to the City
Commission at or prior to the date fixed herein for said hearing, all of the data and
other information required by law to be by him submitted; all of said improvements to be
constructed tin full accordance with the plans and specifications to be prepared by the
City Engineer and filed with the City Clerk.

An Ordinance providing for the preparation of plans and specifications by an architect
or engineer in certain cases and amending Section 301 (d) of the Uniform Building`Code
of Yakima, was read and tabled to be considered at a later date.

18, 1956 at 3 o1clock p.m. with Mr. Syd G. Turner, Vice President and Manager of
Sherwood and Roberts to discuss the city's contract with said firm and the needed re-

WHEREAS, on September 21, 1956, Ordinance No. B -1935 relating to
the Business and Occupation tax ordinance referendum was passed and approved by the
City Commission of the City of Yakima, and a certified copy thereof was duly trans-
mitted to the County Auditor of Yakima County; and said ordinance provided for a special
-election to be held thereon on November 6, 1956, and prescribes the form of ballot
proposition therefor; Now, therefore,
BE.IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF Y.AKIMA:
Section 1. That an emergency with reference thereto exists by
reason of the fact that total anticipated revenues for the calendar year 1957 are in-
sufficient to defray the necessary and legitimate expenses of operation of the govern-
ment of said city, and that the city of Yakima has deemed it advisable to submit the
aforementioned ordinance to a vote of the people for ratification or. rejection; and
that a special city election shall be held at the polling places in the City of Yakima,
on Tuesday, November 6, 1956, between the hours of 8:00 o'clock a.m. and 8:00 o'clock
p.m. for voting upon the said proposition and for ratification or rejection of said
business.and occupation tax ordinance referendum.
Section.2. That as provided in Section 2 of said Ordinance No.
B -1935 the caption of the ballot and. the ballot proposition used at said special election
with reference to said business and occupation tax ordinance referendum shall be as

RESOLUTION N0. C -1411, A RESOLUTION providing for a special city election to be held
in the City of Yakima on Tuesday, ON 6, 1956, and prescribing the form of Pallot
therefor.
WHEREAS, on September 21, 1956, Ordinance No. B -1936, relating
to the Lenox Avenue Overpass and street improvement bond issue was passed and approved
by the City Commission of the City of Yakima, and a certified copy thereof was duly
transmitted. to the County Auditor of Yakima County; and said ordinance provides for a
special election to be held thereon on November 6-, 1956, and prescribes the form of
ballot proposition therefor; Now , therefore,
BE IT RESOLVED BY THE CITY COMMISSION'OF THE CITY OF YAKIMA:
Section 1. That an urgent need exists for funds for the pur-
pose of constructing a railroad grade separation at Lenox Avenue, referred to as the
"Lenox Avenue Overpass ", and for certain improvements to city streets, arterials,
and sidewalks; and that a special city election shall be held at the polling places in
the'City,.of Yakima on Tuesday, November 6, 1956, between the hours of.8:00 o'clock a.m.
and 8:00 ot-clock p.m. for voting upon the said proposition and for approval or dis-
approval of said Lenox Overpass and street improvement bond issue.
v Section 2. That as provided in Section.6 of said Ordinance
No. B -1936 the caption of the ballot with reference to said Lenox Overpass and street
improvement bond issue shall be as follows:
PROPOSITION NO.
LENOX AVENUE OVERPASS AND STREET IMPROVEMENT BONDS - $1,200,000.00
Shall the City of Yakima, Washington, issue its general.obliga-
tion bonds in the principal sum of $12200,000.00, said bonds to
bear interest at a rate of not to exceed 6% per annum, to mature
in from two to ten years from date of issue, and to be payable
both principal and interest by annual tax levies to be made with-
out limitation as to rate or amount, for the-purpose of construct-
ing a railroad grade separation. at Lenox Avenue, referred to as the
"Lenox-Avenue Overpass ", and for making certain improvements to city
streets, arterials, and sidewalks, to be part of a general plan pre-
pared by the `'ity Engineer -under date of September 6, 1956, and on
file in the office of the ity Clerk, all as more specifically pro-
vided in Ordinance No. B -1936 of the "ity, passed and approved
September 21, 1956. -
