HomeMy WebLinkAbout09/10/1956 Business Meeting1 1 1 SEPTEMBER; 10, 1956 The City Commission met in regular session, Monday, September 10, 1956, Mayor Behnke and Commissioners Schutt and Mathews and- Assistant Attorney Loy present on roll call. The minutes of the special session and regular session of Monday, September 4, 1956 were approved as read.. An Ordinance providing for the borrowing of $1,200,000.00 and issuing and selling ne- gotiable general obligation bonds for the purpose of constructing a railroad grade separation at Lenox Avenue, referred to as the "Lenox Avenue Overpass" and for certain improvements to city streets, arterials, and sidewalks to be a part of a general plan a portion of the cost of which shall be paid by Local Improvement District funds; and providing for the submission of the proposition of incurring such indebtedness and issuing such general obligation bonds to the qualified electors of the city in a special election to be held therein on November 6, 1956, was read by the City Clerk and laid on the table to be read again on September 17, 1956: An Ordinance providing for a'.-.license or occupational tax upon certain business, occupa- tions, pursuits and privileges; providing for the necessary administrative machinery for the. collection and enforcement of the licenses and taxes;.was read by the City Clerk and laid on the table to be read again bn SeptEiiiber 17; °1956. The meeting was then opened to discussion of this ordinance. Twenty- two.pe -r sons were.:heard` and registered protest. Moved by Mathews, seconded by Schutt that we do now adjourn to meet again at 1:30 p.m. Monday, September 10; 1956• ADJOURNED MEETING, MONDAY; SEPTEMBER 10, 1956, 1:30 P.M. The City Commission met pursuant-to adjournment, Mayor Behnke, Commissioners Schutt and Mathews and City Attorney Hawkins present. on roll call. Moved by Mathews, seconded by Behnke that Ordinance-No. B -1928 fixing the time of de- linquency of installments and prescribing the form of bonds for L.I.D. No. 839 being the Lots .1 to 27 Liebert Addition Sewer District, be passed as read: carried, Behnke, Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Schutt that the bid of J. Johnson in the - amount of $509.00, being the best bid for one dwelling unit located at the Yakima Municipal Airport be awarded and the City Clerk instructed to notify said bidder of his successful purchase: carried, Behnke,,Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Behnke that those certain items not awarded on August 29, 1956 for the purchase of materials and supplies for the Water Department be awarded as follows: Items 22 to 26 inc. relating to hub and valves be awarded to Waterworks Suppliers Company (Mueller Valves) $9,185.85 Items 20 to 23 inc. on Mechanical Joint Valves be awarded to Rensselaer Valve Company 4,005.04 carried, Behnke, Schutt and Mathews voting aye on roll call. This being the time for the report by the City Engineer on the protests registered against Resolution Not C -1403, being a resolution of intention to improve Del Mar Terrace and others more fully described in said resolution,by constructing curbs and gutters and surfacing said streets, and the City Engineer reporting that in considering the entire district 55.0% protest was registered and that eliminating-Hillcrest and Tieton Drive 51.4% protest was registered and that since the statutory requirement is, that if,''60%c,brotest is filed it is mandatory not to form the district; it was MOVED by Mathews, seconded by Schutt that this local improvement district not_ be formed; carried Behnke, Schutt and Mathews voting aye on roll call. Moved by Schutt seconded by Ms.thew.s that the City Clerk be instructed -to call for bids for the construction-of sanitary sewers in Weber Square & 4th Avenue North-at Cherry Aven}ie, said bids to -be received up to the hour of 10 o'clock A.M. on the 24th day of Septe,Imber 1956 at which time bids will be opened and considered: carried, Behnke, Schutt and Mathews voting aye on roll call. ^ Moved by Mathews, seconded by .Schutt that the damage claim of Mr'. Mc Mechan in the amount of $372.00 to compensate for damages done to his pear orchard by-the contractor when a,sewer line was'placed through his orchard, be allowed and that the City Clerk be instructed to pay this amount from.the - Maintenance & Operation Supplies in the Water Department Fund: carried, Behnke, Schutt and Mathews voting aye on roll call. Moved by Schutt, seconded by Mathews that the Cit Clerk be instructed to publish the the Notice of Ground Water Right Application No.- L12, being notice of application for permit to withdraw public ground waters,through an infiltration gallery situated within the VW-1 NW SW4 of Section 10, Township 13 N, Range 18 E.W'.M. in Yakima County in the amount oi'_ 000 gallons per minute, subject to existing rights continuously, each year for the purpose of municipal supply: carried, Behnke, Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Schutt that we do now adjourn to meet again in regular session on Monday, September 17, 1956 at the hour of 10 o'clock a.m.: carried, Behnke Schutt and Mathews voting aye on roll call.
