The minutes of the regular meeting of Monday, May 21, 1956 and adjourned meeting therof, be approved as read. This being the time for the hearing on the petition of Florence Swaff ord, James S. Raynor, and others for the annexation of property beginning at the intersection of the center, line of 16th Avenue South with the center line of Grant.Street, and other property more particularly set forth and described in said petition, and there being no objections to said annexation proceedings or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance no. B- 1881, annexing said above described territory and every part there- of, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -14871 AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. Moved by Huza, seconded by Huey that Ordinance No. B -1888 providing for the expenditure of funds not.budgeted for the Building Department, in the sum of $445.50 for payment of the cost of examination and checking the plans and specifications of the new school building near Tieton Drive and 40th Avenue be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1888, AN ORDINANCE providing for the expenditure of funds not budgeted for the Building Department, and declaring an emergency. Moved by Huey, seconded by Huza that Ordinance No. B -1889, repealing Ordinance No. B -1660 which provided for the formation of an enlarged local improvement district for the improvement of Gilbert Park located in "The Uplands ", be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1889, AN ORDINANCE repealing Ordinance No. B -1660 which provided for the formation of an enlarged local improvement district for the improvement of Gilbert Park located in "The Uplands ". Moved by Huey, seconded by Huza that Ordinance No. B -1890, relating to the municipal sewerage system and additions and betterments thereto and extension thereof', and the financing, maintenance and operation thereof as a public utility; providing for rates and charges; for the creation of a special "Sewer Fund" into which shall be paid all revenues, etc., be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1890, AN ORDINANCE relating to the municipal sewerage system and addi- tions and betterments thereto and extensions thereof; and the financing, maintenance and operation thereof as a public utility; providing for rates and charges; for the creation of a special "Sewer Fund" into which shall be paid all revenues and out of which shall be paid all expenses of said system; and for the administration and enforcement of this ordinance;, and declaring an emergency. Moved by Huey, seconded by Huza that Ordinance No. B -1891, amending Section 5, of Ordinance No. B -1881, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 1391, AN ORDINANCE amending section 5 of Ordinance No. 'B-1861 entitled "AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington, by constructing an irrigation system toserve various lots and tracts of land; establishing a Local Improvement District; providing for the method of payment therefor, and creating a special fund ". Moved by Huey, seconded. by Huza that the City Engineer having reported the completion of the Petzel Addition Sewer District, L.I.D. No. 832, by the contractor in the sum of 52,121.98, said work is hereby accepted and the City Engineer instructed to prepare an assessment roll for said district, and the City Clerk authorized to give notice of hearing on said roll for Monday, the 18th day of June 1956, at 10 o'clock A.M.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza Examining Board, as provided by the City of Yakima, on the 21st Wayne Schoonover, Fire Marshal to be for one year from date of on roll call. that the following named persons be appointed to the Ordinance No. B -ld64, passed by the City Commission of` day of May, 1956: Richard A. Dittmar, Robert Leichnitz and Paul Probach, Plumbing Inspector, said appointments appointment: carried,- Burns, Huza and Huey voting aye Moved by Huey, seconded by Huza that John Calderon be allowed to connect his property to the sewer line located within the city limits of the City of Yakima, subject to the terms set forth in resolution No. C -1388 and contract and waiver as provided by the City Ordinances of the City of Yakima in such cases made and provided: carried, Burns Huza and Huey voting aye on roll call. Pd WHEREAS, JOHN CALDERON, is the owner of the following described real estate situate in Yakima County, Washington, to -wit: Beg.inriing 145 feet west of the northeast corner of the Southeast quarter of Section 27, Township 13 North, Range 18 E.W.M.; thence south along the east line -of said subdivision 126 feet; thence west 145 feet; thence north 126 feet to the point of beginning, in Yakima County, Washington, said property being located near but outside the city limits of the City of Yakima; and he desires to connect said property with the sewer line heretofore constructed W the City of Yakima adjacent thereto; and he has executed a sewer connection contract and a waiver in the customary form pertaining thereto; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: 1 LI1 1 1 MAY 28, 1956 That the "ity of Yakima does hereby approve said sewer connection contract and hereby consents that said property owner may connect said property with the sewer line heretofore constructed by the City of Yakima adjacent to said real estate and said city consents that said property owner may use the said sewer line for the disposal of domestic sewerage in connection with the use of said property, subject to the payment of sewer charges as and. when provided therein, namely, $36.00 per annum, payable annually in advance. BURNS City Clerk Mayor Moved by Huey, seconded by Huza that the City Commission heretofore called for bids for the construction of a reinforced concrete bridge across the Wide Hollow Creek at the Municipal Airport, and at•the time said bids were received they were deemed excessive by the "ity Commission and were therefore rejected, and it is now deemed advisable for said City of Yakima to proceed to construct said bridge by force account; it is there- fore ordered that said work proceed according to the ab7D ve plan and Resolution No. C -1389: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C- 1389,, WHEREAS, -the City of Yakima has heretofore called for bids for the hereinafter described project and all o.: the bids submitted were deemed excessive and. were therefore rejected by the city; and it is deemed for the best interest of the city that said project be carried out by force account as hereinafter provided; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA,: That a new concrete reinforced bridge over Wide Hallow Creek at the Yakima Municipal Airport to replace the wooden bridge that was damaged.by the recent flood water, shall be constructed and the road connecting with said. bridge shall be graded, gravelled and improved and other necessary road work at said airport shall be done, all of the same to be done by force account of Nate Kimball who was one of the bidders on said project, on a cost plus basis; and the City Lngineer is hereby author- ized and directed to do any and all things necessary or proper for carrying out this resolution; and the same when completed shall be paid fcnr out of the airport fund. Moved by Huey, seconded by Huza that Resolution No. C -1390 providing for the acceptance of the South Interceptor Sewer Contract and such other provisions contained therein, is hereby adopted: carried, Burns, Hu.za. and Huey voting aye on roll call. RESOLUTION NO. C -1390, BE IT RESOLVED BY THE CI`T'Y COMMISSION OF THE CITY OF YAKIMA: That pursuant to the recommendation of-Stevens & Thompson, consult- ing engineers, the City of Yakima does hereby accept the completion and full performance of the South Interceptor Sewer contract originally entered into with J. M. Collins and thereafter completed by the Great American Indemnity Company through Matt Malaspina Company; subject only to the matter of a.small leak in sluice gate in Special Manhole No. 1, and if the same is not satisfactorily sealed by adjustments to said sluice gate within thirty days from this date, then in making final settlement at that time the sum of,$250.00 shall be retained until this is accomplished; and final settlement shall be made with Great American Indemnity Company at the termination of said thirty day period provided by law for the filing of claims, subject to payment or settlement of any claims filed prior thereto. Linse residing at 4202 Summitview Avenue be permitted to hook up to the City Sewer at said address subject to the execution of a contract and waiver as provided for by the ordinances of the City of Yakima in such cases made and provided, by adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1391, WHEREAS Wesley W. Linse and Mary C. Linse, husband and wife, the owners of the property situate at 4202 Summitview Avenue, adjacent to the City of Yakima, Washington, said property being located near but outside of the city limits of the City of Yakima; and they desire to connect said property with the sewer line heretofore constructed by the City of Yakima adjacent thereto; and they have executed a sewer connection contract and a waiver in the customary form pertaining thereto; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the 6ity of Yakima does hereby approved said sewer connection contract and hereby consents that said property owners may connect said property with the sewer line hertofore constructed by the City of Yakima adjacent to said real estate and said city consents that they may use the said sewer line for the disposal of domestic sewerage in connection with the use of said property, subject to the payment of sewer charges as and when provided therein, namely $18.00 per annum, payable annually in advance. _. J. Lenz and wife in the sum of $162.50; it was MOVED by Huey, seconded by Huza that said bid be accepted and the '-ity Attorney directed to prepare a resolution authorizing the sale by the City of Yakima of said property and the execution of a deed by the Mayor and City Clerk to said A. B -ld92, AN ORDINANCE relating to and regulating the sanitation and health requirements of public food establishments, restaurants, drinking places, grocery stores and food markets, and the issuance and revocation of licenses and permits with reference thereto, including food and beverage service worker's permits; providing for the payment of application, license, and permit fees in connection therewith; prescribing penalties for violations thereof; amending section 2 and repealing section 5 of Ordinance No. B -56; and declaring an emergency. Moved by Huza, seconded by Burns that Ordinance No. B -1893, relative to the operation of the Water Department regarding delinquent bills, etc., be passed as read: carried., Burns, and Huza voting aye on roll call. B -18931 AN ORDINANCE repealing Section 34, and amending Section 36 of Water Code Ordinance No. B -606, entitled: "AN ORDINANCE relating to and regulating the operation.of the Water Department of the City of Yakima; providing for the management and control thereof; providing for rules regulating and fixing the use and price of water supplied by the `'ity and connections therewith; amending and rewriting Ordinance A -988 as amended; providing penalties for the violation thereof; repealing certain ordinances and declaring an emergency;" and prescribing penalties for delinquency in the payment of water bills. WHEREAS, a petition has been filed with the Uity Commission of the City of Yakima, municipal corporation, praying for the vacation of a portion of a street described as follows, to -wit: 55th Avenue from the north line of Richey Road to the north line or Ressel Home Tracts, in Yakima, Yakima County, Washington. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That said petition shall be brought on for hearing and determin- ation on Monday, the 25th day of June, 1956, at the hour of 10:00 o'clock a.m. on the said day at the office of the City Commission of the City of Yakima, at the City Hall in Yakima, Yakima County, Washington, or as soon thereafter as the same may be heard, and that notice of such hearing be given as provided by law. day of May, 1956.
