The minutes of the regular meeting of Monday, April 30, 1956 and adjourned meeting thereof, be approved as read. This being the time for receiving bids for the 26th Avenue South Curb and Gutter distr L.I.D. No. 829, the following were received: DeAtley Paving & Crushing, Inc. $1,166.60 DeBlasio Bros. 4 447.90 Also bids for the Liebert Addition Sewer District, L.I.D.a•No.839, the following were received: G. G. Teskey Carroll & Sanish Paul Henley DeBlasio Bros 44,957.65 44,641.80, X4,376.85 44,092.50 Also bids on the Swan Avenue Curb and Gutter district, L.I.D. No. 840, the following were received: DeAtley Paving & Crushing, Inc. $5,851.33 DeBlasio Bros. - 45,101.28 All of the above bids were turned over to the City Engineer for compilation and recommendation. Moved by Huza, seconded by Huey that Ordinance No. B -1877, which was introduced on Monday April 30, 1956, and read in full by the City Clerk, and laid on the table for one week, providing for the expenditure of $1,168.73 for the Airport as an emergency which was not budgeted for 1956, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1877, AN ORDINANCE providing for the expenditure of funds not budget- ed for the Airport, and declaring; an emergency. This being the time for the hearing on Resolution No. C -1364, providing for the vaca- tion on the East 12.5 feet of the West 306.25 feet of the South 111.7 feet of the North 136.6 feet of Lot 16, of the Plat of Section .36 -13 -18 EWM, and there being no objections in writing or otherwise to said vacation proceedings, or any part thereof; it was Moved by Huey, seconded by Huza that Ordinance No. B -1878, vacating said above described property and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1878, AN ORDINANCE providing for the vacation of Fourth Avenue South immediately south of King Street, in the City of Yakima, Yakima County, Washington. This being the time for the hearing on the annexation proceedings of the Westover Terrace Addition and also property owned by Diek Maddox, which property extends to Tieton Drive; and it appearing that the ordinance. passed did not state the Zone and Area classification of said property to be annexed; it was MOVED by Huey, seconded by Huza that the City Attorney be instructed to rewrite said ordinance specifying the zone and Area classification, and said annexation proceedings be held in abeyance pending such revision of said ordinance: carried, Burns, Huza and Huey voting aye on roll call. This.being the time for receiving bids for the purchase of two new 2 ton trucks for the Sanitation Department, the following bids were received: Bell -Wyman Company in the sum of $p,,038.22; Burrows Motor Company in the sum of 05,884.68: It was MOVED by Huza seconded by Huey that said bids be taken under advisement: carried, Burns, Huza and Huey voting aye on.roll`•call. Moved by Huza, seconded by Burns that the report of the Investment Committee for investments purchased during the month of April 1956, be approved as follows: carried Burns, Huza and Huey voting aye on roll call. ADJOURNED MEETING, WEDNESDAY, MAY 9, 1956, 10:00 A.M. The City Commission met pursuant to adjournment, Mayor Burns and Commissioners Huza and Huey present on roll call. Moved by Huey, second by Huza that the bid of Bell -Wyman Company for two trucks for the Sanitation Department in the sum of $5,179.36 is hereby accepted as the lowest and best bids: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the bid of DeBlasio Bros. in the sum of $447.80 for the construction of concrete curbs and gutters on 26th Avenue South L.I.D. No. 829, be accepted and the Mayor and City Clerk instructed to execute a contract on behalf of the City of Yakima for doing said work upon the filing of the proper bond therefor as required by law; carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the bid of DeBlasio Bros. in the sum of 44,092.50 for the Liebert Addition Sewer district L.I.D. No. 839 is hereby accepted and the Mayor and the �Iity Clerk instructed to execute a contract on hehalf of the "ity of Yakima for doing said work upon the filing of the proper bond therefor as required by law: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the bod of DeBlasio Bros. in the sum or 4y,101.33, for the construction of the Swan Avenue Curb and Gutter District, L.I.D. No. 840, is hereby accepted and the Mayor and City Clerk instructed to execute a contract on behalf of the ity of Yakima, for doing said work upon the filing of the proper.bond as re- quired F;y law; carried, Burns, Huza and Huey voting aye on roll call. A communication having been presented to the ity Uoirmission from Bea�laurier & Hanson, Attorneys, rearesenting property owners within' the boundaries of that area which was recently annexed to the City of Yakima by Ordinance No. B -1781, for the purpose of con- testing the legality of said annexation; it was MOVED by Huey, seconded by Huza that, the matter be referred to the City Attorney: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that upon receipt of a telegram from Stevens and Thompson, Engineers stating that work on the industrial Waste Contract heretofore made with said Engineers, would be held in abeyance pending further instructions from the City Commission of Yakima; said action is hereby confirmed: carried, Burns, Huza and Huey voting aye on roll call.
