The City Commission met in regular session, Mayor Burns and Commissioners Huza and Huey
present on roll call.
The minutes of the regular meeting of Monday, April 23, 1956, were approved -as read.
This being the time for the hearing on the vacation of a lU foot strip of land situated
on 20th Avenue from Lombard Lane to the Naches & Cowiche Ditch and it appearing that a
suit has been filed in the Superior Court to quiet title on the above described proper-
ty; it was MOVED by Huey,.seconded by Huza that the hearing on said vacation proceedings
be postponed until such time As the suit now pending in the Superior Court to quiet
title has been settled: carried, Burns, Huza and Huey voting aye on roll call.
This being the time for the postponed hearing on the vacation of that certain roadway
approximately 20 feet wide running along the west line of the E2 of the NE4 of the NW4
of Section 27 -13 -18 EWM, such roadway running from Tieton Drive to the.south line of a
road designated as Arlington, and it appearing that said. road was privately owned and
has never been dedicated, the petitioner, School District No. 7, has asked that the City
take no further action in said vacatiomi.proceedings: carried, Burns, Huza and Huey
voting aye on roll call.
This being the time for receiving bids for the purchase of a 2 -door Station Wagon for
the Engineering Department, the following were received:

Moved by Huza, seconded by Huey that said bids be taken under advisement: carried,
Burns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to advertise
for bids for the construction of a reinforced concrete bridge 24 feet in width and 32
feet long, situated over Wide Hollow Creek at the Yakima Municipal Airport.; said bids
to be received on Monday, the 14th day of May, 1956, at 10 o'clock a.m.: carried,
T3urns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the rezoning of Lot 6 Block I, Johnson's Corner
Subdivision, from "B" Residence to Limited Business District Area 2, is hereby rejected:
carried, Burns, Huza and Huey voting aye on roll call.
An ordinance was introduced providing for the expenditure of funds not budgeted for the
Airport, requiring the sura of $1168.73 for the payment of premium for fire and extended
coverage for insurance; said ordinance was read in full by the City Clerk and laid on
the table for one week as provided by law and the City Charter.
Moved by Huey, seconded by Huza that Resolution No. C -1368, being a resolution of in-
tention to construct an irrigation system for all the lots in Chestnut Park Addition,
hearing on said resolution to be on Monday the 21st day of May, 1956, at 10 o'clock
a.m. is hereby adopted as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -13681 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That it is its intention to construct,-.'.an irrigation system to
serve the following described property, situate in the City of Yakima, Yakima County,
Washington, to -wit:
All los in Chestnut Park Addition to the City of Yakima,
according to the official plat thereof recorded in the
office of the Auditor of Yakima County, Washington;
said improvement to consist of the construction of the necessary headworks, main line,
laterals, service connections and other appurtenances to deliver water for irrigation
purposes to each lot within the proposed district; and to be constructed in full
accordance with the plans and specifications to be prepared by the City Engineer and
filed with the City Clerk.
All persons who may desire to object to said proposed improve-
ment are hereby notified to appear and present such objection., if any, at a meeting of
the City Commission to be held at its office in the City Hall in the City of Yakima,
Yakima County, Washington, at the hour of 10:00 o'clock a.m. on Monday the 21st day of
May, 1956; which time and place are hereby fixed for the hearing of all matters relating
to said proposed improvement or objections thereto, and for determining the method of
payment for said improvement; and the City Clerk is hereby directed to give due notice
of said hearing and of the intention to make the aforesaid improvement'.
The costs and expenses of said improvement, including the
engineering, inspection, advertising, publication of notices and all other expenses
incident thereto shaii be levied and assessed against all of the property legally and
properly assessable therefor, as provided by law and as above described; and the City
Engineer is hereby directed to submit to the City Commission at or prior to the date
fixed herein for said hearing, all of the data and other information required by law
to be by him submitted.

Moved by .Huey, seconded by Huza that Resolution No. C -1369 providing for the transfer
of $15,000.00 from the City Water Department to the City Street fund, as a temporary
loan caused by a large ;expenditure from the Street fund on account of severe winter
weather and said extra expenditure not being anticipated in the 1956 budget; it is
ordered that said resolution authorizing said transfer of funds be adopted as read:

RESOLUTION NO. C -13691 WHEREAS, unusually severe winter weather conditions have necessi-
tated large expenditures by the City Street Department since January 1, 1956, for snow
removal, street maintenance and repairs, and similar purposes; and by reason thereof all
of the funds in the-City Street Department fund have been temporarily exhausted; but
said street department has not exceeded its annual budget requirements, and substantial
revenue will be abailable to said street fund within the next several months from state
gasoline tax revenue and millage from county general taxes, and other lawful revenue of
said street fund; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the appropriate city officials are hereby authorized and
dired.ted to transfer and there is hereby transferred the sum of $15,000.00 from surplus
funds of the City Water Department to the said Street Department fund as a temporary
loan; and the same shall be repaid by the Street Department fund to the Water Depart-
ment as.soon as practicable during theyear 1956, the same to be repayable as soon as
funds therefor are received by the Street Department Fund, together with interest 'there-
on at the rate of 4% per annum from the date hereof until repaid.

Moved by Huey, seconded by Huza that Resolution No. C -1370, relative to salvaging
materials from the city dump be cancelled and terminated, and the Mayor and 'ity Clerk
are hereby authorized to execute an agreement on behalf of the City of Yakima, with
W. M. Coleman, at an agreed price of §75.00 per month for a term of one year, for doing
said work, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -13701 BE IT RESOLVED BY THE CITY COMMISSION. OF THE CITY OF YAKIMA:
That all agreements heretofore made with reference to salvaging
materials from the city dump are hereby cancelled and terminated; and the Mayor and
City Clerk are hereby authorized to execute an agreement on behalf of said city with
W. M. Coleman with reference thereto, at an agreed rental of $75.00 per month, payable
monthly in advance, for a term of one year commencing May 1, 1956, upon the terms and
conditions more fully provided in said agreement, copy of whic.ft is attached hereto
and incorporated by reference herein.

Moved by.Huza, seconded by Huey that the City Treasurer is hereby-authorized and
directed to transfer the sum of $6,000.00 from the City water fund to the "Principal
and Interest Account" of the Water and Sewer Revenue Bond Fund, 1956, to pay the semi-
annual interest due on July 1, 1956 on the X400,000.00 water and sewer revenue bond
issue 1956, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -1371, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the City Treasurer is hereby authorized and directed to
transfer, and there is hereby ordered transferred the sum of $6,000.00 from the Water
Fund to the "Principal and Interest Account" of the "Water and Sewer Revenue Bond Fund,
1956" which was created by Ordinance No. B -1793; and the Oity Treasurer is directed to
use such part thereof as may be necessary to pay the semiannual interest due on July 1,
1956, on the $400,000.00 water and sewer revenue bond issue, 1956, pursuant to
Ordinance No. B -1794, and to do any and all things necessary or proper for carrying
out the terms of this resolution and making said interest payments.

Moved by Huey, seconded by Huza providing for a compromise settlement between Mat
Malaspina and Great American Indemnity Company and the City of Yakima, be adopted as
read: carried, S'urns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -1372, WHEREAS, on April 11, 1956, Matt Malaspina and Great American
Indemnity Company entered into a written compromise settlement agreement with the City
of Yakima, subject to the approval of the City Commission, the terms of which are as
follows:
"Subject to.the approval of the City Commission, it has been
today agreed in conference that all caaims of Matt Malaspina
and the Great American Indemnity Company against the City of
Yakima for extra compensation on the South Interceptor Sewer
project shall be and are hereby compromised and settled on the
following basis:
"1. Malaspina shall forthwith correct and rectify the leaks.
now existing on the side sewers which were installed as extra
work and the City agrees to pay him one -half the pump rental
plus the additional cost of labor, materials and other equip-
ment rental (without overhead) incurred in connection there-
with.
"2. Malaspina agrees to complete all clean up work as soon as
possible and agrees to carry out his agreements with the pro-
perty owners in said area.

"3. The City agrees to pay as the agreed compromise settlement
amount of all claims for extra compensation, the sum of
$4,170.02, less all previous payments for pipe line extension
at or near manhole No. 1 which amount to $1,365.31 and less
$1,500.00 liquidated damages for delay (in addition to $6,000.00
liquidated damages for delay chargeable against the Great
American Indemnity Co.).

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the Yakima City Commission does hereby fully and in all
respects authorize, ratify and approve the said compromise settlement agreement, and
subject to the proper performance of the terms and conditions thereof, the appropriate
city officials are hereby authorized and directed to make the payments as therein pro-
vided.

directed to execute a lease on behalf of the City of Yakima with Loren K. Miller, for
a portion of Tract 23, State Addition,to the City of Yakima No. 2; said tract belonging
to the Water Department and being leased for the purpose of marketing the fruit crop
f'or 1956, on said property at an agreed price of 30% of the gross fruit sales, be
adopted'as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -13 ?3, BE IT RESOLVED BY THE CIT`.i COMMISSION OF THE CITY OF YAKIMA:
That the Mayor and City Clerk, on behalf of said city, arec
hereby authorized to execute a lease with Loren H. Miller for a term commencing
immediately and continuing during the duration of the 1956 fruit season to a portion
of Tract 23, State Addition to the City of North Yakima No. 2, according to the
official plat thereof, as more fully described in said lease, for an agreed rental of
30% of the gross fruit sales of fruit grown on said leased property during the 1956
season on the terms and conditions as more fully provided in said lease a copy of which
is attached hereto and incorporated by reference herein.

and approval of that certain proposal dated April 21, 1956, of Leo A. Daly and
Associates for design work and engineering services for the new high intensity lighting
installation at the Yakima Municipal Airport in consideration of a fee of.6% of the
cost of construction thereof', be adopted as read: carried, Burns, Huza and. Huey voting
aye on roll call.
RESOLUTION NO. C- 1374, BE IT RESOLVED BY THE CITY COMMISSION 0F' THE CITY OF YAKIMA:
That the City of Yakima does hereby accept and approve the pro-
posal dated April 21, 1956, of Leo A. Daly and Associates for design work and engineer-
ing services for the new high intensity lighting installation at the Yakima Municipal
Airport, in consideration of a fee of 6% of the cost of construction thereof, and in
accordance with the terms and conditions more fully stated in said written proposal;
and said company is hereby requested to proceed with said design and engineering work
pursuant thereto.

ORDINANCE NO. B -1873, AN ORDINANCE providing for the expenditure of funds not budgeted
for the payment of the salary of an additional clerk in the City Treasurerts office,

situated at 310 and 312 Holton Avenue being the South 140 feet of the North North 315

ORDINANCE NO. B -1875, AN ORDINANCE relating to definition of a parking space for off -
street parking and amending paragraph 5 of subsection (h) of Section 15 of zoning
ordinance No.' B -293, as added and amended by Ordinance No. B -1811, entitled: "AN
ORDINANCE amending Section 15 of the Zoning Ordinance No. B -293, entitled 'AN ORDINANCE
regulating and restricting the location of trades and industries; regulating and limiting
the use of-buildings and premises; and the height and size of buildings; providing for
yards, courts and other open spaces; establishing districts for said purposes, and pro-
viding for a board of adjustment,-and repealing Ordinances Nos. B -22, B -35, B -43, B -51,
B -71, B -126, B -134, B -147 and B -1721; requiring that any non - residential building or
structure located on a designated arterial shall be set back not lees than 50 feet from
the front lot line, as to new construction, except in the downtown business district,
authorizing waiver by the Building Inspector of said requirement under certain condi-
tions where adequate off - street parking is provided, and repealing Ordinance NO. B- 173811.

ORDINANCE NO. B -18762 AN ORDINANCE imposing a lien upon property for delinquent garbage
collection service charges and amending subdivision (C of Section 10, of Ordinance No.
B -1523 entitled "AN ORDINANCE relating to' public health and sanitation; providing for
and regulatingtthe compulsory collection and disposal of garbage, refuse and. dead
animals in the City of Yakima; regulating the operation of the City Dump and collection
service; creating a special fund and providing for the payment of monies into said fund;

Moved by Huza, seconded by Huey that Resolution No. C -1375, authorizing the Mayor and
City Clerk to execute a lease on behalf of the City of Yakima with Chateau Enterprises,
Inc. for rental of certain premises at Yakima. Municipal Airport, said premises and
transactions being more fully described and set forth in said resolution, is hereby
adopted as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -1375, BE IT RESOLVED BY THE CI'T'Y COMMISSION OF THE CITY OF YAKIMA:
That the Mayor and City Clerk, on behalf of said city, are here-
by authorized and directed to execute a lease to Chateau Enterprises, Inc., a corporation
(owned by Robert J. Paradis and wife,) for a four year period with an option of renewal
for an additional five year period at a rental of $285.00 per month, of the premises
now occupied by Paradis on the second floor of' the Administration Building at the Yakima
Municipal Airport, and secondly, a lease to the same lessee for a five year term at a
rental of X62.50 per month for approximately 500 square feet of space in the south-
easterly portion of the main floor of said airport Administration Building; according
to the terms and conditions as more fully stated in the said two leases; copies of which
are attached hereto and incorporated by reference herein.

2071.03,f'or the ,purchase of a 2 -door Station Wagon for the Engineering Department be
accepted: carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the contract heretofore entered into between N. L.
Kimball, Contractor, and the City of Yakima, for the construction of a reinforced
concrete bridge across the Pacific Power & Light Company Wasteway at 16th Avenue and
Cherry Avenue be extended and held in abeyance until such time as the irrigation water
has been turned off, and until the City Engineer authorizes aaid Contractor to proceed
with the work: carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huey, second by Huza that Resolution No. C -1376, authorizing the Mayor and
City Clerk, to execute a contract on behalf of the City of Yakima, with Stevens &
Thompson, consulting Engineers of Portland, Oregon, for engineering services on the
sewerage and industrial waste project; said services being more fully set forth and de.
scribed in said :Resolution No. C -1376, is hereby adopted: carried, Burns, Huza and
Huey voting aye on roll call.
RESOLUTION NO. C -1376, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the Mayor and City Clerk are hereby authorized and direct-
ed to execute on behalf of said city, the agreement of this date with Stevens &
Thompson, consulting engineers of Portland, Oregon, for engineering services on the
sewerage and industrial waste project, and providing for payment as their compensation
for said engineering services a sum equal to 6-21-0/o of the actual cost of the construction
work exclusive of the purchase price of land and/or rights -of -way, legal fees, and the
fee payable under said contract, said engineering services to be oi' the nature and
according to the terms and conditions as more fully provided in said agreement, copy
thereof being attached hereto and incorporated by reference herein.
