The minutes of the regular meeting of Monday, January 23, 1956 and adjourned meeting thereof, were approved as read. Moved by Huey, seconded by Huza that Ordinance No. B -1830 relating.to Local Improvement districts and assessments thereof and imposing certain additional requirements pursuant to Chapter 353 and 364 of the-laws of 1955, be passed as read: carried, ?urns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1830, AN ORDINANCE relating to Local Improvement Districts and assess- ments therein, imposing certain additional requirements thereon pursuant to Chapters 353 and 364, Laws of 1955, repealing certain ordinances in conflict herewith, and declaring an emergency. Moved by Huey, seconded by Huza that Ordinance No. B -1831 relating to minimum roof loads of buildings, and amending Section 2305 of the Uniform Building Code, 1955, be passed as read: carried, Burns, Huza and Huey voting aye on .roll call. ORDINANCE NO. B -1831, AN ORDINANCE relating to minimum roof loads of buildings, amendi Section 2305 of the Uniform Building Code, 1955 edition, as applied to the City of Yakima, and declaring an emergency. Moved by.Huey,.seconded by Huza that Ordinance No. B -1832, relative to positions for turning motor vehicles, etc. be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1832, AN ORDINANCE relating to positions for turning motor vehicles, and amending paragraph (a) of Section 45', of Traffic Code Ordinance No. B -1526, entitl- ed "AN ORDINANCE relating to and regulating traffic, travel and transportation and their incidents upon the streets and other ways open to the public; prescribing the powers and duties of officers and others in relation thereto; defining offenses; providing penaltie: and repealing Ordinance No. B -131 of all amendments thereof and all other ordinances in so far as they are in conflict therewith, and declaring an emergency "; as amended by Ordinance No. B -1546, and declaring an emergency-. Moved by Huza, seconded by Burns that Ordinance No. B -1833, amending Section 37 of the Penal Code relative to convictions of disorderly persons and vagrants and fixing the punishment to not exceed a fine of $300.00 or 90 days in jail, or by both such fine and imprisonment, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1833, AN ORDINANCE amending Section 37 of Penal Code Ordinance No. A -236' entitled "AN ORDINANCE for the preservation of the public peace, safety, morality and good order in the City of Yakima; defining who are disorderly persons and vagrants; pro- viding penalties for the violation thereof; repealing ordinances numbered 9, 11, 13, 18, 25, 49, 86, 163, 172, 182, 193, 213, 214, 215, 216, 219, 223, 227, 241, 271, 286, 295, 433, 498, 521, 618, 634, 652, 720, 730, 841, 857, A -19, A -29, A -31, A -52, A -73, A -97 and A -134 and all other ordinances and parts of ordinances in conflict therewith and declar- ing and emergency;" prescribing penalties for the violation of said ordinance, and de- claring an emergency. B -1834, AN ORDINANCE creating a Cemetery Trust Fund, A Cemetery Care Fund and a Cemetery Fund, and defining their uses and purposes, declaring all lands in Tahoma Cemetery eligible to endowment care or annual care, withdrawing certain portions of said cemetery from general sale and reserving same for sale to purchasers buying with pro- vision for the endowment care thereof by the city, repealing Ordinance No. 361, A -257, and B -591, B -227 and declaring an emergency. Moved by Huey, seconded by Burns that Ordinance No. B -1835, submitting to the qualified electors of the City of Yakima., the proposition of creating an indebtedness in the sum of $450,000 for the purpose of constructing the Lenox Overpass, etc., be passed as read; subject; t'o the, a:pproval'of the. Bondi_ ng, Attorneys carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B 1835, AN ORDINANCE submitting to the qualified voters of the City of Yakima, Washington, at a special election to be held in said City on March 13, 1956, the proposition of creating an indebtedness in the sum of $450,000.00; for the issuance and sale therefor of general, negotiable, interest - bearing coupon bonds of said city in said amount, for the purpose of improveing Lenox Avenue by extending the same across the right -of -way of the Northern Pacific Railway Company and the right -of -way of the Union Pacific Railroad Company by the construction of a two -lane overpass over and across said railway rights -of -way; providing for the terms and method of payment of said bonds, the principal and interest of which bonds shall be payable out of annual tax levies to be made without limitation as to rate or amount, and providing for the calling and holding of such election, and declaring an emergency. Moved by Huza, seconded by Huey that Resolution No. C -1334, providing for the form of ballot to be used at the special election to be held in March relative to the $4501000.00 Lenox Avenue Bond- Issue, be adopted as read,subject to the approval of the Bonding Attorneys carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1334, A RESOLUTION providing for the form of ballot to be used at the special election to be held in the City of Yakima, Washington, on Tuesday, March 13, 195E WHEREAS, by Ordinance No. B -1835, of the "ity of Yakima, Washing- ton, it is provided that a special election shall be held in said City of Yakima, on Tuesday, March 13,.1956, for the purpose of submitting to the qualified voters of said city for ratification, the proposition of said city for creating an indebtedness in the sum of $450,000.00, and issuing negotiable general obligation bonds of said city in the L. C H� 1 1 1 1 1 JANUARY g30, 1956 aggregate sum of $450,000.00, for the purpose of providing funds for the improvement of Lenox Avenue by extending the same across the right -of -way of the Northern Pacific Railway Company, and the right-of-way of the Union Pacific Railroad Company by the con- struction of a two -lane overpass over said railway rights -of -way; and WHEREAS, it is necessary to provi=de for the form of the ballot to be used at said election; Now,: therefore, BE IT RESOLVED BY ,THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: Section 1. That the ballot to be used at the said special election on March 13, 1956, shall be in substantially the following form: BALLOT SPECIAL ELECTION Held in the City of Yakima, Washington, March 13, 1956, under and pursuant to Ordinance No. B- 1835., INSTRUCTION TO VOTERS: Every voter at the election desiring to vote in favor of the following proposition shall make a cross in the square opposite the words "Bonds -- Yes" so that said ballot shall express his vote on said. question, and every elector desiring to vote against said proposition shall make a cross ,in the square opposite the words "Bonds -- No" so that said ballot .shall express his.vote on said question. ATTEST: PEARL BENJAMIN City Clerk PROPOSITION "Shall the City of Yakima create an indebtedness in the sum of $450,000.00 and issue - general obligation negotiable bonds of the City of Yakima, Washington, in the aggregate sum of $450;000.00, bearing interest at an effective rate over the life of the bonds of not to exceed four percent (4 %) per annum, pay- able semi- annually; said bonds mature in from two (2) to twenty (20) years from date of issue, and the principal and interest thereof shall be payable out of annual tax levies to be made without limit -ation as to rate or amount, for the purpose of pro- viding funds -for the improvement of Lenox Avenue by extending the same across the right -of -way of the Northern Pacific Railway Company, and the right -of -way of the Union Pacific Railroad Company by the construction of a two -lane overpass over said railway rights -of -way, all of which is more fully set forth in Ordinance No. B- of said city? BURNS Mayor Moved by Huey, seconded by Huza that Resolution No. C -1335, transferring 4180.00 from the Draftsmen Salary in the Engineering Department to the to the Instrument Man in said department, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1335, WHEREAS, the budget of the Engineering Department for 1956 as shown by Ordinance No. B -1756 contains an item of "Draftsman, $4,800.00 "; and it appear - that subsequent to the adoption of said budget it has been ascertained that said $4,800.00 item will not be entirely used for said item; and it appearing that the addi- tional sum of $180.00 is needed for the item "Instrument Man, $4,320.00" in said engin- eering department; now therefore, BE IT,RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the sum of $180.00 is hereby transferred from -the said 8LA_,800.00 item in the Engineering Department budget for 1956, and added to the 4,320.00 item for instrument man in said engineering department, and that the expenditure of said sum for said purpose is hereby fully and in all respects authorized and. approved and the appropriate city officials are hereby authorized, empowered and directed to do any and all things necessary or proper for carrying out this resolution. BURNS City Clerk Mayor Moved by Huey, seconded by Huza that Resolution No. C -1336, amending Resolution No. C -1001, to read "Endowment Fund, instead of "Perpetual Care" at `T'ahoma Cemetery, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1336, WHEREAS, Resolution No. C -1001 was adopted by the City Commission on February 4, 1952, prescribing rules, regulations, fees and charges for the operation, government and control of Tahoma Cemetery; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Pursuant to state statute, sections 2 and 22 of said Resolution No. C -1001 are hereby amended so that each reference therein to "perpetual care" is hereby amended to read "endowment care ".
