The minutes of the regular meeting of Monday, January 16, 1956, were approved as read. This being the time for receiving bids for the construction of a sewer system on Englewood Park, in L.I.D. No. 831, the following were received: Carroll & Sanislo De Blas.io Bros. N. L. Kimball $16,878.78 $19,729.90 $15,220.55 Moved by Huey, seconded by Huza that the bid of N. L. Kimball in the sum of $15,220.55 be accepted and the Mayor and City Clerk are hereby authorized to execute a contract on behalf of the City of Yakima with said contractor for doing said work upon the filing of the proper bond as provided. by law: carried, Burns, Huza and Huey voting aye on roll call. This being the time for receiving bids for the codification of the City ordinances, the following bids were received: Sterling Codifiers: $4500.00 for 200 copies and an annual fee of 450.00 for supplemental pages for a term of not less than 7 years. Mitchie City- Publication Company: $10 00 per page for preparing 200 volumes, and 47.`00 per page for supplemental pages. Book Publishing Company: $5,637.50 for 200 copies-with supplemental services at the rate of $560.00 annually for a period of 7 years. Moved by Huza, seconded by Huey that the bid. of Sterling Codifiers be accepted: carrie Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Huey that Ordinance No. B -1825, fixing the time of delinquency of installments of assessments and prescribing the form of bonds; in L.I.D. No. 808, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1825, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement Di- strict No. 808, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. This being the time for the hearing on the assessment roll covering L.I.D. No.784, pro- viding for the 33rd Avenue South curb and gutter district, and there being no objections in writing or otherwise to said assessment roll, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1826, confirming said assessment roll and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1826, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 78x- as created and established by Ordinance No. B -1591 of the Ordinances of the City of 'Yakima. Moved by Huey, seconded by Huza that Ordinance No. B -1827 regulating erection, construc- tion, enlargement, alteration, repair, moving, removal, conversion, demolition, occu- pancy, equipment, use, height, area and maintenance of buildings; providing for the issuance of permits and collection of fees therefor; declaring and establishing fire districts; adopting with certain exceptions the Uniform Building Code, 1955 Edition, etc., be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1827, AN ORDINANCE regulating erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings and /or structures in the City of Yakima; pro- viding for the issuance of permits and collection of fees therefor; declaring and establishing fire districts; adopting with certain exceptions the 'Unif'orm Building Code, 1955 Edition; providing penalties for the violation thereof, and repealing all ordinances and /or parts of ordinances in conflict therewith. Moved by Huza, seconded by Huey that Ordinance No. B -18281 acce ting the joint bid of Blyth & Company Inc, and Foster & Marshall for the issuance of 1x00,.000.00 par value of "Water and Sewer Revenue Bonds, 1956" of Yakima; fixing the interest rates on said bonds and providing for the immediate printing, execution, delivery and sale of said bonds and for the return of the checks deposited by the unsuccessful bidders, be passed as read :. carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1828, AN ORDINANCE of the City of Yakima, Washington, accepting the joint bid .of Blyth & Company, Inc., and Foster & Marshall, for the issue of $400,000.00 par value of "Water and Sewer Revenue Bonds, 1956" of the City; fixing the interest rates on said bonds; and providing for the immediate printing, execution, delivery and sale of said. bonds and for the return of the checks deposited by the unsuccessful bidders. Moved by Huza, seconded by Huey that Ordinance No. B -1829, providing for the expenditure of funds not budgeted for the Garage Department, which was introduced and read in full by the City Clerk, on Monday, January 16, 1956 and laid on the table for one week, be passed as read: carried, Burns, Huza and Huey voting aye-on roll call. ORDINANCE NO. B -1829, AN ORDINANCE providing for the expenditure of funds not budgeted for the Garage Department, and declaring an emergency. 57 JANUARY.23, 1956 Moved by Huza, seconded by Huey that Resolution No. C -1330, relative to the correction of errors of Irrigation Maintenance in L.I.D. No. 395, be adopted.as read: carried, Burns, Huza and Huey voting aye on roll call. CD RESOLUTION NO. C -1330, WHEREAS, it appears that numerous errors have arisen with refer- ence to the irrigation maintenance charges on the maintenance roles of Local Improvement District No. 395; and said errors as to areas and proper charges payable by property" owners in said district have recently been corrected; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the corrections recently made with reference to areas and amounts of irrigation maintenance charges and assessments with reference to property on the ^irrigation maintenance roles in Local Improvement District No. 395, are hereby ratified, confirmed and approved: and bills shall be made out showing the said corrected irrigation maintenance charges in said. district. BURNS Mayor Moved by Huza, seconded by Huey that Resolution No. C -1331, authorizing the Mayor and City Clerk to execute airport lease on behalf of the City of Yakima, with Midstate Chemical Service & Supply, Inc. and Chambers Aviation, Inc., for approximately 23,430 square feet of area at the Yakima Municipal Airport for one year, at a fixed rental base of $125.00 per month, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1331, .BE IT RESOLVED BY-THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Mayor and City Clerk are hereby authorized on behalf of said city to execute airport fixed base operator's lease dated January 10, 1956, between the City of Yakima, as Lessor, and Midstate Chemical Service & Supply, Inc., a corpora- tion, and Chambers' Aviation, Inc., a co- rporation,as Lessees, leasing approximately 23,430 square feet -of area at the Yakima Municipal Airport for a one year period ending on December. 31, 1956, at a fixed base rental of $125.00 per month, subject to all of the terms and conditions as more fully provided in said lease, a copy thereof being attached hereto. BURNS Mayor Moved by Huey, seconded by Huza,that Resolution.No. C -1332, providing for the release, relinquishment and transfer.by, the City of Yakima to School District No. 7, that certain sewer line through the west half of Block 2, Park Addition, extending from East "I" Street to "K" Street, together with the responsibility for future maintenance of said sewer line, be adopted as read: carried; Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1332, WHEREAS, the City of Yakima heretofore constructed a sewer line hereinafter mentioned and School District No. 7 now owns the property upon which the same is located; now, therefore, BE IT RESOLVED BY' THE CITY COMMISSION OF' THE CITY OF YAKIMA: That the City of Yakima does hereby fully and in all respects release, relinquish and transfer to said School District No. 7 that certain sewer line through the West half of Block 2, Park Addition to Yakima, according to the duly record- ed plat thereof, extending from East "I" Street to "K" Street, together with the re- sponsibility for the future maintenance-of said sewer-line. BURNS Mayor Moved by Huey, seconded by Huza that Resolution No. C -1333, being a resolution of inten- tion to improve the property at the intersection of Mead Avenue and 6th Avenue South, and other property more particularly described in said resolution for the construction of a pipe sewer system, and fixing the date for hearing on said resolution as of Monday, the 20th day of February, 1956, at 10 o'clock A.M., be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C =1333, BE IT RESOLVED BY THE CITY COMMISSION OF' THE CITY OF' YAKIMA: That it is its intention to improve the property within the f of ing described district by constructing a pipe sewer with the necessary wye branches, manholes and flush tanks with water connections therefor; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assessed for the above described improvement is situate in the City of Yakima, Yakima County, Washington, and described as follows: Beginning at the intersection of Mead Avenue and 6th Avenue South; thence southerly, along 6th Avenue South to King Street; thence easterly along King Street to 5th Avenue South; thence northerly along 5th Avenue South to Mead Avenue; thence easterly along Mead Avenue to the center line of 3rd Avenue South; thence southerly-along the center line of 3rd Avenue South; 1- thence- .. southerly along th6�center line of 3rd Avenue South to Pierce Street; thence westerly along Pierce Street to Cornell Avenue; thence northerly along Cornell Avenue to Mead Avenue; thence D 1 1 1 C 1 JANUARY ?3, 1956 easterly along Mead Avenue to the point of beginning, situate in Yakima County, Washington. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of 'Yakima, Yakima County, Washington, at the hour of 10 o'clock a.m.,on Monday, the 20th day of February, 1956; which time and place are hereby fixed for the hearing of all matters re- lating to said proposed improvement or objections thereto, and for determinging the method of payment for said improvement; and the City Clerk ,is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvements. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices, and all othercexpenses incident thereto, shall be levied and assessed against the above described property, except that the City Sewer Fund is to bear seventy -five (75%) percent of the cost of that portion of the Main Line beginning at the existing Trunk Sewer on the Union Pacific Railroad right -of -way and extending to the above descri ed district; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date herein fixed for said hearing, all of the data and other infor- mation required by law to be by him submitted. Burns Mayor Moved by Huey, seconded by Huza that the claim of Alice Taylor, in the sum of $875.00 for damages alleged to have been sustained by reason of a tree falling on her automobile, on the 22nd day of December 1955, said car being parked on North Naches Avenue on the east side thereof approximately 100 feet south of the intersection of Naches Avenue with East "A" Street, is hereby rejected: carried, Burns, Huza and Huey voting aye on roll call.
