The minutes of the regular meeting of Monday, January 9, 1956 and adjourned meetings thereof, were approved as read. This being the time for the hearing on Resolution No. C -1320, providing for the construc- tion of a sewer system on Lots 1 to 18, inclusive Petzel Addition, and there being no objections in writing or otherwise to said improvement, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1820, creating L.I.D. No. 832, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1820, AN ORDINANCE providing for the improvement of certain property'by constructing a pipe sewer with the necessary wye branches and manholes; establishing a' Local Improvement District, providing for the method of payment thereof, and creating a special fund. Moved by Huza, seconded by Huey that Ordinance!No. B -1821, fixing the time of delinquent and presoribing.the form of bond in L.I.D. No. 788, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1821, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 786, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Huey, seconded by Hiu.za that Ordinance No. B -1822 amending Section 1, of Ordin- ance No. B -1739, relative to:-the acquisition by condemnation or purchase of that part of the East half of the Northwest Quarter of the Northwest Quarter of Section 23, Town- ship 13 North, Range 18 E. W. M., lying south and west of the right of way of the Power- house Road, except rights of way for canal, and except the South 745 feet of said tract of real estate, which said South 745 feet includes the North 25 feet of Lincoln Avenue, be passed as read: carried, Burns., Huza and Huey voting aye on roll call. ORDINANCE NO. B -1822, AN ORDINANCE amending Section 1 of Ordinance No. B -1739 entitled "AN ORDINANCE providing for the acquisition by condemnation or purchase of certain real property owned by William S. Webber located in and being a part of the East half of the Northwest quarter of the Northwest quarter of Section 23, Township 13 North, Range 18 E.W.M., in Yakima County, Washington, for public park purposes, and providing for the method of payment therefor, and declaring an emergency ", and declaring an emergency. Moved by Huza, seconded by Huey that Ordinance No. B -1823, providing for the employment of a part time Cit Civil Defense Director and the expenditure of funds not budgeted to exceed the sum of 1500.00, which was read by the City Clerk in full on Monday, January 9th, and laid on the table for one week, be passed as read: carried., Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1823, AN ORDINANCE providing for the employment of a part time city Civil Defense Director and providing for the expenditure of funds not budgeted not ex- ceeding $1500.00 for the payment of his salary and expenses, and. declaring an emergency. This being the time for the hearing on the petition of F. G. Brewer and W. S. Phillips, for the annexation to the City of Yakima of beginning at the intersection of 2nd Avenue South with the center line of West Mead Avenue; thence East along the center line of West Mead Avenue a distance of 165.55 feet thence south along the east line of Lot 20, T. J. Hackett's Addition to the Southeast corner of said lot; thence West along the south line of Lot 20 and Lot 19 extended, to the center line of 2nd Avenue South; thence North along the centerline of 2nd Avenue South to the point of beginning and there being no objections in writing or otherwise to said annexation, or any part thereof; it was MOVED by Huey, second by Huza that Ordinance B- 1824, annexing said property and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 1824, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. Moved by Huey, seconded by Huza that Resolution No. C -1329, being a resolution of inten- tion to improve beginning at the intersection of Mead Avenue.and Cornell Avenue, and other streets more particularly described in said resolution by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supply - ir�g water for domestic use and fire protection, and fixing Monday, the 6th day of February, 1956, as the date of hearing on said resolution, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1329, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following described property by constructing the necessary mains, fire hydrants, valves, and other appurten- ances for the purpose of supplying water for domestic use and fire protection. The district to be served by`and assessed for the above describ- ed improvement is situate in Yakima County, Washington, and described as follows, to -wit: Beginning at the intersection of Mead Avenue and Cornell Avenue; thence easterly along Mead Avenue to Third Avenue South; thence southerly along Third Avenue South to Pierce Street; thence westerly along Pierce Street to Cornell Avenue; thence northerly along Cornell Avenue to the point of beginning, excluding there - from Lots 1 and Lots 9 to 18 inclusive, of Block 3, Broadmead, and also excluding therefrom Lots 8 and 9 Cornell Tracts; said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvement 56 J JANUARY 16, 1956 are hereby notified to appear and present such objections, if any, at a meeting; of the City Commission, to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10:00 a.m.. on Monday, the 6th day of February, 1956, which time and place are hereby fixed for the hearing of all matters relating to said p proposed improveme -Lt, or objections thereto, and for determining the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and o the intention to make the aforesaid improvement. A portion of the costs and expenses of said improvement, includ- ing the engineering, inspection, advertising, publication of notices, and all other ex- penses incident thereto, shall be levied and assessed against the above described property as provided by law, and the balance of said costs and expenses shall be borne by the City Water Department; and the pity Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. An ordinance providing for the expenditure of funds not budgeted for the Garage Depart- ment, in the sum of $612.59, was introduced, read by the City Clerk and laid on the table for one week as provided by law and the City Charter. Moved by Huey, seconded by Huza that the claim of Norvin Mann for damages in the sum of $425.00, alleged to have been sustained by reason of a limb falling on his automobile which was parked on South Naches Avenue on December 22, 1956, is hereby rejected:: carried, Burns-, Huza and Huey voting aye on roll call.
