ITEM TITLE: Resolution authorizing professional service contracts for
specialized professional appraisal services associated with
the City's negotiations to acquire certain real property
adjacent to the Yakima Air Terminal.

SUMMARY EXPLANATION:
The City is engaged in negotiations to attempt to resolve certain litigated issues concerning the
real property located adjacent to the Yakima Air Terminal, previously known as the Noland
DeCoto property, as well as to provide additional revenue potential to the Air Terminal from
rental resources. One of the potential resolutions includes the City's acquisition of the Noland
DeCoto land, exclusive of the buildings located thereon. The potential property purchase may
include the use of federal funding obtained through the FAA. The FAA requires that property
subject to purchase using federal funding must be appraised in accord with stringent federal
guidelines. The City previously contracted with Faith Roland of Roland Resources, Inc, to
provide expert consulting services that will assist the City with meeting the strict federal
requirements concerning FAA land acquisitions. Ms. Roland has recommended that the City
contract with two appraisers to provide the professional appraisal necessary to satisfy federal
requirements. She recommended that the Primary Appraiser be Murray Brackett, and that the
required Review Appraiser be from the Greer Allen appraisal firm.
Since time is of the essence to engage the professional appraisers in order to meet the time
lines the City has been given by the owners of the property at issue, the City Manager is
seeking the Council's authority to enter into contracts with the appraisers recommended by Ms.
Roland to obtain the appraisal of the Noland DeCoto property in a format acceptable and in
accord with the FAA requirements. The City is advised that the primary appraisal contract
should not exceed $30,000, and the review appraisal should not exceed $2,000. Therefore, the
City Manager is seeking authorization of the Council to continue the work begun by Ms. Roland
in accord with the Council's prior approval of the work scope concerning the negotiation of the
Noland DeCoto property and to contract for the expert appraisal services necessary to qualify
for federal funding of the property purchase within the contract limits set forth in the attached
resolution.

RESOLUTION NO. R -2013-
A RESOLUTION authorizing the City Manager to execute professional service contracts for
specialized professional appraisal services associated with the City's
negotiations to acquire certain real property adjacent to the Yakima Air
Terminal.
WHEREAS, the City of Yakima has been engaged in litigation concerning certain real
property located immediately adjacent to the Yakima Air Terminal, known as the Noland
DeCoto property; and
WHEREAS, the City has previously contracted with Roland Resources, Inc. for
professional consulting services associated with assisting the City to identify and satisfy Federal
Aviation Administration requirements for real property acquisition for aviation purposes when
federal funding may be utilized to accomplish the acquisition; and
WHEREAS, one element of the consulting agreement with Roland included the City
obtaining a specialized professional appraisal of the Noland DeCoto property to meet specific
FAA funding requirements; and
WHEREAS, Roland has advised the City that Murray Brackett has the professional
experience and expertise to provide the specialized appraisal required by the FAA for this
property acquisition opportunity and that his services as the Primary Appraiser should be
available to the City in a contract amount that should not exceed Thirty Thousand Dollars
($30,000); and
WHEREAS, Roland has further advised that in addition to the services Mr. Brackett can
provide on behalf of the City as the Primary Appraiser, the City will also need to obtain the
services of an Independent Review Appraiser to provide a review and approval of the primary
appraisal in order to meet federal funding requirements; and
WHEREAS, Roland advises that the required Independent Appraisal Review can be
provided by another experienced professional appraiser she will recommend who has the
necessary FAA experience to meet federal review requirements, and that the appraisal review
should be available at a cost not to exceed Two Thousand Dollars ($2,000); and
WHEREAS, the City Council finds it to be in the best interests of the City to pursue the
opportunity to acquire certain real property located adjacent to the Yakima Air Terminal in order
to better serve the Yakima Air Terminal purposes as well as to work toward a negotiated
settlement of ongoing litigation concerning the Air Terminal and to obtain the professional
expertise of appraisers qualified to meet the requirements of the FAA pertaining to federally
funded land acquisition; Now, Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to execute contracts for the
professional services of a Primary Appraiser in an amount not to exceed Thirty Thousand
Dollars ($30,000) and the services of a Review Appraiser, in an amount not to exceed Two
Thousand Dollars ($2,000), to provide the professional appraisal services required by the FAA

for a federally funded land acquisition opportunity concerning the Noland DeCoto property
located adjacent to the Yakima Air Terminal.
