SUBMITTED BY: Tony O'Rourke, City Manager SUMMARY EXPLANATION: Pursuant to negotiations between YPPA and the City, the parties have agreed to extend the current wage schedule of the existing 2012 -2013 Collective Bargaining Agreement, with a zero percent increase through December 31, 2015, maintain existing health care benefits, and implement an Assigned Police Vehicle (APV) policy. R -2013- A RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding between the City of Yakima and the Yakima Police Patrolman's Association ( "YPPA "), extending the terms of the 2012 -2013 Collective Bargaining Agreement and implementing a new Assigned Vehicle Policy (APV) program. WHEREAS, the City and the YPPA have been engaged in contract negotiations including wages and working conditions for 2014 and 2015; and WHEREAS, the City and YPPA have agreed to extend the current contract terms including wages and health benefits through December 31, 2015; and WHEREAS, the City and YPPA have agreed to the implementation of a new APV program, as provided in the attached Memorandum of Understanding; and WHEREAS, the City Council has determined that it is in the best interest of the City of Yakima to agree to the terms and conditions of the attached Memorandum of Understanding, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute the attached and incorporated "Memorandum of Understanding" between the City of Yakima, and the YPPA extending the current contract terms, and implementing a new APV program, subject to the terms and conditions explained above. ATTEST: City Clerk Micah Cawley, Mayor MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING is made by and between the City of Yakima, Washington, and the Yakima Police Patrolman's Association (YPPA). WHEREAS, pursuant to the Public Employees' Collective Bargaining Act, the parties have engaged in negotiations and are implementing this Memorandum of Understanding in order to settle their 2014 -2015 Collective Bargaining Agreement, and; WHEREAS, the parties agree to continue the existing 2102 -2013 wage schedule, with zero percent increase, and to maintain the existing health insurance benefit with no changes, and; WHEREAS, the parties agree to implement the Yakima Police Department Officer Assigned Police Vehicles (APV) policy, with the City's insurance extending to YPPA members and their authorized passengers, and; WHEREAS, the 2012 - 2013 CBA shall remain in effect through December 31, 2015: ongoing language negotiations shall continue until agreed to and formalized by the parties. NOW, THEREFORE, it is agreed by and between the City and YPPA as follows: This agreement shall be effective upon signing and will be incorporated into the Collective Bargaining Agreement between the parties. This MOU is an exclusive agreement unique in nature. It does not establish a precedent between the parties. Executed this 9th day of July, 2013.
