This section of public right -of -way was deeded to Yakima County by right -of -way deed on April 23, 1954 and subsequently became the responsibility of the City of Yakima upon its annexation on June 10, 1954. The size of the area to be vacated is approximately 155 feet in length and 50 feet in width. Cook Street is a dead -end street accessed solely from N 40th Avenue. The petitioner in this action is the record owner of 100% of the privately owned properties contiguous with this right -of -way vacation petition. See complete record attached. The complete record is also on file with the City Clerk's Office, the Planning Division and the City's website. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on May 9, 2013 recommending that the City approve, with conditions, the vacation of that portion of Cook Street lying easterly of N 40th Avenue and westerly of the Yakima Valley Canal and located within the City of Yakima, Washington.; and WHEREAS, the City Council finds that the findings, conclusions, and conditions of the Hearing Examiner set forth in said recommendation in response to the requirements of applicable state and local law are correct and appropriate, and that the same should be adopted by the City Council as its findings, conclusions, and conditions herein; and WHEREAS, the City Council further finds that the conditions imposed on said vacation by the Hearing Examiner that the petitioner shall exchange at par, up to a value of $19,000, the right -of -way of Cook Street for additional right -of -way the City needs for North 40th Avenue along the frontage of the petitioner's parcel abutting Cook Street. Should the right -of -way not fully compensate City for the entire $19,000 the difference shall be paid to the City by the petitioner prior to the recording of the ordinance of vacation; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The City of Yakima hereby vacates that certain tract of real property legally described as that portion of Cook Street lying Street lying easterly of N 40th Avenue and westerly of the Yakima Valley Canal and located within the City of Yakima, subject to the following conditions: those certain conditions set forth in the City of Yakima Hearing Examiner recommendation dated May 9, 2013, known as file number RWV #003 -12, to -wit: 1. The access to the waste bins must be continued for as long as they remain in use. 2. The petitioner shall exchange at par, up to a value of $19,000, the right -of- way of Cook Street for additional right -of -way the City needs for North 40th Avenue along the frontage of the petitioner's parcel abutting Cook Street. Should the right -of -way not fully compensate City for the entire $19,000 the difference shall be paid to the City by the petitioner prior to the recording of the ordinance of vacation. Section 2. The findings, conclusions, and conditions of the Hearing Examiner's recommendation in this matter dated May 9, 2013, known as file number RWV #002 -13, are hereby adopted by the City Council as its findings and conclusions in support hereof, and are incorporated by this reference as if fully set forth herein. Section 3. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 4. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Micah Cawley, Mayor ATTEST: City Clerk Publication Date: Effective Date: Memo Date: June 4, 2013 To: Yakima City Council From: Bruce Benson, Supervising Planner Subject: Cook Street Right -of -way Vacation West Valley Nursing Homes, dba Living Care, is in the process of expanding their facility located to the north of Summitview Avenue and on the east side of N 40th Avenue. Part of their planning for this expansion will require the vacation of Cook Street. After initial review, their petition was found to be sufficient for the continued processing of this request which consisted of further staff review, including a Development Services Team meeting. The findings from this review determined; (1) there was no public purpose to be served by retaining this right - of -way and (2) although indirectly related, it was determined that there was a need for additional right -of -way along the frontage of the petitioner's property. Staff completed its report which recommended approval of this request but suggested that since the petitioner had to pay one -half of the appraised value of the vacated right -of -way ($19,000) it would be beneficial to both the petitioner and the city if there could be an exchange of property on an at par basis. The closed record public hearing on this matter was held before the Hearing Examiner on April 25, 2013. There were no objectors to this vacation either orally or in writing. The examiner closed the hearing and subsequently, on May 9th, submitted his written recommendation for the approval of this street vacation. This is all very normal practice for this type of procedure with the exception that the Hearing Examiner did include, as part of his recommendation, language that would permit the petitioner to fulfill all or a portion of their obligation to pay the city $19,000 (one half of the appraised value) by trading portions of their property along N 40th Avenue, where the city needs to acquire additional right -of -way. The specifics of this property exchange have yet to be decided and this discussion may not occur until after you have held your closed record public hearing. . Should you concur with staff's and the hearing examiner's recommendation that the right -of -way vacation be approved, the vacation ordinance will allow for an all cash settlement, a trade of properties or a combination of the two Staff concurs with the Hearing Examiner's recommendation and therefore recommends that the Council adopt the accompanying ordinance based upon the Hearing Examiners' findings and conclusions. Hearing Examiner Authority. The Yakima Municipal Code states in Chapter 1.43.080 (H), that the hearing examin I shall conduct public hearings • petitions and resolutions to vacate streets and pubi rights-of-way pursuant to RCW Chapter 35.79. Decisions of the examiner on su matters shall constitute recommendations to the City Council. Yakima Urban Area Comprehensive Plan 2026. The Comprehensive Plan indicates that the area surrounding this vacation request high density residential, a designation which supports the underlying zoning. Thl designation was established ■ a Comprehensive Plan map amendment that was approved in 2012. B. RCW 35.79. This chapter of state law stipulates the state's requirements for the process of vacating street rights-of-way. All requirements of this chapter that can be accomplished prior ts the public hearing have been fulfilled. City Planning Division — Bruce Benson The petition complies with state and local regulations governing requests for right-of- way vacations. City Engineering Division - Dana Kallevig, Randy Meloy: North 40th Ave is classified as a Primary Arterial. Minimum RAM requirements are 100'. Cook has a Residential classification requiring 50'. Need to see existing RAN and property boundaries to determine existing situation and a proposed site plan showing exactly what is requested to be vacated. Ci!y Traffic Engineering - Joe Rosenlund: The city will want to maintain at least 50 feet of right of way from centerline of 40th Street east for future roadway expansion. Ci!y Water Division - Mike ' Shane'. There are no public water facilities within the existing right-of-way of Cook St. Solid Waste Division — James Scott: There are currently several garbage bins serviced by the City of Yakima which can only be accessed by utilizing Cook Street. Access must be maintained as long as the bins continue in use. D. Public Use of the Right-of-Way. The subject property has been a deeded public right-of-way since 1954. Avallabl�; records do not indicate when or under what circumstances the existing stree! improvements were completed; nevertheless, as public right-of-way the City has been responsible for its maintenance for the last 58 years. The City's Right-of-Way Vacation application form requests that the petitioner submit written responses concerning the following issues: 2. The vacation of right-of-way does not deny any sole access to any property. The petitioner owns all contiguous properties within the defined parameters of this petition. Consequently, this vacation request will not deny any sole access to any property. S. Existing Utilities (public and franchised) developer's expense or an adequate appropriate, if existing utilities are deemed may be waived. It could also permit the city to obtain badly needed additional right-of-way for widening along N 40th Avenue. On March 19, 2013 the Yakima City Council, in accordance with the requirements of RCW 35.79.010, set the date of the public hearing for this right-of-way vacation on April 25, 2013, by Resolution No. R-2013-035.
