On April 25, 2013 the Hearing Examiner held an open record public hearing on this matter, and subsequently on May 9, 2013 issued a recommendation for denial of the request. BACKGROUND. 1. A right -of -way vacation petition was submitted on February 19, 2013 to vacate a portion of North 27th Avenue, along with a portion of unnamed right -of -way lying south of Lot 11, Wachsmith subdivision. 2. The petition documents were signed by both adjacent property owners: Frosty Pack Co. LLC (Dan Martinez) and 27th Avenue Properties LLC (Ken Leingang). 3. Existing Conditions. a. The existing Right -of -way of North 27th Avenue is unpaved and unmaintained right - of -way. b. The applicant identified that the majority of the unnamed right -of -way south of Lot 11, Wachsmith Plat, is currently encumbered by stockpiled dirt. c. Water, sewer and natural gas utilities exist within the North 27th Avenue right -of- way. d. The southern terminus of North 27th Avenue dead -ends where it intersects BNSF railroad right -of -way which runs east -west. e. Both North 27th Avenue and North 26th Avenue currently have no turn- around at the intersection of BNSF right -of -way. II. PROCESS. 1. The application was determined to be Complete for further processing on March 11, 2013. 2. A Resolution (R- 2013 -034) was adopted fixing April 25, 2013 as the date for an open record public hearing by the Hearing Examiner. 3. In accordance with RCW 35.79.020, the property was posted on March 22, 2013, and notices were posted in 3 public places on March 26, 2013. 4. Notices were sent to the applicant and adjoining property owners on March 26, 2013. 5. DST Review was held on April 9, 2013 to discuss the technical aspects of the project. 6. Staff recommended denial of the project to the Hearing Examiner at the April 25, 2013 hearing. 7. After review of the record and testimony at the public hearing, the Hearing Examiner issued his recommendation to the City Council for denial on May 9, 2013. 8. June 18, 2013 was set as the date for council consideration of the vacation petition in a closed record public hearing. III. APPLICATION 1. Applicant's Statement. The application included the following statements and rational for approval of the vacation petition (Exhibit E -1). The public will never need to build/ and maintain a roadway within this right of way. This portion of right of way has never been on the City's six year road plan to improve and probably never will be. The proposed portion of North 27th Ave. to be vacated is undeveloped, except for a driveway used by the warehouse on the west and a private contractor to the east. The City currently does not maintain this portion of their right of way. The private contractor has stockpiled dirt on the majority of his portion of this right of way. 2. Staff Recommendation to Hearing Examiner. Staffs recommendation of denial to the Hearing Examiner is summarized, as follows (Exhibit A -1): a. The vacation of North 27th Avenue would close off any possibility of a looped access to North 26th Avenue. Currently, both North 27th and North 26th Avenues south of River Road dead -end at the railroad right -of -way with no turn around. The unnamed right -of -way which runs east to west along the railroad right -of -way between North 27th and North 26th Avenues presents the only possible opportunity for looped access to be created. Without right -of -way for a looped access, a cul -de -sac would be required on both North 26th and North 27th Avenue for turn- around purposes and to meet code requirements for dead end streets. There was no method for turn- arounds proposed by the applicant, and based on existing structures directly adjacent to the proposed vacation, it is not clear where such a turn- arounds could physically locate. As indicated in the application, a portion of the right -of -way is currently encumbered by stockpiled dirt. This is an illegal use of the city right -of -way and further precludes any opportunity to loop North 27th to North 26th Avenue. After consideration of the three issues raised above, it has been determined that no public benefit exists by vacating North 27th Avenue. The only benefit would be to the adjacent private businesses, to the detriment of surrounding property owners. IV. HEARING EXAMINER RECOMMENDATION. The Hearing Examiner's Recommendation (Exhibit AA -1) describes includes Findings of Fact and Conclusions which support the Hearing Examiner's recommendation of denial. Part of the testimony at the hearing included a new drawing showing a proposed cul -de -sac, partly on private property (Exhibit G -1). The Hearing Examiner's recommendation provides the following: "The record is unclear as to whether the proposed street right -of -way vacation would be consistent with existing and anticipated development in the area because of absence of input from the city's street and fire experts as to the location, layout and adequacy of the cul -de -sac proposed on private property." V. RECOMMENDATION. Staff recommends that the Council deny the requested vacation based upon the findings, conclusions, and recommendation of the Hearing Examiner. UROSTY PACKING CO. Project and Site Description Frosty Pack LLC has submitted a petition requesting the vacation • the above referenced section of N 27"' Avenue. This section of public right-of-way was dedicated to the City of Yakima by the Plat of Wachsmith Subdivision, recorded on December 21, 1938 in Volume "T" of Plats, Page 50 records of Yakima County Washington. The size of the area to be vacated is approximately 330-feet in length by 50-feet in width for 27 1h Avenue, and 140-feet in length by 35-feet in width for the portion south of Lot 11. The southerly portions of right- of-way are directly adjacent to railroad right-of-way. North of the proposed vacation of 27"' Avenue is I approximately 285-feet of right-of-way before the intersection of 27'!'Avenue and River Road. The current condition of the right-of-way is unimproved gravel with stockpiled dirt on the south end. Z> Public water and sewer utilities are in a portion of the 27 1h Avenue right-of-way, along with a gas line. B. Zoning and Urban Area Comprehensive Plan. The properties surrounding this vacation request are zoned Light Industrial (M-1), and contain Industrial uses, The remaining portion of North 27"' Avenue, not in the vacation area, is zoned M-1 and contains Doc. INDEX # A.- residential uses. The Comprehensive Plan designates the area surrounding this vacation request as Industrial. C. Hearing Examiner Authority. The Yakima Municipal Code states in Chapter 1.43.080 (H), that the hearing examiner shall conduct public hearings on petitions and resolutions to vacate streets and public rights-of-way Pursuant to RCW Chapter 35.79. Decisions of the examiner on such matters shall constitute recommendations to the City Council. D. Statement of Cause. Pursuant to City Policy, the applicant has provided in his application (dated February 19, 2013) the following statements, explaining the proposed Right-of-way vacation petition: The public will never need to buil[d] and maintain a roadway within this right Qfivay. City Policy provides the following five criteria for consideration during the review of street right-of- way of vacation petitions. 2. RC W 3539. This chapter of state law stipulates the state's requirements for the process of vacating street rights-of- way. 3. City Resolution R-2007-126. IV. STAFF ANALYSIS. The proposed right-of-way vacation would not be a public benefit, but solely a private benefit to the property owners adjacent to the proposed vacated area, Vacation of the right-of-way would be detrimental to the public benefit because it would result in street ends that do not comply with YMC § 12.06.050, and would not provide space for code required fire truck turnaround. Staff therefore concludes that the criteria for considering right-of-way vacations has not been met. VI . RECOMMENDATION.
