R -2013- A RESOLUTION authorizing the City manager to execute Amendment No. 1 to Animal Control Agreement with Humane Society of Central Washington. WHEREAS, the City of Yakima (City) has previously entered into an Animal Control Agreement with Humane Society of Central Washington ( "Humane Society "), which Agreement was approved December 13, 2011 pursuant to City Resolution No. 2011 -182; and WHEREAS, City and Humane Society desire to amend such Agreement to provide for the retention and compensation of two additional Animal Control Officers to provide animal control services within the City of Yakima; and WHEREAS, City and Humane Society have negotiated Amendment No. 1 to such Animal Control Agreement to provide such additional service, which amendment is attached hereto as Exhibit "A" and incorporated herein by this reference; and WHEREAS, the City Council finds and determines that approval of such Amendment No. 1 is in the best interests of residents of the City of Yakima, will provide enhanced animal control services, and will promote the general health, safety and welfare; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute and administer Amendment No. 1 to the Animal Control Agreement between the City of Yakima and the Humane Society of Central Washington, which amendment is attached hereto and incorporated herein as Exhibit "A" by this reference; now, therefore, ADOPTED BY THE CITY COUNCIL this 7th day of May, 2013. ATTEST: City Clerk Micah Cawley, Mayor AMENDMENT NO. 1 To ANIMAL CONTROL AGREEMENT THIS AMENDMENT NO. 1 amends the Animal Control Agreement dated December 13, 2011 between the CITY OF YAKIMA, a municipal corporation, and the HUMANE SOCIETY OF CENTRAL WASHINGTON, a nonprofit corporation, for the provision of animal control services within the City of Yakima. I. Recitals A. City of Yakima (hereafter "City ") is a municipal corporation of the State of Washington with City Hall located at 129 North 2nd Street, Yakima, Washington 98901. B. Humane Society of Central Washington (hereafter "Humane Society ") is a nonprofit corporation duly formed and existing under the laws of the State of Washington, with business address at 2405 Birchfield Road, Yakima, Washington 98901. C. The parties have previously entered into an Animal Control Agreement ( "Agreement "), dated December 13, 2011, whereby Humane Society agreed to provide animal control services for the City, and the City agreed to pay compensation to Humane Society for such services. D. The parties desire to amend such Agreement to provide for two additional Animal Control officers, supplied by the Humane Society to provide animal control services to the City. II. Amendment Agreement Section 1. Section 3 of the Agreement is amended to add a new subsection to read as follows: Additional Animal Control Officer. Commencing May 8, 2013 or as soon thereafter as practicable, Humane Society shall provide two additional Animal Control Officers to perform animal control services as described above within the City. Upon retention of such additional officers, Humane Society shall notify City whereupon compensation to be paid by City to Humane Society for such additional officers shall commence. Compensation to be paid by City to Humane Society for such additional Animal Control Officers shall be Four Thousand Two Hundred Fifty -one and 25/100 Dollars ($4,251.25) per month ($51,015.00 annually) each, or prorated portion of such monthly compensation for partial month of service. The amount of compensation is intended by both parties to fully cover and pay for all wages, benefits, training expenses, equipment, supplies, cell phone, applicable insurance premiums, licensing and vehicle expenses incurred by Humane Society for the retention and employment of such Animal Control Officers. 1 The parties reserve the ability to retain Animal Control Officers in addition to the Animal Control Officer described in this subsection. Retention of additional Animal Control Officers, or any change in scope of services or rate of compensation for such officers, shall be pursuant to a written amendment to the Agreement approved and signed by both parties. Section 2. Except as amended herein, the provisions of the Agreement shall remain unchanged and in full force and effect. Executed and effective this CITY OF YAKIMA la day of May, 2013. Tony O'Rourke, City Manager ATTEST: la Sonya Claar Tee, City Clerk Contract No. Resolution No. 2 HUMANE SOCIETY OF CENTRAL WASHINGTON 0 Wendy St. George, Executive Director INTEROFFICE MEMO May 7, 2013 TO: Honorable Mayor & Council Members FROM: Joe Caruso, Code Administration Manager SUBJECT: Contracting two Animal Control Officers through the Humane Society Of Central Washington At the April 2, 2013 Council meeting, Councilmember Kathy Coffey initiated a conversation on hiring two more Animal Control Officers. Currently in the City of Yakima, we employee one Animal Control Officer and contract out with the second Animal Control Officer through the Humane Society of Central Washington under a three year contract covering 2012 through 2014. Investigating all estimated costs for two more officers within the City of Yakima and meeting with the Director of the Humane Society of Central Washington for their estimated costs of supplying officers, it was determined that contracting with the Humane Society was in the best interest of the City of Yakima financially. If the City of Yakima hired two Animal Control Officers, just the salary and medical for each employee would estimate at $59,000 each (Step C). Along with this estimate, the city would have to purchase two trucks estimated at $25,000 each, plus equipment, uniforms etc. The estimate from the Humane Society is $51,015 annually for each officer supplied by the shelter, which covers all wages, benefits, training, equipment, supplies, cell phone, applicable insurance policies, licensing and vehicle expenses. In the 2102 Citizens Survey, residents rated animal control 35% fair and 37% poor. Also, in the 2012 Citizens Survey, Yakima ranked last (282 out of 282) in animal control efforts. The Humane Society has agreed to supply these officers if requested by the City of Yakima with an estimated start date of July 1, 2013.
