For Meeting of:April 20, 2021 ITEM TITLE: Resolution authorizing documentation confirming the City of Yakima's Certification Acceptance (CA) status with the Washinton State Department of Transporatation when developing all Federal Highway Administration (FHWA) projects SUBMITTED BY: Scott Schafer, Public Works Director Bill Preston, City Engineer(509) 575-6754 SUMMARY EXPLANATION: To maintain the City's Certification Acceptance status, the City must have current CA documentation information on file with Washington State Department of Transportation (WSDOT). This documentation outlines the responsibilities of the City per the WSDOT Local Agencies Guidelines (LAG) manual when developing all Federal Highway Administration (FHWA) projects. It has been updated to reflect the current Public Works Table of Organization. By maintaining current CA, the City saves time and money since the City has the authority to develop, advertise, award, and manage its own projects rather than contracting out for administrative help. WSDOT Local Programs also signs the document indicating that they have accepted the City's CA documentation. The City of Yakima's Certification Acceptance (CA) status is attached for City Council review. R-2021- A RESOLUTION authorizing the City Manager to sign the WSDOT document confirming the City of Yakima's Certification Acceptance (CA) status; WHEREAS, The Federal Highway Administration (FHWA) through a Stewardship Agreement, delegates authority to the Washington State Department of Transportation (WSDOT) for approving project development and construction administration, and; WHEREAS, WSDOT has the option of delegating some or all of this authority to qualified local agencies; and WHEREAS, WSDOT delegates this authority through a CA program; and WHEREAS, the CA program benefits the City through savings in time and money since the City has the authority to develop, advertise, award, and manage its own projects, and WHEREAS, the City has committed sufficient staff and other resources to project administration to ensure that all applicable state and federal are requirements are met, and WHEREAS, the City Council of the City of Yakima finds that maintaining its CA status is in the best interests of the City and its residents; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized sign the WSDOT document confirming that the City of Yakima maintains its CA status. Patricia Byers, Mayor ATTEST: Sonya Clear Tee, City Clerk 4 Agency: City of Yakima Agency Number: 1485 The agency agrees to comply with the following requirements when developing all Federal Highway Administration (FHWA)projects under City of Yakima CA status. 1. Adherence to the Local Agency Guidelines and all policies and procedures promulgated by the Washington State Department of Transportation (WSDOT)which accomplish the policies and objectives set forth in Title 23, U.S. Code, Highways, and the regulations issued pursuant thereto. 2. The overall approval authorities and conditions will be as follows: a. The project prospectus will be reviewed and approved by the following official: City Engineer or Public Works Director b. The local agency agreement will be reviewed and approved by the following official or officials: City Manager c. The designs and environmental documents will be reviewed and approved by the following state of Washington registered Professional Civil Engineer: City Engineer d. The hearing's findings (if required)will be reviewed and approved by the following official or officials. Public Works Director e. The contract plans, specifications and estimate of cost will be reviewed and approved by the following state of Washington registered Professional Engineer: City Engineer f. Agreements will be signed by the following responsible local official: i. Railroad: City Manager ii. Utility: City Manager iii. Consultant: City Manager iv. Technical Services: City Manager g. The award of contract will be signed by the following responsible local official: City Manager h. All projects will be constructed in conformance with the Washington State Department of Transportation/American Public Works Association (WSDOT/APWA) current Standard Specifications for Road, Bridge, and Municipal Construction M 41-10 and such specifications that modify these specifications as appropriate. Multimodal enhancement projects shall be constructed in conformance with applicable state and local codes. i. The contract administration will be supervised by the following state of Washington registered Professional Civil Engineer: City Engineer j. Construction administration and material sampling and testing will be accomplished in accordance with Construction Manual M 41-01 and the Local Agency Guidelines. DOT 140-550 10/2015 5 3. The agency agrees that they have the means to provide adequate expertise and will have support staff available to perform the functions being subdelegated. The support staff may include consultant or state services. 4. The agency agrees that the signature on each project prospectus and local agency agreement will be consistent with section 2 above. 5. All projects under Certification Acceptance shall be available for review by the FHWA and the state at any time and all project documents shall be retained and available for inspection during the plan development and construction stages and for a three year period following acceptance of the project by WSDOT. 6. Approval of the local agency certification by the Director, Local Programs may be rescinded at any time upon local agency request or if, in the opinion of the Director, Local Programs, it is necessary to do so. The rescission may be applied to all or part of the programs or projects approved in the local agency certification.
