Staff Announcements–Planning Manager Joseph Calhoun announced the following:
The final draft for the Housing Action Plan is due by the end of the week. The YPC will hold a
study session on 4/14 and a public hearing on 4/28.
The draft documents for the Shoreline Master Program Periodic Update have been sent to
the Department of Ecology for review. A combined City/DOE notice will go out after DOE
review is complete.
March 10, 2021 Meeting Minutes–It was motioned by CommissionerPlaceand seconded by
Commissioner Roseto approve the meeting minutes ofMarch 10, 2021with a minor clarification
to the YPC members present.The motion carried unanimously.
R-3 Moratorium Public Hearing–Calhoun presented the staff report and recommendation on
the Class 2 and 3 uses in the R-3 zoning district. A study session was held on January 13, 2021
which provided a background on the moratorium, the role of the YPC, purpose of the R-3 zone,
map of the R-3 zone, analysis of allowed land uses in the R-3 zone, and a review of Type 2 and
3 uses submitted in the last 5 years. The consensusat that meeting was to leave the uses as-is
in Table 4-1 and there was subsequent discussion on the Rezone process. Based on the
moratorium requirements, the March 24, 2021 hearing was scheduled. The Staff recommendation
is: 1) hear testimony from the public regarding Class 2 and 3 uses in the R-3 zoning district and
forward a recommendation to City Council; and, 2) schedule future YPC study sessions to further
examine the rezone process.
Public Testimony:
1) Andrew Sawyer: Mr. Sawyer provided testimony related to the effect of zoning decisions and
the considerations of neighbors, concern with a recent rezone and the process, we need more
high density housing and affordable housing, R-3 should be in areas that receive the full range of
urban services, there are no neighborhood shopping areas in the vicinity, traffic should not go
through low density areas, many people are not able to attend the meeting time of 3:00 pm in the
middle of the week, non-project rezone is a bait and switch, this goes against the interest of
citizens, projects need to be transparent.
2) Tracy Sawyer: Ms. Sawyer provided testimony related to R-3 zone, high density residential
districts with the full range of urban services, concern on a non-project rezone –people cannot
make informed decisions when there is no context, R-3 is for infill where you already have

infrastructure, the city needs affordable housing, not everyone can afford a $250k home, providing
multifamily housing is the spirit of the R-3 zoning change.
3) Tom Durant: Mr. Durant provided testimonyin favor of not making changes to permitted Class
2 and 3 land uses in the R-3, non-residential uses are to provide support to surrounding residential
areas, there is a need for additional land for affordable housing but supporting land uses shouldn’t
be disallowed, examples of supporting land uses are daycares, schools and churches which are
compatible with residential uses, the class 2 and 3 review provides a case-by-case basis to review
projects.
4) Bill Hordan: Mr. Hordan provided testimony in favor of not making changes to permitted Class
2 and 3 uses in R-3, those uses are appropriate as staff review (Class 2) and by Hearing Examiner
(Class 3), if a previous use is approved under Class 2 or 3 and that is removed from the table
then it becomes a nonconforming use, uses should be looked at as a case-by-case basis
Commission Discussion:
Commissioner Place asked about legal nonconforming uses. Calhoun explained that if a use is
previously approved and the land use table is changed to not allow the use in the zone, then it
becomes legally nonconforming. CommissionerRose stated that there are enough controls with
the Type 3 and 2 review process to be conditioned for compatibility with the R-3 zone. Calhoun
read the definition of Class 3 uses from YMC Ch. 15.02. Commissioner Place noted concern with
the mini-storage use. She would propose a change to not allow the use in R-3, other uses such
as daycares fit well. Commissioner McCormick asked about the R-3 zone and the full range of
urban services. Calhoun noted that services are available and capable of being extended with
development, which is the typical process. Commissioner Rose provided additional context on
the development process. Calhoun read the definition of Urban Services in YMC Ch. 15.02. Vice-
Chair Wallace asked where mini-storage uses could locate in the city if removed from the R-3
zone. Calhoun stated the use would still be allowed in the B-2, AS, GC, RD, M-1 and M-2 zones.
Commissioner Place motioned to remove the Residential Mini Storage Use from R-3, Vice-Chair
Wallace seconded. Commissioner McCormick noted that the people who most need mini-storage
are those who are in high density housing units. Commissioner Place stated she realizes the need
for mini-storage but doesn’t think it should be in areas with housing. Commissioner Rose noted
that recent mini-storage facilities are well-controlled and attended. The motion failed 2-3. A
subsequent motion was made by Commissioner Rose to retain the uses in the R-3 zone as
currently codified in YMC Table 4-1. Commissioner McCormick seconded.Commissioner Rose
asked about future review options. Vice-Chair Wallace asked for additional process clarification.
Calhoun outlined the process and read portions of YMC Ch. 1.42 which gives the Commission
the authority to study and advise the council on its own initiative. The motion passed 3-2.
Other Business–Calhoun reminded the Commission of the upcoming HAP study session and
public hearing. Commissionersrequested a printed version of the HAP when available.
Adjourn–A motion to adjourn to April 14, 2021was passed with unanimous vote. This meeting
adjourned at approximately 4:00p.m.
