CITY OF YAKIMA, WASHINGTON
OCTOBER 8, 1996
ADJOURNED MEETING
The City Council met on this date at 7:30 a.m. at the Sewer Maintenance
Facility, 204 East Pine Street, Yakima, Washington. Council Members
present on roll call were Clarence Barnett, Ernie Berger, John
Klingele, and John Puccinelli. Mayor Lynn Buchanan and Council Members
Henry Beauchamp and Bernard Sims were absent and excused. Glenn Rice,
Acting City Manager; John Hanson, Director of Finance & Budget; Ray
Paolella, City Attorney; Dueane Calvin, Water & Irrigation Manager;
Dave Hussell, Streets & Traffic Operations Manager; Don Skone, Planning
Manager; Chris Waarvick, Wastewater Superintendent; Shelley Willson,
Supervising Traffic Engineer; John Elsden, Senior Project Planner;
Vaughn McBride, Assistant Planner; and Deputy City Clerk Skovald were
also present. There were also several interested citizens in
attendance at this meeting.
Council Member Barnett reported the City Subcommittee of the Yakima
Urban Area Joint Board, of which he and Council Member Klingele are
members, has finished reviewing the Draft Yakima Urban Area
Comprehensive Plan. The purpose of this meeting is to explain some of
the proposed changes as summarized in a report along with
recommendations from the Regional Planning Commission. This report has
been previously distributed to the Council and will also be presented '
to the full Yakima Area Joint Board for review and discussion.
Additional Modifications Recommended by the Joint Board City
Subcommittee
Council Member Barnett referenced Page 1 of the Additional
Modifications, under Land Use Element, p.III -11. He directed attention
to the deletion of certain wording concerning regional mall or center.
This change does not conflict with the Downtown Yakima Core Plan. Also
on Page 1 of the Additional Modifications, under Appendix A, P. A -12,
Council Member Barnett explained the recommendation to add the Large
Convenience Center (LCC) future land use category and descriptive text
in Legend under Map 111-3, Future Land Use. This wording was added to
conform with Policy 3C -1 in the Draft Comprehensive Plan which provides
for Regional Shopping Centers. Council Member Barnett also pointed out
that there may be a number of changes in this section that the Council
may want to consider and should earmark when the final public hearing
is held with the County Commissioners, such as changing current zoning
categories to the Neighborhood Commercial Future Land Use Category.
Council Member Berger referred to the proposed additional criteria on
Page 2, under Modify Policy C3.1, Action Plan Element, as follows. He
wants the wording changed in #5 to not include and not have a
detrimental impact on existing regional center." because he felt
competition alone could cause a detrimental effect on another business.
Council Member Puccinelli felt it is not government's responsibility to
determine what is a detrimental impact. This item needs to be
considered during the final public hearing.

Council Member Barnett directed attention to the recommendation to add
certain references as indicated on ; ;,Page 3 of the Additional
Modifications referring to the Transportation Element and the
Transportation Plan. These changes, which reference the Transit
Element, were made in order to be internally consistent and to comply
with the GMA checklist. Council Member Barnett pointed out that he
introduced these changes, not YVCOG.
Section I - Introduction
Council Member Klingele directed attention to recommended changes in
the first chapter of Section I. The City Subcommittee eliminated
zoning codes and other as an editorial change because building codes
refer to the Capital Facilities Plan instead of the capital budget.
Section II - Action Plan Element
Council Member Barnett referred to a number of General Development
Policies where the "Development Community" should be included as a
responsible agency.
The next major change is an addition under Objective G -2. This'change
reflects Council Member Puccinelli's request to include a grandfather
clause in the Comprehensive Plan to address Goal 6 of the Growth
Management Act concerning the protection of property rights. Council
Member Barnett explained the proposed modification of Objective G2
relates to the Grandfather Clause concept and private property rights.
The addition of Policy G2.5 is a modified grandfather clause which does
not completely address the true grandfather clause in as much as it
mentions extended time limitations under the present ordinance if a
structure has been destroyed and not rebuilt within 12 months and loses
its non - conforming use status.... Council Member Puccinelli wants the
time regulations extended. Council Member Barnett explained that issue
would be decided when development regulations are written.
Council Member Barnett referenced Policy G9.1 on Page II -12 of the
Draft Comprehensive Plan, which requires complete site plans, for all
projects. This was modified to conform with the Council resolution
requiring site plans for all projects. There was discussion about how
this would impact the community and how it will relate to the non-
conforming use issue.
Page II -20, Transportation Policies, on Page 3 of this section refers
to liberal changes to conform with the definition of concurrency found
in the Growth Management Act as it relates to streets and roads. This
includes a site plan for improvements within six years.
Council Member Barnett referred to BICYCLE AND PEDESTRIAN PLAN POLICIES
on Page 3 of this section. These modifications were made by the
Bicycle Plan Review Committee and deal with development regulations in
that plan. The Yakima Urban Area Joint Board will decide whether to
include this or not.
Section III - Land Use Element
Council Member Barnett explained the City Subcommittee rewrote this
section to reflect Council's earlier discussion about the use of the
term "consistency" in the Growth Management Act. The rewrite clarifies •

that the Future Land Use Map proposes a general description of land
uses anticipated and provides a graphic display of where development is
expected to occur. There is a special statement included which
indicates the current zoning map will stay in place until the public
hearing process. There is not going to be any "automatic change" to
the land use map. Zoning change will have to be applied for.
Verna Beggs, 1204 East Spruce Street, had some questions concerning the
rezone process. Glenn Valenzuela invited her to come by the office and
pick up the information and meet with him.
Land Use Compatibility Chart
The Land Use Compatibility Chart that the Hearing Examiner uses during
his hearings was changed to include new terminology. This is now
included in the draft Comp Plan.
Residential Land Uses and the Land Use Map
Glenn Rice directed attention to the new Residential Densities Wall
Chart, a separate informational tool which explains and visualizes each
category. It reflects public testimony to maintain density at the same
dwelling units per acre. Before this change, the density ranges were
indicated less. Council Member Barnett noted that Land Use Element:
Table 3 -5 has been updated to reflect a separate category for Parks and
Open Space. This table will replace the table currently in the Draft
Comprehensive Plan. Incorporated into the Draft Comp Plan for
informational purposes is a list of City Council approved changes and
the Future Land Use Map reflecting those changes. Council Member
Barnett pointed out that the Future Land Use Map needs to be updated to
include the classification of Large Convenience Center (LCC).
Siting of Public Facilities Proposed Lancuage
Council Member Barnett suggested the word, Draft, be removed from the
page. He explained that this language was required by the State
Department of Community, Trade and Economic Development.
Section IV - Housinq Element
The housing element was completely rewritten by Council Member
Klingele. Council Member Klingele explained he corrected materials to
parallel the CHAS, i.e., low and medium income and other contemporary
involvement. Foster care or group homes wording was made more general
in nature. This would be more readable to the layperson. Comparisons
were corrected to use the same basis to make sure everything was
consistent throughout this final draft.
Section V - Transportation Element and Transportation Plan
At the bottom of Page 1 of this section, Council Member Barnett
explained the Draft Comprehensive Plan reference, under the
Transportation Element, includes recommendations of widening of lanes
such as 16th Avenue and other streets. Many of the proposed changes
reflect the consultant's recommended alternative and also testimony
heard during public hearings, such as Petition No. 1220 against the
widening of 32nd Avenue. Other petitions are expected. The
Transportation Plan will have to be revised according to the public

testimony. Formal discussion about these petition requests will be at
the public hearing.
At the top of Page 2 of this section, Council Member Barnett referred
to the proposed change to add the Yakima Air Terminal Master Plan
Update by reference. At the bottom of Page 2, Council Member Barnett
noted the correction to the definition of concurrency.
On Page 3 of this section, Council Member Barnett reported that he has
requested the appropriate Transportation Plan tables indicate that $7
million of the $59 million alternative is included for
Bicycle /Pedestrian facility improvements. It also needs to include
that the consultant recommends those capacity improvements.
Bicycle Pedestrian Plan
Council Member Barnett referred to the Bicycle and Pedestrian Plan as
revised by the Bicycle Advisory Committee included in this section.
The policies in this plan were not added to the Draft Comprehensive
Plan and the. Bike Plan. The City Council might consider adding them or
just including them by reference. He reiterated that most of the
superfluous elements have been eliminated in this revised document.
Section VI - Capital Facilities Element and Capital
Facilities Plan
Referring to Page 1 of this section, Council Member Barnett explained
that the reference to the $907,000 was deleted because the original
Bike Plan gave a whole list of streets requiring off street parking to
allow bike paths throughout the City. On Page 2 of this section, the
City's domestic water rights information was corrected. Also on Page
2, the statement of spending, was corrected to include the actual
proposed amount for 0 & M expenditures. There is a footnote added to
the table to include Bike and Pedestrian capacity improvement costs.
John Hanson explained that the referenced Capital Facility Plan changes
originally indicated for the Convention Center costs probably should
not be changed.
Section VII - Utilities Element
Council Member Barnett indicated that he asked HDR to come up with a
stormwater alternative and Alternative 3A was recommended although
there was no vote. Yakima County thinks Alternative 3A should not be
put in the Plan since it was not voted on. The Council Subcommittee,
Klingele and Barnett, believe it should be included because Alternative
3A was suggested during the public hearing and should be included as an
alternative. Council Member Barnett commented that he feels the
Alternative 3A plan, estimated to cost about $4 "million, would satisfy
DOE requirements. Although, the consultant still. recommends
Alternative 4, estimated to cost about $22 million. Council Member
Klingele commented about utility services regulation with current
requirements recently changed.
Under Paae VII - 17 Implementation, in the Second and Third Paragraph
Council Member Barnett provided copies of a handout, "ADDITIONAL
RECOMMENDATIONS." He explained that under the Draft Comp Plan it

indicates the Yakima County Commissioners and the City Council should
start a stormwater utility. He recommends that wording be changed
indicating that the City Council and the Yakima County Commissioners
may consider a stormwater utility instead of should establish. Council
Member Barnett also recommended that the sentence about "Formation of
the Utility" be deleted as indicated in the handout since Yakima County
has already indicated they would be the lead agency.
Other Issues Discussed
Council Member Barnett reported that the Washington State Community,
Trade & Economic Development meetings are scheduled today, and a
representative from the Planning Division will attend who will review
the Draft Report from that meeting. There will probably be some final
recommendations made and any proposals should be brought up during the
final public hearing. Council Member Berger congratulated Council
Members Barnett and Klingele for their participation in the major
rewrite.
Glenn Rice reminded the Council of an Urban Area Joint Board Meeting at
10:30 a.m. on Thursday in the City Manager's Conference Room.
Glenn Valenzuela asked if the time frame of the City Council's meeting
schedule would allow the scheduling of a special meeting on November
5th to hear the Appeal of the Determination of Significance for the
Providence Yakima Medical Center Expansion project. Staff was . directed
to inform the appellants that this is a Quasi - Judicial matter and there
are procedural complexities which require the appeal go through the
required time frame.
Glenn Rice reviewed -the schedule of upcoming Council subcommittee
meetings this week.
Council Member Barnett asked that enough copies of the Joint Board
Recommended changes be made available.
It was MOVED BY PUCCINELLI, SECONDED BY- KLINGELE, TO ADJOURN THE
MEETING AT 9:00 AM. The motion carried by unanimous voice vote; Sims,
Beauchamp, and Buchanan absent.
