HomeMy WebLinkAbout01/08/2013 07 Termination of Joint Air Terminal Operations Agreement; Conveyance of Yakima Air Terminal Property Ownership to the Citye BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. For Meeting of: January 8, 2013 I ITEM TITLE: Resolution relating to public services, authorizing the City Manager to execute an agreement with Yakima County to terminate the Joint Air Terminal Operations Agreement and to accept receipt of Yakima County's undivided half interest in the real and personal property of the Yakima Air Terminal, McAllister Field, resulting in the City becoming the sole owner of the Yakima Air Terminal; and authorizing the City Manager to execute the necessary legislation concerning operation and property acquisition as is necessary to receive the County's undivided half- interest conveyance of said real and personal property. SUBMITTED BY: Jeff Cutter, City Attorney CONTACT Jeff Cutter, City Attorney / 575 -6030 PERSONITELEPHONE: SUMMARY EXPLANATION: In June, 1982 the City Quit -Claim Deeded an undivided one -half interest in fee simple in and to the real property, and all improvements and appurtenances then comprising the Yakima Air Terminal, McAllister Field (YAT), to Yakima County to be shared equally with the City as tenants in common. The City and County entered a Joint Air Terminal Operations Agreement, in accord with RCW Chapter 14.08, that provided for a Joint Board to operate and oversee the general operations of the YAT on behalf of the City and County. The City and County have decided that in the current environment it is in the best interest of the City and County and their respective constituents that YAT operations should be conducted by one owner and one voice of authority, and that it is therefore desirable to both parties that the County convey its undivided one -half interest in the real and personal property constituting the YAT back to the City. Upon the approval of this Resolution and a similar Resolution by the County Commissioners stating a parallel determination, the City and County shall initiate the necessary discussion and prepare the necessary deeds, legislation and agreements to fully transfer the real and personal property, assets and liabilities constituting the YAT to the City, in accord with the specific terms and conditions associated therewith as shall be the result of said discussions. This Resolution expresses the desire and intent of the City to proceed with the necessary discussion and preparation to affect the transfer of YAT ownership to the City as quickly as is reasonably possible to facilitate the smooth transition of ownership back to the City early in 2013. R- 20,13- A RESOLUTION relating to public services, authorizing the City Manager to execute an agreement with Yakima County to terminate the Joint Air Terminal Operations Agreement and to accept receipt of Yakima County's undivided half interest in the real and personal property of the Yakima Air Terminal, McAllister Field thereby acknowledging the intent of the Joint Owners that the City become the sole owner and operator of the, Yakima Air Terminal; and authorizing the City Manager to execute the necessary legislation concerning operation and property acquisition as is necessary to receive the County's undivided half- interest conveyance of said real and personal property and to establish the City's sole operation of the Yakima Air Terminal. WHEREAS, in June, 1982 the City Quit -Claim Deeded an undivided one -half interest in fee simple in and to the real property, and all improvements and appurtenances thereto then comprising the Yakima Air Terminal, McAllister Field (YAT), to Yakima County, to be shared equally with the City as tenants in common, and WHEREAS, the City and County entered a Joint Air Terminal Operations Agreement, in accord with RCW Chapter 14.08, that provided for a Joint Board to operate and oversee the general operations of the YAT on behalf of the City and County; and WHEREAS, the City and County have decided that in the current environment it is in the best interest of each of them and the citizens thereof that YAT operation would be conducted most efficiently and economically by one owner and one voice of authority, as is indicated in the attached letter from Commissioner Elliott, and that it is therefore desirable to both parties that the County convey its undivided one -half interest in the real and personal property constituting the YAT back to the City; and WHEREAS, the City and the County shall, upon the approval of this Resolution and a similar Resolution by the County Commissioners stating a parallel determination, initiate the necessary discussion and prepare the necessary deeds, legislation and agreements to fully transfer the real and personal property, assets and liabilities constituting the YAT to the City, in accord with the specific terms and conditions associated therewith as shall be the result of said discussions, and WHEREAS, it is the desire and intent of the City to proceed with the necessary discussion and preparation to affect the transfer of YAT ownership to the City as quickly as is reasonably possible to facilitate the smooth transition of ownership back to the City early in 2013, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Yakima Air Terminal, McAllister Field shall become the sole property of the City of 'Yakima, and all legislation, property deeds and agreements that are required to carry out the transfer of all real and personal property, to allocate the assets and liabilities associated therewith, and to terminate the Joint Air Terminal Operations Agreement, shall be prepared in accord with the direction of the City Council and the County Commissioners; and the City Manager of the City of Yakima is hereby authorized and directed to execute all necessary documents required to accomplish this transfer of ownership to the City from the County, under the terms as shall be determined. This format worked well in the `good' years. However, in recent years under the present Airport management structure, we have seen several issues unable to be effectively resolved. The existing three - way decision process is slow and unresponsive and the issues at hand cannot be dealt with in a timely efficient manner. For these reasons a discussion began for a single entity to take over ownership of the Airport and operate it as a department. The Board of County Commissioners is willing to assign our interest in the Yakima Airport to the City which will enable the speedy resolution of the outstanding legal and operating problem's. It is our opinion this should be conducted with dispatch to avoid protracted personnel and legal issues with adjacent land owners. In addition, the RFP's for alternative airport management proposals and commercial air service consultants are due in early January and should be reviewed and decided upon by the City as the owner of the Airport. We believe it is in the best interest of all to have a single voice of authority to allow for the resolution of issues as well as the growth and development of the Yakima Airport.
