SUBMITTED BY: Jeff Cutter, City Attorney CONTACT Jeff Cutter / 575 -6030 PERSON /TELEPHONE: SUMMARY EXPLANATION: In accord with City Council direction from the November 6, 2012 City Council meeting, this proposed ordinance amends Section 1.46 026 of the Yakima Municipal Code relating to City Council and Commissions, amending the residency requirements for the City of Yakima Planning Commission members to allow non - residents of the City that own and /or operate businesses and properties that are located within the City to be members of the Commission. ATTACHMENTS: Click to download ❑ Ord - Planning Commission Membership Requirement Amendment -12 -2012 ❑ Ordinance planning commission clean ORDINANCE NO. 2012 - AN ORDINANCE relating to City Council Committees and Commissions, amending the residency requirements for the City of Yakima Planning Commission members to allow non - residents of the City that own and /or operate businesses and properties that are located within the City to be members of the Commission, and specifically amending Section 1.46.026 of the Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.42.026 of the City of Yakima Municipal Code is hereby amended to read as follows 1.42.026 Residence of members. No person shall hold the office of member of the City Planning Commission unless that person is either 1) a resident of the City of Yakima, or 2) an owner of a business or of real property that is located within the City of Yakima. The office of member of the City Planning Commission shall become vacant upon such member ceasing to meet the requirements of either 1 or 2, or both, as described in this Sectionrcsidc in the City. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
