SUMMARY EXPLANATION:
® On October 2, 2012 the Yakima Planning Commission's recommendation to not approve
this Comprehensive Plan amendment and rezone was not accepted and the matter was
remanded back to the Planning Commission for a second hearing. When informed that a
second hearing was to be held the applicants chose not to proceed with the second hearing.
This resolution withdraws the application and rescinds the direction for a second hearing.

RESOLUTION NO. R -2012-
A RESOLUTION Withdrawing Comprehensive Plan Amendment #003 -12 and
Rezone #003 -12 from further Council consideration and
rescinding the Council's direction to remand this matter back
to the City of Yakima's Planning Commission.
WHEREAS, Comprehensive Plan and the rezone applications were
submitted, for property located at 1021 S 31 Avenue during
the City of Yakima's annual Comprehensive Plan
amendment and rezone process. Requested was a
Comprehensive Plan Future Land Use Map Amendment
from Low Density Residential to Neighborhood Commercial
and a concurrent rezone request from R -1, Single family
residential to B -2, Local Business; and
WHEREAS, The City of Yakima's Planning Commission held an open
record public hearing to consider this amendment and
rezone request on August 8, 2012; and
WHEREAS, On September 27, 2012 the City ..of Yakima Planning
Commission voted four in favor, one against and with one
1111 abstention not to recommend to the Yakima City Council that
this comprehensive plan amendment and rezone application
be approved; and
WHEREAS, On October 2, 2012 the Yakima City Council held a closed
record public hearing to consider the Yakima Planning
Commission's recommendation on this amendment and
rezone application, at the conclusion of which they voted
unanimously to remand this matter back to the Yakima
Planning Commission for further fact finding and
deliberations; and
WHEREAS, The applicants, herein, having been informed of the remand
decision, have chosen to not proceed with a new public
hearing before the Planning Commission, and
WHEREAS, The Yakima City Council deems it to be in the best interests
of the City of Yakima that the applicant's decision not to
proceed with a new hearing before the Planning Commission
should be honored, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:

Comprehensive Plan Amendment #003 -12 and Rezone #003 -12 are •
hereby withdrawn from any further consideration and the Council's
remand of this matter back to the City of Yakima Planning Commission is
hereby rescinded.
