SUMMARY EXPLANATION:
In order to address current and projected budget shortfalls due to reduced City of Yakima
revenues, cost savings must be identified and implemented at all levels of City government to
ensure financially sustainable, high levels of service to the public. This Amendment eliminates the
tax deferred compensation plan for newly hired employees within the management group as
defined in YMC 2.20.130.

Ordinance Amending YMC Section 2.20.130 Re Deferred Compensation
• ORDINANCE NO. 2012-
AN ORDINANCE amending Section 2.20.130 of the City of Yakima Municipal Code
by eliminating the deferred compensation provision for newly hired
management group employees.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1, Section 2.20.130 of the City of Yakima Code is hereby amended to
read as follows.
"2.20.130 Management group tax deferred compensation plan.
Commencing May 1, 1995, each member of the management employee group, as
defined below, shall participate in a tax deferred compensation plan adopted or
approved by the city and shall be paid, in addition to that employee's monthly salary as
established by the compensation plan, deferred earned compensation each month in an
amount equal to three percent of said monthly salary.
Effective December 9, 2012 (or as individually negotiated between the City and
prospective employees prior to the effective date of this amendment), newly hired
employees of the management group will not be eligible, nor shall participate, in the tax
• deferred compensation plan.
The management employee group, as that term is used in this section, is composed of
any non - temporary employee in the following positions:
(1) Executive series, as listed in Section 2.20.100(B);
(2) Management series, as listed in Section 2.20.100(B);
(3) Executive support series as listed in Section 2.20.100(B);
(4) Public safety management series, as listed in Section 2.20.100(E);
(5) Union exempt management support group, as listed in Section
2.20.100(D);
(6) Union exempt supervisory group, as listed in Section 2.20.110(H);
(7) Union exempt fire civil service, as listed in Section 2.20.100(K). (Ord. 95 -18

2689 § 1, 1983)."

Section 2. This ordinance shall become effective and shall be in full force and
effect 30 days after its passage and publication in accordance with law.
