OCTOBER 3, 1995
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the : Chambers of City Hall, Mayor Pat Berndt,
presiding, Council Members Clarence Barnett, Henry
Beauchamp, Ernie Berger, and Lynn Buchanan present on roll
call. `Council Members Bill Brado and Bernard Sims absent
and excused. City, Manager Zais, City Attorney Paolella,
and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Buchanan.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS (IF APPLICABLE).
Mayor Berndt read a proclamation declaring October as Breast
Cancer Awareness Month and declaring October 19, 1995 as
Mammography Day. Providence Medical Center staff accepted
the proclamation and directed attention to their public
education campaign which teaches important lifesaving, early
detection methods.
Doug Dodd, Water & Irrigation Superintendent, announced the
end of the irrigation season. Staff will begin shutting
down the irrigation system this Sunday, October 8, 1995.
Mr. Dodd also indicated a press release will be prepared.
It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO
APPOINT GREG BERNDT TO THE AIRPORT BOARD. The motion
carried by a unanimous voice vote; Brado and Sims absent.
Mayor Berndt directed staff to notify Mr. Berndt of his
appointment.
Chris Waarvick, Wastewater Superintendent, reported all
steps have been taken, or are in process, to alleviate the
odor situation at the Wastewater Treatment Plant.

4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, announced that Item No. 9 was removed from the
agenda and questioned whether there were any additions or
deletions from either Council members or citizens present.
I/ The City Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED BY
BUCHANAN, SECONDED BY BEAUCHAMP, THAT THE CONSENT
AGENDA, AS READ, BE ADOPTED. The motion carried by
unanimous roll call vote; Brado and Sims absent.
(Subsequent paragraphs preceded by an asterisk ( *) indicate
items on the Consent Agenda handled under one motion without
further discussion.)
*5. APPROVAL OF THE MINUTES OF THE SEPTEMBER 19, 1995 BUSINESS
MEETING
The minutes of the September 19, 1995 Business meeting, was
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. HEARING ON APPEAL OF DENIAL OF ISSUANCE OF TAXI DRIVER'S
LICENSE FILED BY. ALLEN HAGEN
The hearing was canceled.
7. AUDIENCE PARTICIPATION'
None.
8. PRESENTATION OF YAKIMA VALLEY CONFERENCE OF GOVERNMENTS 1996
BUDGET
Lon Wyrick, Executive Director of the Yakima Valley
Conference of Governments (YVCOG), briefly outlined and
urged the Council to accept 1996 YVCOG Preliminary Budget.
He reported the Executive. Committee has proposed no
increases in the assessments from 1995; however, the City of
Yakima's assessment has increased by 1.2% due to increased
population within the jurisdiction. Mr. Wyrick provided an
informational handout to the Council and directed their
attention to various countywide programs YVCOG administers,
including housing rehabilitation; transportation project
review; water quality; and traffic safety. Mr. Wyrick also
answered questions from the Council concerning the diversity
of its employees and affirmative action statistics for
YVCOG. There was discussion about jurisdiction
representation and the organization's procedures.
Mr. Wyrick provided explanation concerning the ISTEA
Enhancement prioritization process for project requests.

ACCEPT THE REPORT. The motion carried by unanimous voice
vote; Brado and Sims absent.
9. CONSIDERATION OF APPOINTMENT TO THE LOCAL REVIEW BOARD FOR

This Item was removed from the agenda.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EASEMENT WITH
BONNEVILLE POWER ADMINISTRATION AT FRUITVALE FISH SCREEN
RESOLUTION NO. R -95 -136, A RESOLUTION authorizing the
City Manager to execute a Contract and Grant of Easement with
the United States Bonneville Power Administration.
*11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH THE YWCA AS THE PROVIDERS OF SERVICES FOR THE
DOMESTIC VIOLENCE VICTIM'S ADVOCATE
RESOLUTION NO. R -95 -137, A RESOLUTION authorizing the
City Manager and City Clerk of the City of Yakima to execute
an Agreement with the YWCA to continue to provide domestic
violence services.
*12. APPROVAL OF FIRST HALF 1995 VEHICLE INCIDENT /COLLISION REPORT
The First Half 1995 Vehicle Incident /Collision Report was
accepted.
*13. SECOND READING OF ORDINANCE AMENDING THE 1995 BUDGET AND
APPROPRIATING FUNDS FOR ACQUISITION OF PROPERTY AT 210 SOUTH
2ND STREET
An Ordinance amending the 1995 budget and appropriating funds
for the acquisition of property at 210 South 2nd Street,
having been read by title only at the previous meeting, was
brought before the Council for a second reading.
ORDINANCE NO. 95 -50, AN ORDINANCE amending the 1995
budget for the City of Yakima; and making an appropriation of
$110,000 in the Police Capital Fund for expenditure during
1995 to provide for the purchase of land and building located
at 210 South Second Street (Butler Property). The City and
the City /County Narcotics Unit will share purchase price
equally with the CCNU contributions being accounted for as
pre - payment of a long -term lease. At the termination of the
lease, property will revert to the City.

*14. SECOND READING OF ORDINANCE AMENDING THE 1995 BUDGET AND
APPROPRIATING FUNDS FOR FIRE FIGHTING INSTRUCTION SERVICES
CONTRACT WITH THE YAKIMA SCHOOL DISTRICT
An Ordinance amending the 1995 budget and appropriating funds
for the fire fighting instruction services contract with the
Yakima School District, having been read by title only at the
previous meeting, was brought before the Council for a second
reading.
ORDINANCE NO. 95 -51, AN ORDINANCE amending the 1995
budget for the City of Yakima; making appropriations for a
Firefighter Training Program for Skill Center Students from
Unappropriated Fund Balances within various Funds for
expenditure during 1995.
*15. FIRST READING OF ORDINANCES AMENDING THE 1995 BUDGET (NO
FORMAL ACTION REQUIRED THIS MEETING)
A. ORDINANCE APPROPRIATING FUNDS INTO THE ENVIRONMENTAL FUND
An Ordinance amending the 1995 budget and appropriating funds
for underground storage tank upgrades and remediation, and a
hazardous waste storage facility, having been read by title
only, was laid on the table for two weeks, until October 17,
1995.
B. ORDINANCE APPROPRIATING: FUNDS INTO THE WATER FUND
An Ordinance amending the 1995 budget and appropriating funds
for the purchase of new water meter service material and
professional legal services, having been read by title only,
was laid on the table for two weeks, until October 17, 1995.
C. ORDINANCE APPROPRIATING FUNDS INTO THE IRRIGATION FUND
An Ordinance amending the 1995 budget and appropriating funds
for payment of overtime, operating supplies, repair and
maintenance by contractors and professional services, having
been read by title only, was laid on the table for two weeks,
until October 17, 1995.
