ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Mayor Pro Tem Clarence Barnett, presiding, Council Members Henry Beauchamp, Ernie Berger, Bill Brado, Lynn Buchanan, and Bernard Sims present on roll call. Mayor Pat Berndt absent and excused. Acting City Manager Rice, Assistant City Attorney Peterson, and Acting City Clerk Skovald also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Brado. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) Pete Blue presented the City with a check for $500 from proceeds from a Teen Dance he promoted along with other local sponsors. Irene Guitteriez, Rebound Manager, described current Alley Cat projects including Graffiti removal from City parks. Mayor Pro Tem Barnett read a proclamation declaring August 16, 1995 as Yakima Find Another Day Way. Lance Durbin accepted the proclamation, passed out buttons and urged citizens to use alternative methods of transportation instead of . driving alone to and from work. It was MOVED BY BEAUCHAMP, SECONDED BY BRADO, TO NOMINATE ROBERT CRISP AND BRUCE SMITH TO THE DARC COMMITTEE. The motion carried by unanimous voice vote; Berndt absent. 4. CONSENT AGENDA Mayor Pro Tem Barnett referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. He announced Item No. 10C and Item No. 17 were removed from the Agenda entirely. The Acting City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 282 AUGUST 8, 1995 *5. APPROVAL OF THE MINUTES OF THE JULY 25, 1995 BUSINESS MEETING The minutes of the July 25, 1995 Business meeting was approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. SPECIAL PRESENTATION BY BETTY EDMONDSON ON THE WOMAN SUFFRAGE DIAMOND JUBILEE Betty Edmondson welcomed Representative Mary Skinner from the 14th Legislative District. Ms. Edmondson recognized Washington state women, including some from the Yakima Valley, who were influential in the Woman's Suffrage movement, which lasted 72 years. The Yakima Woman's Century Club will honor elected women officials at a special celebration and the Allied Arts' Festival, will include a Celebration March commemorating the 75th Anniversary of Women's Right to Vote. Mayor Pro Tem Barnett declared the week of August 19 -26, 1995, as The Woman Suffrage Diamond Jubilee and noted that Washington was ahead of its time by being the first state or territory in the Northwest to allow women to vote, almost 40 years before the Nineteenth Amendment to the U S Constitution was adopted in 1920. 7. AUDIENCE PARTICIPATION None. *8. CONSIDERATION OF RESOLUTION AUTHORIZING RESIDENTIAL RENTAL AGREEMENTS RELATING TO FIRE STATION #5 TRAINING FACILITY PROPERTY WITH: A. BILL AND JEAN PITTS B. LORRAINE LEWIS RESOLUTION NO. R - 95 - 110, A RESOLUTION authorizing the City Manager to execute Residential Rental Agreements for the use of certain property at 812 Central Avenue and at 808 A Central Avenue, Yakima, Washington. *9. CONSIDERATION OF RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH OWNERS OF VACANT STRUCTURES FOR FIRE DEPARTMENT TRAINING PURPOSES I/ RESOLUTION NO. R -95 -111, A RESOLUTION authorizing and directing the City Manager and the City Clerk of the City of Yakima to execute Fire Training Exercise Agreements. 2 AUGUST 8, 1995 2 V 3 • *10. SET DATE OF PUBLIC HEARING /MEETING FOR AUGUST 22, 1995, FOR • CONSIDERATION OF THE FOLLOWING: A. GARRETT STREET RIGHT -OF -WAY VACATION (PUBLIC HEARING) August 22, 1995 was set as the date of continuance of the public hearing on the Garrett Street and adjacent alley right -of -ways vacation petition. B. BUTLER -HANEY PROPERTIES REZONE REQUEST (PUBLIC MEETING) August 22, 1995 was set as the date of public meeting on the Butler -Haney Properties rezone request for property located at 3801 River Road. C. PROPOSED REFUSE LEGISLATION AMENDMENTS (PUBLIC HEARING) This item.removed from the Agenda. *11. APPROVAL OF FINAL CONTRACT PAYMENT FOR THE 7TH STREET SEWER TRUNK (STANDARD MOTION V -B -- ACCEPT THE PROJECT AND APPROVE FINAL PAYMENT) • • The report from the.City Engineer, dated July 26, 1995, with respect to the completion of the work on the 7th Street Sewer Trunk, performed by Casper & Magera, Inc. was approved, the work accepted and payment of the final estimates as therein set forth was authorized. *12. CONSIDERATION OF RESOLUTION AUTHORIZING CITY MANAGER TO ACCEPT CERB FUNDING RESOLUTION NO. R -95 -112, A RESOLUTION authorizing and directing the City Manager to execute, on behalf of the City of Yakima, the City's acceptance of an Initial Offer of a loan from the Washington State Community Economic Revitalization Board to partially finance•the cost of constructing or improving public infrastructure in the vicinity of Central Heating & Plumbing, Inc.'s new facility; and further authorizing and directing the City Manager and the City Clerk to execute, on behalf of the City a Final Contract between the Community Economic Revitalization Board • and the City, and further designating and authorizing the City Manager to act as the official representative of the City to take such additional steps as may be necessary and prudent to establish this financial assistance. • 3 • 284 AUGUST 8, 1995 *13. CONSIDERATION OF RESOLUTION AUTHORIZING MODIFICATION TO PROFESSIONAL SERVICES AGREEMENT WITH DENNIS COVELL FOR I -82 PROJECT RESOLUTION NO. R - 95 - 113, A RESOLUTION authorizing execution of an amended Agreement for Professional Engineering Services with Dennis E. Covell. I/ *14. CONSIDERATION OF RESOLUTION EXECUTING PROFESSIONAL SERVICES CONTRACT TO PROVIDE ENVIRONMENTAL COMPLIANCE AUDIT AT WASTEWATER TREATMENT PLANT RESOLUTION NO. R - 95 - 114, A RESOLUTION authorizing' the execution of an agreement for professional engineering and consulting services between the City of Yakima, a municipal corporation, and Dames and Moore Inc. *15. CONSIDERATION OF LEGISLATION FOR THE YAKIMA AIR TERMINAL A. JOINT CITY /COUNTY RESOLUTION APPROVING 1995 BUDGET AMENDMENT #2 RESOLUTION NO. R - 95 - 115, A JOINT RESOLUTION of the City of Yakima and Yakima County approving the Yakima Air Terminal 1995 Budget- Amendment #2. B. JOINT CITY /COUNTY RESOLUTION APPROVING AMENDMENT #1 TO FAA GRANT AGREEMENT FOR TERMINAL IMPROVEMENTS RESOLUTION NO. R - 95 - 116, A JOINT RESOLUTION of the City of Yakima and Yakima County ratifying Amendment #1 to Federal Aviation Grant (FAA) made to the Yakima Air Terminal for Project #3 -53- 0089 -15 under Contract Number DOT- FA95NM -0027 deleting Special Condition Number 11 authorizing payment by letter of credit. *16 APPROVAL OF SECOND QUARTER TREASURY REPORT The Second Quarter 1995 Treasury Report was approved. 17. CONSIDERATION OF ORDINANCE RESTRICTING PARKING IMMEDIATELY ADJACENT TO FEDERAL BUILDING (CHESTNUT AND THIRD STREET) AS I/ REQUESTED BY US MARSHAL'S OFFICE This item removed from the Agenda. 4 285 AUGUST 8, 1995 *18. CONSIDERATION OF ORDINANCE, RELATING TO TRAFFIC, AMENDING THE MUNICIPAL CODE TO REFLECT DUI LAW AS FOUND IN THE WAC MODEL TRAFFIC ORDINANCE ORDINANCE NO. 95 -39, AN ORDINANCE relating to traffic; amending City of Yakima Municipal Code Section 9.46.010 to incorporate Washington State's. 1995 DUI laws as found in the Washington Administrative Code, Chapter 308 -330, the model Traffic Ordinance; repealing City of Yakima Municipal Code Sections 9.46.021, 9.46.022, 9.46.023, 9.46.024, 9.46.025, 9.46.026, 9.46.027 and 9.46.028 to delete obsolescent 1994 DUI laws; and adopting City of Yakima Municipal Code Section 9.46.031, Savings clause. *19. SECOND READING OF ORDINANCE APPROPRIATING FUNDS TO STREET BUDGET FOR GRAFFITI REMOVAL An Ordinance amending the 1995 budget and appropriating funds to provide for an Interlocal Agreement between the City and County regarding Graffiti Cleanup, having been read by title only at the July 25, 1995 meeting, was brought before the Council for a second reading. Ordinance No. 95 -40, AN ORDINANCE amending the 1995 budget for the City of Yakima; and making an appropriation of $25,000 in the General Fund for expenditure during 1995 to provide for an Interlocal Agreement between the City and County regarding Graffiti Cleanup. *20. SECOND READING OF ORDINANCE AMENDING THE 1995 TRANSIT OPERATING BUDGET An Ordinance amending the 1995 budget and appropriating funds to provide for an expenditure during 1995 for Dial -A -Ride Service and Overtime, having been read by title only at the July 25, 1995 meeting, was brought before the Council for a second reading. Ordinance No. 95 -41, AN ORDINANCE amending the 1995 budget for the City of Yakima; and making an appropriation of $165,000 in the Transit Operating Fund for expenditure during 1995 for Dial -A -Ride Service and Overtime. 21. OTHER BUSINESS Acting City Manager Rice reported no executive session was needed. Council Member Beauchamp reported a citizen has expressed concern about the safety of the intersection at North 6th 5 286 AUGUST 8, 1995 Street and Lincoln Avenue. Apparently there has been a number of accidents at this intersection and branches from nearby trees are partially blocking the view. He felt the problem could increase as the I -82 Project is built. Mayor Pro Tem Barnett requested staff bring a report back on this issue. 22. ADJOURNMENT There being no further business to bring before Council, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADJOURN AT 2:25 PM. The motion carried by unanimous voice vote; Berndt absent.
