Purpose. The purpose of the accessory dwelling unit (ADIJ) provisions is to: 1. Provide property owners with an opportunity for extra income, companionship, and security; 2. Better utilize existing infrastructure and community resources (sewer, water, roads, etc.); 3. Provide a housing type that allows flexibility to respond to changing needs and lifestyles; 4. Add 1u the supply of affordable dwelling units; and 5. Protect neighborhood character and stability byensuring that ADUx are compatible with surrounding land uses. B. Requirements. An accessory dwelling unit inu permitted use on all parcels containing a single- family dvvo||inQ (3ooYK4C15.U4.030. Tub|o4'l. for |ovo| nfroviom) nubjoo11ua|| u[thofo||umin0 conditions: 1. The accessory dwelling unit may be attached to the primary residence or attached to or above a detached garage, orhe its own stand-alone structure. u 2. Off-street parking shall be provided as required in YMC Chapter 15.06 for both the ADU and the primary residence located nn the lot they are intended tnserve. 3. TheADU's floor area shall not exceed one thousand square feet. 4. The ADU'o exterior walls shall be designed ouas tobo similar in style, color, and building materials to the primary detached dwelling. 5. An ADU attached to the primary structure shall have the same building setbacks as the primary structure. An ADU that is attached to, or built above, a detached garage or a stand- alonesdruo1uroohaUhave1heoamebui|dingoe1baokoasanaouoosuq/ structure. §. A parcel/lot shall contain no more than one single-family residence and one AIDU. 7. ADUs shall not be allowed on parcels containing a duplex or multifamily dwelling, or a commercial or industrial struo1uro/une. 0. ADUs shall only be permitted onparce|si|ots sized appropriately for a duplex per YMC 15.05.030, Table 5-2. ADUs proposed on lots smaller than the minimum lot size may he approved after undergoing one additional level u[ review ao shown inYK4C l5.U4.03U' Table 4- 1. g. The primary residence and the ADU shall both be connected to public sewer and water. a. If the ADU is attached to the primary dwelling unit, the two dwelling units shall share a single sewer and water connection. b. If the ADU is attached to, or located above, a detached garage, or is a stand-alone structure, each unit may have its own sewer and water connection, with required meters, or share the sewer and water connection with the primary dwelling unit consistent vjith app|ioallouodo(o). 10. A lot containing an ADU shall not be subdivided, or otherwise segregated in ownership, in a way that separates the ADU and the primary dwelling unit on different lots, except as permitted under Y&4CTitle 14. 11. The site plan for the construction or conversion of an ADU shall indicate the AIDU. 12. Any exterior stairs shall bo placed in the rear ur side yard. 13. A deed restriction, signed by the property owner and the city, shall be recorded with the Yakima County auditor's office providing notice to potential buyers of the ADU restrictions. 14. ADU'o uses una short term rental shall also comply with Y&4C l5.0g.080 and all other applicable codes. C. Enforcement. The city retains the right with reasonable notice to inspect the ADU for compliance with the provisions ofthis section. 9 D. Elimination. The city retains the rightv/hhroaoonab|eno1icoh) vvithdraw/000upanuyayyrnva| if any of the requirements under subsection B of this section are violated. In the event the city withdraws occupancy, the property owner may: 1. |f attached, merge the existing ADU |n the single-family dwelling; nr 2. If detached, use the building for an approved accessory use or remove the structure from the premises.
