section of N. 35th Avenue south of River Road that was
originally constructed as a portion of the Chesterly
Meadows Assisted Care Facility development.

SUMMARY EXPLANATION:
Dr. Lloyd Butler, the current owner of a private road, N. 35th Avenue, located just south of
River Road, submitted an application to transfer ownership of this section of N. 35th Avenue
to the City. This section of N. 35th Avenue was originally constructed in 2001 as a public
street. Upon Dr. Butler's request, the street right -of -way was vacated in 2007.
In accordance with Chapter 8.95 of the Yakima Municipal Code, Dr. Butler had PLSA
Engineering fill out the Private Road Evaluation Form. We have reviewed the application
and conducted a site review. Attached is a memo detailing our review. We recommend that
the City accept ownership of this section of N. 35th Avenue, as long as, Dr. Butler is held
responsible to have it crack sealed and chip sealed, and install two signs, "No Outlet" and
"Speed Limit 25 ". Besides showing significant wear, this section of N. 35th Avenue meets
the City's Roadway Standards.

RESOLUTION NO. R -2012-
A RESOLUTION accepting a section of N. 35 Avenue into public ownership.
WHEREAS, Dr. Lloyd Butler has requested that the City take ownership of
a section of N. 35 Avenue, which he currently owns, located just south of River
Road; and
WHEREAS, Dr. Butler has prepared a Quit Claim Deed conveying
ownership of this section of N. 35 Avenue to the City; and,
WHEREAS, City staff have reviewed the Private Road Evaluation Form
and determined that this section of N. 35 Avenue meets the requirements of the
City's Roadway Standards; and,
WHEREAS, Dr. Butler has acknowledged that he will either pay for, or
contract the crack sealing and chip sealing of this section of N. 35 Avenue prior
to next summer; and,
WHEREAS, the City Council deems it to be in the best interest of the City
of Yakima to accept public ownership of this section of N. 35 Avenue, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That said roadway, N. 35 Avenue immediately south of River Road shall
be accepted into public ownership.

Re: Application of Lloyd Butler Transfer Ownership of N. 35 Avenue to the City
In September of this year, Lloyd Butler submitted an application to transfer ownership of
N. 35 Avenue to the City. This section of N. 35 Avenue was originally constructed in
2001 as a public street. Upon request of the adjacent property owner, the street right -of-
way was vacated in 2007.
The Engineering Division and Traffic Engineer have reviewed the application and have
reviewed the site. Attached is a spreadsheet comparing the City Standards to 35
Avenue. It meets all of the City Standards, but shows significant wear. We recommend
that Dr. Butler be responsible for having the roadway crack sealed and chip sealed, and
install two signs — one that says "No Outlet" and another that says "Speed Limit 25 ".
One thing to note. The approved construction plans showed sidewalk on the north side of
the two parcels adjacent to River Road. Instead of constructing the sidewalk in these
locations, the owner had signed a deferral agreement. This deferral agreement requires
the owner to pay the price to construct these sections of sidewalk at the time the roadway
is improved. If developments are made on these parcels prior to the sidewalk being built,
the sidewalk would be constructed as part of the development.
We recommend that the City accept ownership of this section of N. 35 Avenue if Dr.
Butler commits to crack sealing and chip sealing the roadway and installing the two signs
listed above.
