SUMMARY EXPLANATION:
D.A. Arthur Inc. is requesting a Right -of -Way Use permit to construct a 4 ft iron fence within the City
of Yakima street right -of -way that is 26 inches from the face of the building and approximately 12 ft
from the face of the curb at 220 West Yakima Avenue.
The required proof of ownership and liability insurance outlined in Chapter 8.20 of the Yakima
Municipal Code is on file in the Office of Code Administration.

REQUEST
Mr Arthur is requesting a Right -of -Way Use Permit construct a 4 ft. iron fence within the City of
Yakima's right -of -way that is 26 inches from face of building and approximately 12 ft. from face
of curb on W. Yakima Ave. The property is located within the Central Business District, (CBD)
zoning district. The four -foot tail fence is proposed to be constructed within the public right -of-
way for Yakima Ave. for the purpose of keeping bicycles and skateboarders 26" from the front
door and people peering in the windows.
Yakima Avenue has 50 feet of right -of -way from the center line to Mr Arthur's property line, and
approximately 16 feet from building to the back of curb
FINDINGS
DEVELOPMENT SERVICES TEAM (DST) REVIEW. A DST meeting was held on October 3,
2012, for technical review of this request. Below are the comments received:
Water and Irrigation Division: No Comment
Planning Division: Yakima Urban Area Zoning Ordinance standards are as follows:
Ch. 15.05 020 (G) (2): In the side yard: fences and walls may be placed on or behind the
property line In the commercial districts eight feet is the maximum fence or wall height behind
the required setback.
As the proposed fence is located within the side -yard and is not located within the clear view
triangle for a driveway or un- signalized intersection the City of Yakima Planning Division has no
objection to the approval of this right -of -way use permit.
Utilities: The City of Yakima Utility Billing Department has no object to the location of the fence.

Streets and Traffic Operations: Provided the applicant installs reflective material on the eastern
corner post of the eastern fence installation and on the western corner post of the western
fence installation, this application could be approved. The reflective material needed to improve
pedestrian awareness of the black fences extending into the sidewalk area at night needs to be
at least 18 square inches in size and placed just below the top rail of the fences.
CONCLUSIONS
1. The fence is not consistent with the above provisions of the Yakima Urban Area Zoning
Ordinance in regard to its location in the public right -of -way. However, provided a right -of -way
use permit is granted it will meet all other standards
2. Per YMC § 8.20 010 the fence is prohibited in the public right -of -way unless a right -of -way
use permit is granted to allow is construction and /or location.
3. In accordance with the requirements of the City Traffic Engineer, if approved the applicant
shall install reflective material on the eastern corner post of the eastern fence installation and
on the western corner post of the western fence installation which is 18 square inches in size
and placed just below the top rail of the fences.
RECOMMENDATION
According to the findings listed above, the City of Yakima Planning Division has no objection to
the granting of a right -of -way use permit subject to the below condition:

on the western corner post of the western fence installation which is 18 square inches in
size and placed just below the top rail of the fences.

Insurance
Prior to the issuance of any permit pursuant to this chapter, the applicant shall file with the
community and economic development director or his /her designee evidence of comprehensive
public liability insurance, with limits of not less than five hundred thousand dollars combined
single limit for bodily injury and property damage for residential uses and one million dollars
combined single limit for bodily injury and property damage for business uses, with the city of
Yakima named as an insured party, insuring against liability from injury or damage resulting
from applicant's occupancy of or activities on public right -of -way under the permit to be issued,
which insurance shall be maintained in effect during the term of the permit. (Ord. 2009 -15 § 7,
2009: Ord. 1672, § 1 (part), 1974).
