CITY OF YAKIMA, WASHINGTON
MAY 24, 1994
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall,Yakima, Washington.
Assistant Mayor Clarence Barnett, presiding, Council Members
Ernie Berger, Bill Brado, Lynn Buchanan, and Bernard Sims
present on roll call. Mayor Pat Berndt and Council Member
Henry Beauchamp absent and excused. City Manager Zais, City
Attorney Paolella, and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Sims.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS (IF APPLICABLE -)
A proclamation declaring June 5 -11, 1994 as Yakima Valley
Community College Alumni Association Week was presented to
Mel Lewis, Fred Valikanje and Don Hughes.
A proclamation declaring May 31 - June 9, 1994 as All
America City Week was presented to Curtis King.
A proclamation declaring May 22 -30, 1994 as Poppy Days was
presented to Madeleine Cooper, American Legion Auxiliary.
A proclamation declaring June 6 -11, 1994 as Management Week
was presented to Russ Knight.
Council Member Sims commented that after a neighborhood
meeting was held, the Council Transit Committee concluded
that the property at 32nd Avenue'and Nob Hill Boulevard
should not be developed into a park- and -ride lot. It was
MOVED BY SIMS, SECONDED BY BERGER, TO NOT DEVELOP
THE PROPERTY AT 32ND AVENUE AND NOB HILL BOULEVARD
INTO A PARK - AND -RIDE LOT, AND PLACE THE PROPERTY
BACK ON THE MARKET FOR SALE TO THE PUBLIC FOR ITS
MOST RECENT APPRAISED VALUE. Council Member Brado
suggested the City look for other property for a park-and-

ride lot to accommodate City and County employees working in
the downtown area.- The question was called for a vote
on the motion. The motion carried by unanimous voice vote;
Beauchamp and Berndt absent.

B. CONSIDERATION OF APPOINTMENTS TO THE BICYCLE /PEDESTRIAN
ADVISORY COMMITTEE
It was MOVED BY SIMS, SECONDED BY BRADO, TO ACCEPT
THE RECOMMENDATION TO APPOINT GREG LURING, NEIL
1/ MC CLURE, JENNIFER B. RENNIE, MARK J. VAN KOMMER AND
CEC VOGT (YAKIMA GREENWAY FOUNDATION REPRESENTATIVE)
TO THE BICYCLE /PEDESTRIAN ADVISORY COMMITTEE. The
motion carried by unanimous voice vote; Beauchamp and Berndt
absent.
4. CONSENT AGENDA
Assistant Mayor Barnett referred to the items placed on the
Consent Agenda, questioning whether there were any additions
or deletions from either Council members or citizens
present. It was the general consensus of the Council to add
Item No. 7 to the Consent Agenda. The City Clerk then read
the Consent Agenda items, including resolutions and
ordinances by title. It was MOVED BY SIMS, SECONDED BY
BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE
ADOPTED. The motion carried by unanimous roll call vote;
Beauchamp and Berndt absent. (Subsequent paragraphs preceded
by an asterisk ( *) indicate items on the Consent Agenda
handled under one motion without further discussion.)
-5. APPROVAL OF THE MINUTES OF THE MAY 3, 1994 BUSINESS MEETING
The minutes of the May 3, 1994 Business meeting was
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. AUDIENCE PARTICIPATION
None.
*7. PRESENTATION OF CODE DIVISION QUARTERLY REPORT,
This item was placed on the Consent Agenda and the report
was accepted.
8. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION
I/ AND DEBRIS ABATEMENT PROGRAM
Leonard Hall, Code Administration Manager, was present to
respond to any questions. No citizen being present to
respond to the notice, and Resolution No. R -94 -60 having
been read by title, it was MOVED BY SIMS, SECONDED BY
BRADO, THAT THE RESOLUTION BE ADOPTED. The motion
carried by unanimous roll call vote; Buchanan temporarily
absent, Beauchamp and Berndt absent.

RESOLUTION NO. R 94 - 60, A RESOLUTION authorizing the
Code Administration Manager to clear certain weedy lots.
9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
COLLECTIVE BARGAINING AGREEMENT FOR IAFF FIREFIGHTERS
City Manager Zais explained the negotiation process which
concluded with this collective bargaining agreement. The
contract is for the years 1994 and 1995. There will be no

salary increase in 1994; in 1995 the increase will be based
on 90% of CPI. In July of 1995 an adjustment will be made
to bring the Firefighter's wage base into parity with the
Police Officers. The contract also agrees to an increase in
kelly days earned, from 8 2/3 days to 10 days per year. The
cost impact for 1995 is estimated at approximately $200,000.
Resolution No. R -94 -61 having been read by title, it was
MOVED BY SIMS, SECONDED BY BERGER, THAT THE
RESOLUTION BE ADOPTED. The motion carried by 4 -1 roll
call vote; Brado voting nay; Beauchamp and Berndt absent.
Council Member Brado explained that although he recognizes
the value of the firefighters, the people, through
Initiative 601, have stated they are tired of increased
government costs. Council Member Sims commented that the
City demonstrated it was cognizant of the citizens opinion
by not authorizing any adjustments for 1994.
RESOLUTION NO. R 94 - 61, A RESOLUTION authorizing and
directing the City Manager and City Clerk of Yakima to
execute a collective bargaining agreement for calendar years
1994 and 1995 with the International Association of
Firefighters (Fire LEOFF), AFL -CIO.
*10. APPROVAL OF RIGHT -OF -WAY USE PERMIT FOR INSTALLATION OF SIGN
REQUESTED BY BETHLEHEM LUTHERAN CHURCH
The Right -of -Way Use Permit for Bethlehem Lutheran Church to
install a parking lot identification sign in the City right -
of -way located at 411 South 8th Avenue was approved.
*11. SET DATE OF PUBLIC HEARING FOR JUNE 21, 1994 ON HIGHWAY 410,
NACHES UTILITY EASEMENT RELEASE REQUESTED BY SUZANNE LUNZMAN
June 21, 1994 was set as the date of public hearing to
consider the release of an utility easement along Highway
410, requested by Suzanne M. Lunzman.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
CONTRACT WITH WASHINGTON DCTED FOR REIMBURSEMENT FOR FIRE
MOBILIZATION EXPENSES IN BENTON COUNTY ON THE RED MOUNTAIN
FIRE
RESOLUTION NO. R 94 - 62, - RESOLUTION authorizing the
City Manager and City Clerk of the City of Yakima to execute
a contract between the Washington State Department of

Community, Trade and.Economic..Development and the City of
Yakima for reimbursement to thie'Fire Department for fire
mobilization expenses incurred on November 3, 1993 in Benton
County on the Red Mountain fire.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING DISPOSAL OF SEIZED
SURPLUS VEHICULAR PROPERTY
RESOLUTION NO. R 94 - 63, A RESOLUTION authorizing the
sale of surplus personal property owned by the City.
*14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
CONTRACT WITH YCCS FOR DEBT COLLECTION SERVICES
RESOLUTION NO. R 94 - 64, A RESOLUTION authorizing the
City Manager and City Clerk of the City of Yakima to execute
an Agreement between the City of Yakima and YCCS -- A
National _Collection System, Inc. for collection services.
*15. CONSIDERATION OF A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT WITH THE YWCA FOR DOMESTIC VIOLENCE VICTIMS'
ADVOCATE SERVICES
RESOLUTION NO. R - 9 - 65, A RESOLUTION authorizing the
City Manager and City Clerk of the City of Yakima to execute
an agreement between the City of Yakima and the YWCA to
provide a domestic violence advocate to serve victims of .
domestic violence at the misdemeanant level, funds for the
position to be provided by a grant previously applied for
and tentatively approve:= ...,, .,
*16. CONSIDERATION OF LEGISLATION REGULATING ADULT ENTERTAINMENT
A. CONSIDERATION OF ORDINANCE CLARIFYING THE DEFINITION OF
PUBLIC DANCEHALL TO EXCLUDE ADULT ENTERTAINMENT
ESTABLISHMENTS
ORDINANCE NO. 94 - 23, AN ORDINANCE relating to licenses
and business regulations; clarifying the definition of a
public dancehall t� exclude adult entertainment
establishments; and amending Section 5.28.030 of the City of
Yakima Municipal Code.
B. CONSIDERATION OF ORDINANCE DEFINING AND REGULATING ADULT
I/ ENTERTAINMENT ESTABLISHMENTS AND LICENSING REQUIREMENTS
ORDINANCE NO. 94 - 24, AN ORDINANCE relating to licenses
and business regulations; defining and regulating adult
entertainment establishments; requiring licenses for
operators, managers, and entertainers; prohibiting certain
"conduct within adult entertainment establishments;
establishing penalties for violations thereof; making the
Code Administration Manager responsible for administration
of this chapter; adding new Sections 5.30.005 and 5.30.095

and amending Sections 5.30.010, 5.30.020, 5.30.030,
5.30.040, 5.30.060, 5.30.070, 5.30.080, and 5.30.090 all of
the City of Yakima Municipal Code.
*17. CONSIDERATION OF LEGISLATION RELATING TO TRAFFIC CODE
AMENDMENTS
A. AN ORDINANCE ADOPTING THE WASHINGTON MODEL TRAFFIC
ORDINANCE AND AMENDING, REPEALING, AND ENACTING NEW SECTIONS
OF THE CITY OF YAKIMA MUNICIPAL CODE
I/
ORDINANCE NO. 94 -25, AN ORDINANCE relating to traffic;
adopting the Washington Model Traffic Ordinance as contained
in the Washington Administrative Code, Chapter 308 -330 WAC;
amending Sections 9.46.010 and 9.46.020; repealing Chapter
9.50, Sections 9.50.110, 9.50.120, 9.50.400, 9.50.410, and
9.50.415; and enacting as new sections Sections 9.46.030 and
9.46.040 all of the City of Yakima Municipal Code.
B. AN ORDINANCE INCREASING THE PENALTY FOR HIT AND RUN
ATTENDED VIOLATIONS AND AMENDING THE YAKIMA MUNICIPAL CODE
ORDINANCE NO. 94 - 26, AN ORDINANCE relating to traffic;
increasing the penalty for striking an attended vehicle
resulting only in property damage and failure to remain and
provide identifying information; and amending Section
9.45.010 of the City of Yakima Municipal Code.
18. OTHER BUSINESS
John Hanson, Director of Finance and Budget, reported that
last week Council was provided with information from the
Association of Washington Cities (AWC) regarding a proposal
by US West before the Transportation and Utilities
Commission to change a rate structure for terminal loops to
a private line designation. If that designation is
approved, he estimated it would cost the City an additional
$75,000 to $100,000 per year depending on the actual rate
adjustment. AWC and the City of Bellevue are asking other
cities to share the cost of technical assistance required to
challenge that classification change. They are asking
cities the size of Yakima to commit $500 to $1,000 towards
this effort. He asked if Council is interested in
participating by making a contribution. Council Member Sims
expressed concern about taking action on this request
without having a full report on the impact this change would
have on the City, particularly since the technology in this

area is constantly improving the equipment. Mr. Hanson
responded to Mr. Sims' concerns by stating this does not
affect the technology or obsolesce of equipment; it simply
changes the classification of the lines that go to city
facilities and back from terminal loop to private lines. It

CONTRIBUTE UP TO $1,000 TO ASSIST AWC AND THE CITY

OF BELLEVUE IN THEIR EFFORTS BEFORE THE
TRANSPORTATION AND`` UTILITIES' COMMISSION REGARDING US
WEST'S CHANGE OF CLASSIFICATION OF TERMINAL LOOP TO
PRIVATE LINES. The motion carried by 4 -1 voice vote; Sims
voting nay, Beauchamp and Berndt absent.
I/ Glenn Valenzuela referenced the report from Traffic
Engineering and the Planning Division regarding three
recommendations pertaining to improvements to the 18th
Street /Chalmers /Riverside Road corridor. He stated this
issue was brought up by Central Pre -Mix and Superior Asphalt
during the Wal -Mart hearing. He asked for Council direction
regarding these recommendations. Following discussion, it
was the general consensus of the Council to direct staff to
place this issue on the agenda for the next Council meeting.

19. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION FOR
PROPERTY DAMAGE AT 317 WEST YAKIMA AVENUE
It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO MOVE
INTO EXECUTIVE SESSION FOR APPROXIMATELY FIVE TO TEN
MINUTES FOR THE PURPOSE OF DISCUSSING PROSPECTIVE
LITIGATION, FOLLOWED BY IMMEDIATE ADJOURNMENT. The
motion carried by unanimous voice vote; Beauchamp and Berndt
absent.

20. ADJOURNMENT
