SUBMITTED BY: Bronson Faul, Assistant City Attorney CONTACT Bronson Faul - 575 -6030 PERSON /TELEPHONE: SUMMARY EXPLANATION: The Employees' Welfare and Benefit Program Board (Board) is responsible for annually assessing the number of Board Members which represent each Participating Employee Group. The Board has determined that representation is not equal nor up to date; and a need exists to obtain greater equality and update the program. Article III, Section 2 of the Employees' Welfare Benefit Program, shall be updated to consist of: 11 voting members consisting of five AFSCME representatives; two IAFF representatives; two City Management employee representatives; one City municipal corporation representative; and, one AFSCME Transit representative. In addition, there shall be three non - voting members to consist of: two YPPA representatives, and one City municipal corporation representative. Each represented Participating Employee Group shall appoint or elect, as specified, its representative to the Board. The City Manager will appoint each of the City municipal corporation representatives. Each voting member shall be entitled to one alternate to serve at the voting member's pleasure, however alternates voting shall occur only in the absense of the voting member whom the alternate serves. R -2012- A RESOLUTION amending Article III, Section 2 of the Employees' Welfare Benefit Program; adding a voting member for the AFSCME and management groups; moving AFSCME Transit from a non - voting to a voting member; removing YPPA to nonvoting members; and creating a provision for alternate members. WHEREAS, the Employees' Welfare and Benefit Program Board (Board) has the responsibility to annually assess the number of Board Members which represent each Participating Employee Group, and WHEREAS, the Board has determined that representation is not equal nor up to date; and WHEREAS, to obtain greater equality and update the program, the Board has passed by a supermajority this resolution to forward to City Council; and WHEREAS, the City Council finds that the equality in Board representation is important and beneficial to the benefit program; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Article III Section 2 of the Employees' Welfare Benefit Program is hereby amended to read as follows 2. Number of Board Members The Board may consist of both voting and non - voting members ( "Board Members "). Each Board Member must be a City employee. Upon Termination of employment, the Board Member shall be replaced (See Section 3 in this Article). Effective October 1, 2012, the Board shall consist of eleven (11) voting members' five (5) AFSCME representatives; two (2) IAFF representatives; two (2) City Management • employee representatives; one (1) city municipal corporation representative, and one (1) AFSCME Transit representative. Each represented Participating Employee Group, shall appoint (except the Management group) or elect its representative to the Board. The Management employee group shall elect its representatives to the Board. The City municipal corporation representative shall be appointed by the City Manager. In addition to the voting members of the Board, there shall be three (3) non - voting members: two (2) YPPA representatives, and one (1) City municipal corporation non- voting member appointed by the City Manager. Each voting member shall be entitled to one (1) alternate to serve at the voting member's pleasure. Alternates are encouraged to attend meetings of the Board but may only vote if the voting member for whom the alternate serves is absent. Each represented Participating Employee Group shall appoint or elect its alternate representative(s) to the Board. All provisions relating to Board members shall apply to alternates. The number of Board Members representing each Participating Employee Group and the City as a municipal corporation shall remain as set forth above in this Section 2 until the Board agrees to change the number of Board Members for each group. The Board shall meet annually to reassess whether the number of Board Members which represent each Participating Employee Group should be changed. If a new Employee Group is recognized by the City, the Board shall meet within 30 calendar days of recognition to determine the group's representation on the Board, if any, including the number of voting or non - voting Board Members that will represent the group and, if voting representations are allowed, whether the group will be allowed to elect or appoint its own Board Member(s) or will be represented by current Board Members.
