ROLL CALL. • The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Henry Beauchamp, Ernie Berger, Bill Brado, Lynn Buchanan, and Bernard Sims present on roll call. City Manager Zais, Assistant City Attorney Boyd, and City Clerk Roberts also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Berger. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) It was announced that the Crime Prevention program of the Year Award (non -law enforcement) by the Washington State Crime Prevention Association was awarded to the Yakima On Guard Radio Watch Program. The award was accepted by Mr. Mize, an On Guard Radio Watch volunteer. May 16 -20, 1994 was proclaimed TRY TYANSIT Week. The proclamation was accepted by Cecil Aston, Transit Operator of the Year. Marketa Oliver, Administrative Assistant to the City Manager, distributed a fact sheet and explained the Community Public Health and Safety Network program. She reported that she and Council Member Berger attended the last meeting concerning boundaries for these networks. She stated the next meeting is scheduled for May 31st, facilitated by the State Family Policy Committee, at East Valley High School, beginning at 7:00 p.m. It was MOVED BY SIMS, SECONDED BY BARNETT, TO APPOINT COUNCIL MEMBER , BERGER TO.. SERVE ON THE CITY'S VOLUNTEER FIREFIGHT PENSION BOARD. The motion carried by unanimous -vo ice vote;: • MAY 17, 1994 289 Mayor Berndt made three recommendations regarding the stand alone radar tower issue. Shesiiggested a letter be sent (by Friday) to Secretary of Transportation Pena reminding him of the reversal. of the Roswell, New Mexico order, and asking for his intervention. She suggested an ad hoc committee..be formed, chaired by Assistant City Manager Glenn Rice. The Committee.should include representatives from the Chamber of Commerce (executive director or .president), New Vision president, representative from the Airport Board, and any other interested citizen Council might select. Her last recommendation was to ask Glenn Valenzuela, Director of Community and Economic Development, to work with Glenn Rice and enlist the aid of County Commissioner Klarich and Council Member Beauchamp and Bruce Loy, Airport Manager, to participate in a conference call with Congressman Jay Inslee and other State. Senators, to update them on the status-of this issue and convey how critical the stand alone tower is to Yakima. It was the, general consensus of Council to accept the recommendations made by Mayor Berndt. County Commissioner Klarich submitted a Letter of Map Revision received from the Federal Emergency Management Agency to Council. He announced that effective May 16, 1994 the 100 year floodplain designation has been lifted for the area of Selah Gap to East Birchfield and from Terrace Heights Drive /Yakima Avenue to West Birchfield. Several development projects will be positively affected by this revision. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council to add Item No. 10 to the Consent Agenda. The. City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled one motion without further discussion.) • 5. PRESENTATION OF REPORT FROM YAKIMA COUNTY DEVELOPMENT ASSOCIATION • Bob Hall, President of YCDA (New Vision), provided an update as to the activities and current efforts to promote economic growth in Yakima County. He emphasized three areas that New Vision has focused on including expanding the local job base and aiming those jobs within Yakima County as well as recruiting jobs from those organizations that are relocating • 2 2 90 MAY 17, 1994 to this area. He also explained the important economic development role that the Foreign Trade Zone will have and mentioned the potential international investment possibilities at the airport, both which will contribute toward economic growth in the Yakima area Joe Gero, Executive Director of YCDA (New Vision), gave a technical briefing about their programs and what they intend I/ to do in the future. He presented information concerning recruitment of new industry and retention and expansion of existing industry. He explained some businesses have passed over the Yakima area and have taken their jobs to other communities. He emphasized the for available buildings with current industrial zoning in order to meet the needs of clients on a limited timetable that can't wait the time it takes to request a rezone of property. Other key criteria that prospective employers consider when evaluating communities include a low crime rate, the need for a well - educated and productive workforce, the need for a receptive and positive local government and community business climate, which is presently available, the availability of adequate, affordable housing, as well as enough doctors and access to transportation. Mr. Gero also emphasized the critical nature of the Airport Master Plan and the Foreign Trade Zone, as well as utility requirements and standby fire flow. Mr. Gero also indicated their support in the City's efforts in several areas including the effort to gain federal enterprise community designation and keeping the radar tower in Yakima. Variances of youth work rules, the school bond issue, Grandview's request to house a new prison facility, and the issue of tax incentive limitations by the state constitution were among other areas of concern described by Mr. Gero and targeted by New Vision. Council Member Barnett questioned the appropriateness of New Vision supporting the school bond issue. It appears there could be some restrictions. This issue should be looked at from a legal point of view. Mr. Gero also clarified the issue of rezoning. He explained the client will need to find property already properly zoned as opposed to the property owner seeking a rezone after being approached by a client in order to meet tight timeframes. Another question Council Member Barnett had is the intent of YCDA to initiate action to change the State Constitution on lending of credit. He - indicated this could become a very controversial debate of a I/ heated issue. There was continued discussion among Council members and staff concerning this issue and the need for industrial site development. There was also discussion concerning the need for the City, the County, and the YCDA to seek an extension of the December 31, 1994 deadline in order for the state to finish its part of the Washington Administrative Code as it relates to the implementation of the economic development element of the Comprehensive Plan. 3 MAY 17, 1994 . 291 6. AUDIENCE PARTICIPATION Mike Allen, Manager of Englewood Garden Apartments, requested Council's assistance in obtaining funding to develop a pedestrian walkway on the City's covered irrigation canal • along Powerhouse Road. Mayor Berndt directed staff to send copies of the petition to the state agency and let them know that the community does indeed want this project. *7. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF PROMOTION AGREEMENT FOR USE OF VALLEY MALL PARKING LOT AS TEMPORARY SHUTTLE BUS OPERATIONS FOR COMMUNITY EVENTS RESOLUTION NO. R 94 - 58, A RESOLUTION authorizing the Director of Public Works and City Clerk of the City of Yakima to execute a promotion agreement with First Union Management, Inc. (or subsequent owners of the Valley Mall property) to use the Valley Mall parking lot for temporary shuttle bus operations for community events. *8. CONSIDERATION OF RESOLUTION AUTHORIZING CLOSURE OF PORTIONS OF 16TH AVENUE AND SPRING CREEK ROAD DURING THE YAKIMA AIR FAIR • RESOLUTION NO. R 94 - 59, A RESOLUTION authorizing closure of portions of 16th Avenue and Spring Creek Road for the Yakima Air Fair. *9.. APPROVAL OF APRIL 1994 REVENUE AND EXPENDITURE REPORT The April 1994 Revenue and Expenditure (Budget) Report was approved. *10. CONSIDERATION OF ORDINANCE AMENDING THE CODE PENALTY SECTIONS OF THE YAKIMA MUNICIPAL CODE ORDINANCE NO. 94 - 22, AN ORDINANCE relating to public safety and morals; amending Title 6 Public Safety and Morals to conform with state laws; amending Sections 6.02.050, 6.04.020, 6.04.027, 6.04.070, 6.04.110, 6.04.115, 6.04.140, 6.04.170, 6.04.185, 6.04.230, 6.04.235, 6.04.245, 6.04.307, 6.04.315, 6.04.387, 6.04.450, 6.04.480, 6.20.180, 6.48.010, 6.86.110; adding Sections 6.02.060, 6.04.021, 6.20.010, 6.20.120, 6.36.030, 6.60.040,6.68.02 and 6.76.030, and adding Subsection (c) to Section 6.04.040, Subsection H to Section 6.04.180, Subsection D to Section 6.04.370, Subsection D to Section 6.04.540, and Subsection D to Section 6.08.020; and repealing Sections 6.04.425 and 6.04.575, and repealing Chapter 6.14, Sections 6.14.010 and 6.14.020, all of the City of Yakima Municipal Code. 4 292 MAY 17, 1994 11. OTHER BUSINESS After Assistant. City Manager Rice indicated some members of staff along with selected members of the Council are going to deliver the Enterprise Application„ it was MOVED BY SIMS, SECONDED BY BUCHANAN, TO AUTHORIZE COUNCIL MEMBER I/ BARNETT TO TRAVEL TO WASHINGTON, D.C. TO DELIVER THE ENTERPRISE ZONE APPLICATION. The motion carried by unanimous voice vote.
