ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Mayor Pat Berndt, presiding; Council Members Clarence Barnett, Henry Beauchamp, Ernie Berger, Bill Brado, and Lynn Buchanan present on roll call. Council Member Bernard Sims present after 2:30 p.m. City Manager Zais, City Attorney Paolella, and City Clerk Roberts also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Buchanan. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) None. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus to remove Agenda Item No. 8 from the Consent Agenda. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, THAT THE CONSENT AGENDA, AS AMENDED, BE ADOPTED. The motion carried by unanimous roll call vote; Sims absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF THE MINUTES OF THE APRIL 5, 12, AND 19, 1994 BUSINESS MEETINGS The minutes of the April 5, 12, and 19, 1994 Business meetings, were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION I/ Curtis King, Chamber of Commerce, announced on behalf of the All American City Committee that Yakima has been chosen as one of the 30 finalists in the All American City contest. They will prepare a 10- minute presentation for the 2 5 9 APRIL :„46 1994 competition in Oakland., California in six weeks. Mr. King thanked the City for all its suppo in this endeavor. A. FIDDLER PERFORMANCE Mayor Berndt read a proclamation declaring the month of May 1994 as Old Time Fiddlers Association Month. This was followed by a performance by the Old Time Fiddlers. B. PRESENTATION FROM AIR FAIR BOARD Mayor Berndt read a proclamation for the 12th Annual Yakima Air Fair declaring the week of May 16 -23, 1994 as Yakima Air Fair Week. Larry West accepted the proclamation, and, in turn, presented Council with Air Fair posters. C. PRESENTATION FROM NORTHWEST CABLE Gary Chrey, Attorney representing Northwest Cable, submitted a petition with over 1600 signatures requesting Council rescind Ordinance No. 94 -13 relating to a 5 percent tax on cable TV. He requested Council either rescind the ordinance, re -vote on the ordinance, or place it on the ballot. No formal action was taken by the Council. Bev Luby Bartz, 114 North 7th Street, requested Council make several maps available to the public at the neighborhood meetings being conducted on the future vision of neighborhoods. Mayor Berndt directed staff to follow up on this request. After thanking Council for their support of the North Central Coalition in getting the canal covered and starting improvements to Swan Park, Alberta Culp,. 911 North 10th Avenue, expressed concern that she and her neighbors have about multi family residences being built in their area. These developments do not have adequate provisions for play areas for children, sidewalks, parking facilities, or decent landscaping. She asked Council to look at the short and long term impacts of these developments on the neighborhood. The request was referred to staff. 7. CONSIDERATION OF DECISION RELATING TO THE GREENWAY SEPA APPEAL I/ It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE FORMAL GREENWAY SEPA APPEAL DECISION. The motion carried by unanimous voice vote;' Berndt and Brado abstaining due to an appearance of fairness issue. 2 266 APRIL 26, 1994 8. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT TO MEMORANDUM OF INTENT AND LEASE WITH THE WASHINGTON MILITARY DEPARTMENT FOR THE ARMORY PROPERTY Assistant City Manager Rice introduced Senator Alex Deccio, who was very instrumental in putting together the acquisition of lease and memorandum of agreement for the Armory property for the new Police Station /Legal Center. Senator Deccio spoke of the demolition appropriation for the Armory. Even though the appropriation was not included in the 1993 Supplemental Capital Budget, there was a meeting held with officials, and a very strong commitment was made by the National Guard to include this in the 1995 Capital Budget. He will follow this issue and check on its progress a couple of months before the session begins. Mayor Berndt thanked Senator Deccio for his assistance. Resolution No. R -94 -49 having been read by title, it was MOVED BY SIMS, SECONDED BY BUCHANAN, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R 94 - 49, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Addendum to Memorandum of Intent with the Washington State Military Department and a Lease for property at 202 South 3rd Street in Yakima, Washington. *9. CONSIDERATION OF RESOLUTION AUTHORIZING SUBMITTAL OF APPLICATION WITH WASHINGTON STATE DEPARTMENT OF COMMUNITY DEVELOPMENT FOR FUNDING FOR A RENTAL REHABILITATION PROGRAM RESOLUTION NO. R 94 - 50, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to file an Application with the Washington State Department of Community Development for funding for a rental rehabilitation program. *10. REPORTS AND LEGISLATION FROM FINANCE DEPARTMENT: A. APPROVAL OF FIRST QUARTER 1994 FINANCIAL REPORT The First Quarter 1994 Financial Report was accepted and approved. B. APPROVAL OF 1993 FOURTH QUARTER ACCOUNTS RECEIVABLE REPORT The 1993 Fourth Quarter Accounts Receivable Report was accepted and approved. 3 261 APRIL . .26, 1994 C. CONSIDERATION OF RESOLUTION - AUTHORIZING WRITE -OFF OF CERTAIN UNCOLLECTABLE ACCOUNTS RESOLUTION NO. R 94 - 51, A RESOLUTION authorizing the write -off of certain uncollectible accounts due to various • I/ funds of the City. *11. SECOND READING OF ORDINANCE AMENDING THE 1994 BUDGET AND APPROPRIATING FUNDS FOR ADDITIONAL ARCHITECTURAL SERVICES An Ordinance amending the 1994 budget and appropriating funds for additional architectural services for the Police Station /Legal Center, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 94 - 17, AN ORDINANCE amending the 1994 budget for the City of Yakima; and making an appropriation of $55,675 in the Law & Justice Capital Fund for expenditure during 1994 for additional architectural /engineering costs. 12. OTHER BUSINESS Mayor Berndt announced that she, along with Glenn Rice and Glenn Valenzuela, will travel to Seattle for a Washington State Agriculture briefing at the Greater Seattle Trade Alliance reception. This will promote the Agricultural Showcase throughout the state in an attempt to get a broader base of exhibitors at this year's event. Council Member Buchanan updated Council on the status of the attempt to keep radar at the airport. It was the consensus to send a letter to DOT and to request the County Commissioners to either sign that letter or send their own letter in support of this issue. The Honorable Tom Foley, Speaker of the House of Representatives, U. S. Congress, will also be contacted in request of a letter of support. Council Member Beauchamp requested staff investigate a clear view problem at Ranch Rite Road and South 1st Street. He also described a poor street patch job on Hathaway by Elks Parks. I/ Council Member Sims referred to the endeavor of Council to start a Bikepath Committee with citizens throughout Yakima. He has heard quite a bit of interest from the Scenic Drive area group. They have started a petition to turn that into a bikepath. He asked what the status of this committee is and whether appointments will be made in the near future. Mayor Berndt indicated that applications are now available. City Clerk Roberts stated that there are less than five that have been received. Mayor Berndt suggested that this be continued to be advertised. A Council Committee probably is needed to review this or else it can be done with the same committee 4 262 APRIL 26, 1994 that does Parks. There was inquiry about whether the bikepath petition had been submitted. Mayor Berndt referred to the Street Committee and suggested staff schedule a meeting to form that committee. It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO DIRECT STAFF TO SCHEDULE A MEETING WITH THE COUNCIL COMMITTEE FOR THE PURPOSE OF ESTABLISHING THE STREET FUND COMMITTEE. The motion carried by unanimous voice vote. Copies of the 1994 Budget were distributed to Council members. Council Member Barnett requested his budget be placed in a three -ring binder like Council Member Buchanan's. John Hanson, Director of Finance & Budget, explained the format of this year's budget is a little different than what it has been in prior years. This format was used in order to meet new criteria, established by the Government Finance Officers Association, and to include additional statistical information as well as the inclusion of an- easy -to- follow Reader's Guide.
