For Meeting of: January 19, 2021 ITEM TITLE: Ordinance rescinding Ordinance No. 2021-001 SUBMITTED BY: Glenn Denman, Codes Administration Manager Sara Watkins, Senior Assistant City Attorney SUMMARY EXPLANATION: At the Council's January 5, 2021 City Council meeting, the Council approved Ordinance No. 2021-001 which adopted the state-mandated Washington State Buildings Codes, 2018 edition (building code, plumbing code, mechanical code, etc.). Subsequent to the Council's adoption of the Ordinance, the Washington State Building Code Council met and unexpectedly voted to delay the adoption of the 2018 Washington State Codes until July 1 , 2021. The new codes were supposed to go into effect February 1 , 2021. As a result of the unexpected delay in adoption of the new codes, the City cannot adopt the 2018 edition of the Washington State Codes because they have not formally been adopted by the State. When the State formally adopts the 2018 editions of the codes staff will return to City Council with this ordinance. WHEREAS, the International Code Council publishes the International Codes and accompanying standards for adoption by state and local jurisdictions to regulate the safe construction of buildings and building systems; and WHEREAS, the Washington Legislature has delegated the responsibility of amending and adopting the International Codes by reference (referred to herein as the Washington State codes) to the State Building Code Council; and WHEREAS, the State Building Code Council has adopted review procedures and approval criteria for local amendments, exempting from its review the administrative provisions of the codes; and WHEREAS, any jurisdiction may amend the Washington State codes provided that the amendments do not reduce the minimum performance standards of the codes; and WHEREAS, the State Building Code Act requires that each local jurisdiction enforce the Washington State codes within its jurisdiction; and WHEREAS, the Washington State Building Code Council is the entity that formally adopts updates to the Washington State codes, the 2018 codes were set to take effect on February 1, 2021, and the Building Code Council determined on or about January 8, 2021, to delay the adoption of the 2018 codes; and WHEREAS, the City, on January 5, 2021, relying on the effective date previously provided by the Building Code Council of February 1, 2021, for the building codes, adopted Ordinance 2021-001 which adopted and amended as appropriate the building codes of the City of Yakima; and WHEREAS, since the Building Code Council delayed the approval of the 2018 editions of the building codes, the City must rescind its ordinance that adopted those code provisions, and revert back to using the previously-adopted code provisions until the Building Code Council approves updated building codes; and WHEREAS, the City Council of the City of Yakima finds that it is in the best interest of the City and its residents to rescind Ordinance 2021-001; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Ordinance No. 2021-001 is hereby rescinded.
