ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Henry Beauchamp, Ernie Berger, Bill Brado, Lynn Buchanan, and Bernard Sims present on roll call. City Manager Zais, City Attorney Paolella, and City Clerk Roberts - also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by City Attorney Paolella. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) Paul McMurray was introduced as the new Assistant City Attorney. Glenn Valenzuela, Director of Community & Economic Development, gave a brief report on his recent trip to Washington, D.C. He described Enterprise Community opportunities that could be possible. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF THE MINUTES OF THE OCTOBER 22, 1993 SPECIAL MEETING, NOVEMBER 16, 1993 BUSINESS MEETING AND JANUARY 25, 1994 ADJOURNED AND BUSINESS MEETINGS The minutes of the October 22, 1993 Special Meeting and November 16, 1993 Business meeting, and January 25, 1994 Adjourned and Business meetings, were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 128 FEBRUARY 1, 1994 6. AUDIENCE PARTICIPATION Gary`Bailey, Manager of TCI in Yakima, presented the City with as check for ehe first installment of the capital grant for public and government access per the franchise agreement. David Hawkins spoke about the crime rate and the need for God in the schools. He will also address the School Board and request his program be made available in the schools. 7. RECONSIDERATION OF RESOLUTION ADOPTING A COMMUTE TRIP REDUCTION PROGRAM FOR THE CITY OF YAKIMA (CONTINUED FROM 1/25/94 - PLEASE BRING PREVIOUS MATERIAL -- NEEDS FULL COUNCIL FOR ACTION) John Elsden, Senior Project Planner, briefly recapped the requirements for the City's Commute Trip Reduction Program and outlined Alternatives A, B, and C proposed in the report. Council Member Beauchamp inquired about the concept of commuters using bicycles from the City's Unclaimed Stolen Property. Mr. Elsden provided explanation about plan implementation as well as what level of accomplishment is expected. Mayor Berndt asked what other major employers are including in their CTR Programs, and Mr. Elsden explained carpooling and preferred parking for carpoolers, options that are less costly to implement. In order to find out the program's results, surveys will be conducted to determine if goals have been met. After further discussion and comments among Council members, it was MOVED BY BERGER, SECONDED BY BARNETT, TO ADOPT ALTERNATIVE C. Council Member Barnett suggested starting with Alternative C, and if necessary, adding more incentives later which might encourage participation. Don Skone, Planning Manager, emphasized the importance of reducing transportation problems and using alternative forms of transportation, including the bus system. Mr. Elsden compared CTR program elements other cities' and counties' have implemented to elements proposed in Alternatives A, B, and C. The question was called for a vote on the motion. The motion carried by a 4 -3 vote; Beauchamp, Berndt, and Sims voting nay. After Resolution No. R -94 -8 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R - 94 - 8, A RESOLUTION adopting a Commute I/ Trip Reduction Program for the City of Yakima. 8. CONSIDERATION OF RESOLUTION AUTHORIZING THE SALE OF BONDS FOR THE POLICE STATION /LEGAL CENTER AND I -82 PROJECTS TO SEATTLE NORTHWEST SECURITIES John Hanson, Director of Finance and Budget, referred to the $6.8 million sale of General Obligation Bonds for the Police Station /Legal Center and Yakima Avenue /I -82 Interchange 2 t1 ° { 12 9 FEBRUA 1, 1994 projects. Mr. HansonintrodU,ced : Rose, Vice President of Seattle - Northwest Securities Corporation, who made the offer to purchase. Mr. Rose explained some of the dynamics in the Municipal Bond Market and what it means to the City of Yakima. Council Members Barnett, Berger and Brado spoke about concerns they have with the two projects. After further discussion and comments concerning this issue and Resolution No. R -94 -9 having been read by title, it was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by a 6 -1 roll call vote; Brado voting nay. RESOLUTION NO. R - 94 - 9; A RESOLUTION authorizing the execution and delivery of a contract for purchase of the City's Limited Tax General Obligation Bonds, Series 1994, in the aggregate principal amount of $6,800,000; approving the form of the official statement therefor and the distribution thereof; and ratifying certain acts and proceedings. *9. CONSIDERATION OF RESOLUTION CALLING FOR PROPOSALS FOR LEGAL ADVERTISING SERVICES RESOLUTION NO. R - 94 - 10 A RESOLUTION prescribing a form of contract for printing and publishing city legal advertising; and directing publication of a call for proposals therefor. 10. CONSIDERATION OF LEGISLATION EXCLUDING POSITIONS FROM CIVIL SERVICE: City Manager Zais explained in detail why the positions of the Police Chief and Fire Chief should be excluded from Civil Service in the City of Yakima. This proposal would not affect the present Police Chief, but would affect the Fire Chief position that is currently vacant. A. CONSIDERATION OF ORDINANCE EXEMPTING THE FIRE CHIEF FROM CIVIL SERVICE Ordinance No. 94 -3 having been read by title, it was MOVED BY BEAUCHAMP, SECONDED BY SIMS, TO ADOPT THE ORDINANCE. The motion carried by a unanimous roll call vote. ORDINANCE NO. 94 - 3, AN ORDINANCE relating to City administration; removing any fire chief appointed after March 15, 1994 from the Civil Service; making the fire chief directly responsible to the city manager; and amending Section 1.46.010 and adding Section 1.46.040, all of the City of Yakima Municipal Code. 3 13 0 FEBRUARY 1, 1994 B. CONSIDERATION OF ORDINANCE EXEMPTING THE POLICE CHIEF FROM CIVIL SERVICE Ordinance No. 94 -4 having been read by title, it was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO ADOPT THE ORDINANCE. The motion carried by a unanimous roll call vote. ORDINANCE NO. 94 - 4, AN ORDINANCE relating to City administration; removing any police chief appointed after March 15, 1994 from the Civil Service; making the police chief directly responsible to the City Manager; and amending Section 1.54.010 and adding Section 1.54.040, all of the City of Yakima Municipal Code. C. CONSIDERATION OF ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR THE FIRE CHIEF Ordinance No. 94 -5 having been read by title, it was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO ADOPT THE ORDINANCE. The motion carried by unanimous voice vote. ORDINANCE NO. 94 - 5, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective March 15, 1994; amending Subsections 2.20.100 A, 2.20.110 B, 2.20.100 C, 2.20.110 A, 2.20.110 B and 2.20.110 E, all of the City of Yakima Municipal Code. *11. CONSIDERATION OF ORDINANCE AMENDING THE TERMS OF PATROLMAN AND POLICE WOMAN TO POLICE OFFICER ORDINANCE NO. 94 - 6, AN ORDINANCE relating to city administration; removing the terms patrolman and police woman from the designation of police officer positions and replacing them with the term police officer; and amending Section 1.48.020 of the City of Yakima Municipal Code. 12. REPORT FROM ENGINEERING DIVISION REGARDING PROPOSED AMENDMENTS TO THE SAFE DRINKING WATER ACT Ty Wick, Water and Irrigation Superintendent, asked Council to support legislation by urging Representative Jay Inslee to co- sponsor HR 3392, which would amend the Safe Drinking Water Act. The main objection is the requirement to perform tests for contaminants in the water where none exist. Lee Arnett, President of the Yakima Valley Rental Association, gave examples and described the severe impact on the rental industry caused by current regulations; he asked Council to support whatever can be done to change it. Mayor Berndt and Council Member Beauchamp encouraged Mr. Arnett to join the letter writing effort and to make a few phone calls. After continued discussion concerning how to effect change in current regulations, particularly in Washington, D.C., it was 4 131 FEBRUARY 1, 1994 MOVED BY BEAUCHAMP,1 SECONDED BY SIMS, TO ACCEPT THE REPORT AND AUTHORIZE THE SENDING OF THE LETTER. The motion carried by unanimous voice vote. Council members thanked Mr. Wick for his years of service and wished him well in his new position in Spokane. 13. REPORT ON FROM PUBLIC WORKS DEPARTMENT REGARDING STREET COMMITTEE COMPOSITION /TASKS AND WORK PROGRAM David Hussell, Streets & Traffic Operations Manager, expressed a need for the Street Fund Review Committee to comprehensively consider, among various alternatives, whether to cut expenses, enhance revenue, or implement other options. There was discussion among Council members concerning the makeup of the committee and the level of commitment that is required. Council also emphasized they don't want this committee formed solely to campaign for street utility tax. City Manager Zais further explained that the committee would look at funding and expenditure reductions including other options in order to be fair and objective. It was the general consensus among Council members to establish the Committee to include a representative from the Chamber of Commerce (not the Visitors and Convention Center). Council representatives will be Mayor Berndt and Council Member Brado; Council Member Barnett will serve as an alternate. 14. OTHER BUSINESS There was discussion the AWC Legislative Session; Marketa Oliver, Administrative Assistant to the City Manager, asked for Council direction as to whether there were any changes in the Legislative Priorities Listing previously distributed. EXECUTIVE SESSION REGARDING: It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF 1/ DISCUSSING COLLECTIVE BARGAINING AND PROPERTY DISPOSITION, WITH ADJOURNMENT TO FEBRUARY 8, 1994, AT 7:00 AM FOR INFORMAL DISCUSSION AMONG COUNCIL MEMBERS AT THE YAKIMA CENTER.
