CITY OF YAKIMA, WASHINGTON
JANUARY 25, 1994
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Clarence
Barnett, Ernie Berger, Bill Brado, Lynn Buchanan, and
Bernard Sims present on roll call. Council Member Henry
Beauchamp absent and excused. City Manager Zais, City
Attorney Paolella, and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Barnett.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Police Chief Green accepted a $1,677.81 donation from the
Southland Corporation (7- Eleven) employees for the Yakima
D.A.R.E. Program.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
It was the general consensus of the Council to add Items
Nos. 7 and 9 to the Consent Agenda. The City Clerk then
read the Consent Agenda items, including resolutions and
ordinances by title. It was MOVED BY SIMS, SECONDED BY
BUCHANAN, THAT THE CONSENT AGENDA, AS ,READ, BE
ADOPTED. The motion carried by unanimous roll call vote;
Beauchamp absent. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled
under one motion without further discussion.)
*5. APPROVAL OF THE MINUTES OF THE NOVEMBER 9 AND 16, AND
DECEMBER 7 AND 14, 1993 ADJOURNED MEETINGS AND JANUARY 18,
1994 BUSINESS MEETING
The minutes of the November 9 and 16, and December 7 and 14,
1993 Adjourned Meetings and January 18, 1994 Business

meeting, were approved, having been duly certified accurate
by two Council members and no one present wishing to have
said minutes read publicly.

6. AUDIENCE PARTICIPATION
David Hawkins, 114 North 9th Street, presented Council with
information concerning his Kids Unlimited Program, which
would solve the youth violence problem.
*7. NOTICE OF INTENTION TO COMMENCE STEPHENSON TRACT ANNEXATION
(STANDARD MOTIONS A & B)
January 25, 1994 was set as the time of a meeting with the
initiating parties who have signed a notice of intent to
commence annexation proceedings, the initiating parties being
Congdon Orchards, Inc.
The annexation proposed by the above parties was accepted by
the City of Yakima, and that area to be annexed was required
to assume its share of the City's existing indebtedness, and
staff was directed to file a notice of intent to annex with
the Yakima County Boundary Review Board.
8. CONSIDERATION OF LEGISLATION RELATING TO CITY'S COMMUTE TRIP
REDUCTION PROGRAM:
A. RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
CONFERENCE OF GOVERNMENTS FOR TECHNICAL PLANNING ASSISTANCE
ON COMMUTE TRIP REDUCTION PLANNING
John Elsden, Senior Project Planner, referred to the report
that includes the Council budget policy decision to execute
an agreement with the Conference of. Governments (COG) to
provide technical assistance for Commute Trip Reduction
planning. COG would oversee the other major employers in the
City who are required to prepare and adopt a commute trip
reduction program. There was discussion about this state
mandated program. Resolution No. R -94 -4 having been read by
title, it was MOVED BY SIMS, SECONDED BARNETT, TO PASS
THE RESOLUTION. The motion carried by a 4 -2 roll call
vote; Berndt and Buchanan voting nay; Beauchamp absent.
Council Member Barnett only supports this issue because it is
a state mandated program. Mayor Berndt disagrees with cost
of the contract for the level of services to be provided.
RESOLUTION NO. R - 94 - 4, A RESOLUTION authorizing and
directing the City Manager and the City Clerk of the City of
Yakima to execute a Professional Services Agreement with
Yakima Valley Conference of Governments for commute trip
reduction planning.

B. RESOLUTION ADOPTING A COMMUTE TRIP REDUCTION PROGRAM FOR
THE CITY OF YAKIMA
Mr. Elsden explained the provisions contained in the proposed
Commute Trip Reduction Program for the City employees. He
referred to the three alternatives and the incentives
contained in them.
After discussion among Council members concerning the
incentives, Archie Sutton, Personnel Officer, explained many
employees ride the bus currently, particularly since there is
a lack of parking. The transit pass incentive, as well as
utilizing carpooling, would help alleviate the current
problem and plan for the future. It was MOVED BY BARNETT,
SECONDED BY BERGER, TO ADOPT ALTERNATIVE C. The
motion failed by a 3 -3 roll call vote; Berndt, Brado, and
Buchanan voting nay; Beauchamp absent. The proposed
resolution adopting a Commute Trip Reduction Program for the
City of Yakima including Alternative B, having been read by
title, it was MOVED BY SIMS, SECONDED BY BUCHANAN, TO
ADOPT THE RESOLUTION. The motion failed by a 3 -3 roll
call vote; Brado, Barnett, and Berger voting nay; Beauchamp
absent. It was the general consensus of Council to direct
Staff to bring this item back when a full Council is in
attendance.
*9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH YAKIMA HOUSING AUTHORITY FOR PARTNERSHIP FOR -
INNOVATIVE HOUSING PROGRAM
RESOLUTION NO. R - 94 - 5, A RESOLUTION authorizing and
directing the City Manager of the City of Yakima to execute a
Contingent Loan Agreement with the Yakima Housing Authority
for implementation of the Partnership for Innovative Housing
Program.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH THE OFFICE OF AGING AND LONG TERM CARE FOR AN
ADULT DAY CARE PROGRAM FOR SENIOR CITIZENS
RESOLUTION NO. R - 94 - 6, A RESOLUTION authorizing the
execution of the 1994 Adult Day Care Agreement with Yakima
County.
*11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH HUD FOR THE HOPE 3 PROGRAM

RESOLUTION NO. R - 94 - 7, A RESOLUTION authorizing and
directing the City Manager and the City Clerk of Yakima to
execute an agreement with the Department of Housing and urban
Development for funding for a Hope III Program.

*12. SET DATE OF PUBLIC" HEARING FOR'.FEBRUARY 8, 1994 TO CONSIDER
APPEAL OF SEPA DETERMINATION ON THE GREENWAY PATHWAY WEST
SHORELINE APPLICATION
February 8, 1994 was set as the date of public hearing to
consider the appeal of the SEPA determination on the'Greenway
Pathway West Shoreline. Application.
*13. APPROVAL OF 1993 YEAR -END ANNUAL EMPLOYEE ASSISTANCE PROGRAM
REPORT
The City of Yakima Employee Assistance Program Year -End
Report for 1993 was approved.
*14. APPROVAL OF THIRD QUARTER 1993 TREASURY REPORT
The Third Quarter 1993 Treasury Report was approved.
15. OTHER BUSINESS
Staff was directed to advise the Conference of Governments
regarding the conflict existing with the scheduled PTBA
meeting on February 2nd and the Legislative Session in
Olympia where most City officials in the Valley will attend.

PROSPECTIVE LITIGATION, WITH IMMEDIATE ADJOURNMENT

17. ADJOURNMENT
