JANUARY 4, 1994
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Clarence
Barnett, Henry Beauchamp, Ernie Berger, Bill Brado, Lynn
Buchanan, and Bernard Sims present on roll call. City
Manager Zais, City Attorney Paolella, and City Clerk Roberts
also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Barnett.
3. ADMINISTRATION OF OATH OF OFFICE TO NEWLY ELECTED COUNCIL
MEMBERS BEAUCHAMP, BERGER AND SIMS
Henry Beauchamp, Ernest (Ernie) Berger, and Bernard Sims
having been elected to the office of Council member on
November 2, 1993, and the Oath of Office having been
administered to them at this time by City Clerk Roberts, are
now duly seated as Council members for the City of Yakima.
4. ELECTION OF MAYOR
It was MOVED BY BARNETT, SECONDED BY BRADO, TO
NOMINATE PAT BERNDT AS MAYOR. The motion carried by
unanimous voice vote.
5. ELECTION OF ASSISTANT MAYOR
It was MOVED BY BRADO, SECONDED BY BERGER, TO NOMINATE
CLARENCE BARNETT AS ASSISTANT MAYOR. The motion
carried by unanimous voice vote.
6. APPOINTMENT OF COUNCIL MEMBERS TO BOARDS AND COMMITTEES
The following assignment changes were made to the Council
boards and committees:
Conference of Governments - General Membership: Clarence
Barnett and Ernie Berger; Bill Brado will serve as an
alternate with Council Members Beauchamp and Buchanan.
District Board of Health: Council Member Brado will fill the
vacancy.
Downtown Area Redevelopment Committee: Council Member
Beauchamp will fill the vacancy.

Emergency Medical Services Advisory Council - Executive
Board: Council Member Berger will fill the vacancy.
Public Transportation Benefit Area (PTBA): Council Member
Berger will fill the vacant position.
Westside Merchant Association: Council Member Brado will
fill the vacancy; Council Member Sims will serve as
alternate.
Yakima Center Advisory Commission: Council Member Beauchamp
will fill the vacancy.
Other Current Committees of the Council:
Cable TV (CPAC): Council Member Berger will fill the
vacancy.
Economic Development Council Committee: Council Member Brado
will fill the vacancy; Council Member Beauchamp will serve
as an alternate.
Labor /Management Committee: Council Member Beauchamp will
fill the vacancy.
Public Safety Committee Regarding Joint Law Enforcement
Facility; 911 and Consolidated Communications: Council
Member Berger will fill the vacant alternate position.
The Selah Committee /Improvements - South 1st Street was
dissolved.
Transit Committee: Council Member Beauchamp will fill the
vacant position and Council Member Berger will serve as
alternate.
Visioning Yakima 2010 Review Committee: Mayor Berndt
reported the appointment to fill the vacant position will be
made by the Committee.
Tobacco Youth Committee: Mayor Berndt will fill the vacancy.
Council Committees for Appointments to Boards and
Commissions:
Community Programming Advisory Committee (Cable): Council
Member Berger will fill the vacancy.
Rebound Plus: Council Member Berger will fill the vacancy.
Regional Planning Commission: Council Member Barnett will
fill the vacancy.
Yakima Center Advisory Board: Mayor Berndt will fill the
vacancy.
7. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS (IF APPLICABLE)
Leonard Hall, Code Administration Manager, introduced Nancy
Danko as the new Fire Code Inspector and Kathy Kohl as the
new Code Compliance Officer.
8. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
There being no changes, the City Clerk then read the Consent
Agenda items, including resolutions and ordinances by title.

It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE
CONSENT AGENDA, AS READ, BE ADOPTED. The motion
carried by unanimous roll call vote. (Subsequent paragraphs
preceded by an asterisk ( *) indicate items on the Consent
Agenda handled under one motion without further discussion.)
*9. APPROVAL OF THE MINUTES OF THE APRIL 13, 1993 ADJOURNED
MEETING AND OCTOBER 12, 1993 BUSINESS MEETING
The minutes of the April 13, 1993 Adjourned meeting and
October 12, 1993 Business meeting, were approved, having
been duly certified accurate by two Council members and no
one present wishing to have said minutes read publicly.
10. AUDIENCE PARTICIPATION
Mel Stubblefield brought to Council's attention an incident
which occurred when he was stopped by the Police. He spoke
about the lack of respect that was given him and the
unwarranted frisking and intimidation of the youths that were
with him. He requested a report of this incident. He
further related two other recent incidents involving
disrespectful treatment by police officers. City Manager
Zais stated a thorough review of the incident will be
conducted.
*11. SET DATE OF PUBLIC MEETING FOR JANUARY 11, 1994 TO CONSIDER
FINAL PLAT APPROVAL OF SUNCREST III, UNITED BUILDERS
January 11, 1994 was as the date of public meeting to
consider the Final Plat for the Suncrest III Subdivision,
United Builders, located south of Mead Avenue between 32nd
and 34th Avenues.
*12. APPROVAL OF FINAL CONTRACT PAYMENT FOR WATER TREATMENT PLANT
S.C.A.D.A. SYSTEM, SCHEDULE A (Standard Motion V -B, accept
contract and approve final payment)
The report from the City Engineer, dated December 20, 1993,
with respect to the completion of the work on the Water
Treatment Plant S.C.A.D.A. System, Schedule A, performed by
Zypher Mechanical, Inc., was approved, the work accepted and
payment of the final estimates as therein set forth was
authorized.
*13. ACCEPTANCE OF 1992 GENERAL AUDIT REPORT FROM THE STATE
AUDITOR'S OFFICE
The report from the Finance Department regarding the 1992
State Audit Report was accepted.
