ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Henry Beauchamp, Bill Brado, Lynn Buchanan, and Bernard Sims present on roll call. Council Member Skip Semon absent and excused. City Manager Zais., Assistant City Attorney- Carberry, and Deputy City Clerk Skovald also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE • The Pledge of Allegiance was led by Council Member Barnett. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Mayor Berndt announced the YPAC Council candidate forum scheduled for tonight on YCTV at 7 p.m. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus 'to add Item No. 8 and to remove Item No. 10 from the Consent Agenda. The Deputy City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS AMENDED, BE ADOPTED. The motion carried by unanimous roll call vote; Semon absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 5. AUDIENCE PARTICIPATION A. SPECIAL PRESENTATION BY CHAMBER OF COMMERCE Mike Mercy, President of the Chamber of Commerce, presented a check to the City of Yakima for improvements to the parking area adjacent to the Chamber's office. Curtis King, Chairman of the All American City Committee, introduced and thanked the committee members who went to the All American City contest in Tampa, Florida. He presented the All American City Award plaque and a picture of the delegation to Mayor Berndt. • 486 OCTOBER 26, 1993 Phil Hoge, representing the North Central Neighborhood Coalition, thanked Council for their decisions regarding Swan Avenue Park improvements, as well as Council Member Brado and Park employees for their help cleaning up the park. 6. PUBLIC HEARING ON THE FINAL ASSESSMENT ROLL FOR NORTH 21ST AVENUE LID NO. 1050 This being the time set for the public hearing, Al Rose, Office Engineer, explained this public hearing is to confirm the Final Assessment Roll for the North 21st Avenue Water LID No. 1050, which was created so that a private water main could be replaced. Mr. Rose was also available to answer any questions. Mayor Berndt opened the public hearing and asked for anyone wishing to comment about this issue. There being no one, the public hearing was closed. Ordinance No. 93 -96 having been read by title, it was MOVED BY SIMS, SECONDED BY BUCHANAN, TO PASS THE ORDINANCE. The motion carried by unanimous voice vote; Semon absent. ORDINANCE NO. 93 -96, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 1050 as created and established by Ordinance No. 93 -31 of the Ordinances of the City of Yakima. 7. CONSIDERATION OF RESOLUTION PROCLAIMING OCTOBER 27, 1993, AS "UNFUNDED MANDATES DAY" IN OBSERVANCE OF NATIONAL UNFUNDED MANDATES DAY City Manager Zais presented information concerning the growing problem of unfunded mandates issued by both the federal and state governments. In order to gain attention publicly and to educate citizens about the severe effects these unfunded mandates have on the City's budget, Mr. Zais urged the City Council to adopt the resolution. After further comments and a considerable amount of discussion among Council members and staff, and Resolution No. R -93 -108 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE RESOLUTION. The motion carried by unanimous voice vote; Semon absent. RESOLUTION NO. R -93 -108, A RESOLUTION declaring October 27, 1993 as Unfunded Mandates Day in the City of Yakima. 2 4 8.7 OCTOBER 26, 1993 *8. CONSIDERATION OF LEGISLATION REGARDING CONTRACT DOCUMENTS WITH THE SYSTEMS WORKS (TSW) FOR IMPLEMENTATION OF AN AUTOMATED MAINTENANCE MANAGEMENT SYSTEM (AMMS) RESOLUTION NO. R - 93 - 109, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute four agreements with the System Works, Inc. to implement an Automated Maintenance Management System. *9. CONSIDERATION OF RESOLUTION AUTHORIZING PERSONAL CONSULTING SERVICES AGREEMENT WITH DIANA WELCH FOR UPDATING POLICE /FIRE AND CHARTER CIVIL SERVICE RULES AND REGULATIONS RESOLUTION NO. R - 93 - 110, A RESOLUTION authorizing the execution of a personal consulting services agreement with Diana Welch. 10. SET DATE OF PUBLIC HEARING FOR NOVEMBER 16, 1993, ON SEPA APPEAL FOR GREENWAY PATHWAY WEST SHORELINE APPLICATION Joe Schons, 4806 -A West Chestnut Avenue, who filed the appeal, stated he was opposed to the November 16, 1993 date because there is not enough time for him to prepare for the hearing. He requested the date be set after the first of the new year to allow enough time to gather the information he needs for the appeal. Due to the adequate length of time since the SEPA Checklist was filed and provided to the public, and the fact that they are ready to discuss Mr. Schons' concerns, Cec Vogt, Director of the Greenway, stated they would prefer to proceed with the appeal as soon as possible. After a considerable amount of discussion among Council members, staff, and the others, concerning setting the date of public hearing to a day that is reasonable for all parties, it was MOVED BY BEAUCHAMP, SECONDED BY BRADO, TO SET DECEMBER 7, 1993, AS THE DATE FOR PUBLIC HEARING TO CONSIDER AN APPEAL OF THE SEPA THRESHOLD DETERMINATION ON THE PROPOSED GREENWAY PATHWAY WEST SHORELINE APPLICATION. The motion carried by unanimous / / voice vote; Semon absent. Planning Manager Skone requested any additional information be provided to staff in advance of the hearing. *11. APPROVAL OF THE THIRD QUARTER 1993 REVENUE AND EXPENDITURE BUDGET REPORT The Third Quarter 1993 Revenue and Expenditure Budget Report was approved. *12. APPROVAL OF QUARTERLY VEHICLE INCIDENT /COLLISION REPORT The Quarterly Vehicle Incident /Collision Report was accepted. 3 488 OCTOBER 26, 1993 13. EXECUTIVE SESSION - It was MOVED BY BEAUCHAMP, SECONDED BY SIMS, TO MOVE INTO EXECUTIVE SESSION FOR APPROXIMATELY 15 -20 MINUTES FOR THE PURPOSE OF DISCUSSING PENDING LITIGATION ON THE BROADWAY FIRE DISTRICT DISSOLUTION ISSUE, WITH IMMEDIATE ADJOURNMENT THEREAFTER. The motion carried by unanimous voice vote; Semon absent. 15.
