ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Henry Beauchamp, Bill Brado, Lynn Buchanan, Skip Semon and Bernard Sims present on roll call. Assistant City Manager Rice, Assistant City Attorney Paolella, and City Clerk Roberts also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Invocation was given by Council Member Beauchamp. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) Mayor Berndt stated Council received a copy of the letter staff prepared to respond to a bill sponsored by Senator Gorton. Chris Waarvick, Wastewater Superintendent, stated that he, Marketa Oliver, and Dick Zais wrote a response to a bill by Senator Gorton which says that if a federal regulatory law is passed, they must provide a source of funding. He stated the letter will be sent as written unless Council would like to suggest changes. Council Member Barnett requested clarification on the hearing date for the CHAS 1994 -1998 report. Glenn Valenzuela, Director of Community and Economic Development, stated the hearing will be held next Tuesday and assured Council Member Barnett that the hearing was properly noticed. Council Member Buchanan advised Council that he has seen a letter from Congressman Inslee's Office where FAA indicated the radar scopes will be placed at Pasco and the tower rating in Yakima will be lowered. They will transfer three people from the Yakima tower, instead of two people, as originally thought. Following discussion, it was referred to staff to contact local representatives and community leaders to write to Senator Gorton about the impact this will have to the City of Yakima and surrounding communities. Council Member Beauchamp suggested Iry Newhouse could contact Senator Gorton and John McAlister, Tree Top, could contact Senator Foley. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or 42 3 SEPTEMBER 21, 1939 deletions from either Council members or citizens present. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 5. PUBLIC HEARING ON POWERHOUSE ANNEXATION (See Ordinance annexing property) Bruce Benson, Associate Planner, stated this 20 acre annexation consists of 4 parcels of land with an assessed valuation of $110,750. Petitions representing over 95% of the property owners have been received. The staff recommendation is to annex this property. Council Member Beauchamp inquired if a better map showing this area is available. Mr. Benson referenced a larger map in the Council Chambers, pointing out this area. Don Skone, Planning Manager, advised Council that the applicant, Mr. Abrams, has requested a one week postponement of this hearing. Mayor Berndt inquired if Item 6 would also have to be postponed. She was advised the two items are related and Item 6 should also be postponed. It was the general consensus of the Council to postpone Items Nos. 5 and 6 until September 28th. Those citizens present to speak to this issue were assured they would be contacted if the hearing date is changed from next week. 6. PUBLIC MEETING TO CONSIDER HEARING EXAMINER'S RECOMMENDATION ON THE REZONE OF PROPERTY: A. ORDINANCE REZONING PROPERTY IN VICINITY OF 4400 POWERHOUSE REQUESTED BY DEL MATTHEWS B. ORDINANCE REZONING PROPERTY AT 4411 W. POWERHOUSE RD., REQUESTED BY MYRON ABRAMS AND GEORGE MULL This item was postponed for one week, until September 28, 1993. 7. AUDIENCE PARTICIPATION Tara Williams, a student representative from Eisenhower High School, .stated that on October 15th, they plan to have their homecoming game, including a fireworks show. She requested Council waive the City's permit fee for the fireworks display. Council was advised the fee for a fireworks display permit is $100. Following a recommendation by the Assistant City Attorney, it was MOVED BY BEAUCHAMP, SECONDED BY BRADO, TO INSTRUCT STAFF TO AMEND THE ORDINANCE TO WAIVE THE FEE FOR FIREWORKS DISPLAY FOR STUDENT ORGANIZATIONS. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF INTERLOCAL AGREEMENT WITH YAKIMA VALLEY CONFERENCE OF GOVERNMENTS FOR REGIONAL TRANSPORTATION SYSTEMS PLANNING RESOLUTION NO. R -93 -101, A RESOLUTION authorizing the execution of an interlocal Agreement with the Yakima Valley Conference of Governments and other member jurisdictions. *9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH YAKIMA VALLEY COUNCIL OF CAMP FIRE FOR AFTER - SCHOOL RECREATIONAL PROGRAM FOR YOUTH AT RISK RESOLUTION NO. R -93 -102, A RESOLUTION authorizing an agreement between the City and the Yakima Valley Council of Camp Fire to provide an After - School Recreational Program for Youth at Risk. *10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH FIRST UNION MANAGEMENT, INC. FOR USE OF VALLEY MALL PARKING LOT FOR CENTRAL WASHINGTON FAIR SHUTTLE SERVICE RESOLUTION NO. R -93 -103, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute a promotion agreement with First Union Management, Inc. to use the Valley Mall parking lot for temporary shuttle bus rides to the Central Washington Fairgrounds. *11. APPROVAL OF FINANCE REPORTS: A. 2ND QUARTER 1993 TREASURY REPORT The Second Quarter 1993 Treasury Report was accepted. B. 2ND QUARTER 1993 INSURANCE CLAIMS REPORT The Second Quarter 1993 Insurance Claims Report was accepted. *12. SECOND READING OF ORDINANCE AMENDING THE 1993 BUDGET AND APPROPRIATING FUNDS INTO THE TRANSIT BUDGET FOR ADDITIONAL SALARIES TO PROVIDE BUS SERVICE An Ordinance amending the 1993 budget and appropriating funds into the Transit budget for additional salaries to provide bus service, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 93 -89, AN ORDINANCE amending the 1993 budget for the City of Yakima; and making an appropriation of $100,035 in the Transit Operating Fund for expenditure during 1993 for additional salaries necessary to provide bus service. 3 425 SEPTEMBER 21, 1939 • l *13. FIRST READING OF ORDINANCE AMENDING THE 1993 BUDGET AND APPROPRIATING FUNDS FOR PARKS SENIOR TOUR PROGRAMS AND UNANTICIPATED RETIREMENT COSTS (No formal action required this meeting) An Ordinance amending the 1993 budget and appropriating funds for Parks Senior Tour Programs and unanticipated retirement costs, having been read by title only, was laid on the table for one week, until September 28, 1993. 14. OTHER BUSINESS None. EXECUTIVE SESSION. REGARDING PROSPECTIVE LITIGATION It was MOVED BY BARNETT, SECONDED BY BUCHANAN, TO MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PROSPECTIVE LITIGATION, WITH IMMEDIATE ADJOURNMENT THEREAFTER TO SEPTEMBER 28, 1993 AT 7:30 A.M. AT THE YAKIMA SCHOOL DISTRICT #7 LIBRARY, FOR A JOINT MEETING WITH THE COUNTY COMMISSIONERS. The motion carried by unanimous voice vote. 4 42.6 SEPTEMBER 21, 1939 16.
