CITY OF YAKIMA, WASHINGTON
AUGUST 17, 1993
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington.
Acting Mayor Clarence Barnett, presiding, Council Members
Bill Brado, Skip Semon and Bernard Sims present on roll
call. Mayor Pat Berndt, and Council Members Henry Beauchamp
and Lynn Buchanan absent and excused. City Manager Zais,
City Prosecuting Attorney Woodard, and City Clerk Roberts
also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member
Brado.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS (IF APPLICABLE)
Acting Mayor Barnett reported the Yakima City News contained
outdated information, inviting people to attend Growth
Management meetings, which by the time this publication was
released, the meetings had already occurred. He suggested
that perhaps the newsletter should be published monthly to
keep the information current.
4. CONSENT AGENDA
Acting Mayor Barnett referred to the items placed on the
Consent Agenda, questioning whether there were any additions
or deletions from either Council members or citizens
present. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was
MOVED BY SIMS, SECONDED. BY SEMON, THAT THE CONSENT
AGENDA, AS READ, BE ADOPTED. The motion carried by
unanimous roll call vote; Beauchamp, Berndt and Buchanan
absent. (Subsequent paragraphs preceded by an asterisk ( *)
indicate items on the Consent Agenda handled under one
motion without further discussion.)
*5. APPROVAL OF THE MINUTES OF THE APRIL 21, 1993 ADJOURNED
MEETING
The minutes of the April 21, 1993 Business meeting, was
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.

6. AUDIENCE PARTICIPATION
Verna Beggs, 1204 E. Spruce, stated she learned the City is
considering placing the police station at Kiwanis Park, but
was unsure about how the neighborhood would feel about that
location. She submitted a petition showing support for the
location of the police station /legal center at Kiwanis Park.
David Hawkins, P. 0 Box 1766, spoke about the best and worst
cities and asked what it would mean if Yakima would become
the best place in the nation to live. He stated it will
come to pass when his program comes into the schools.
Phil Pleasant, 701 S. 7th Ave., stated he is speaking in
behalf of the NAACP and other minorities who are not
participating in projects available in Yakima. He commented
on the City's high number of blacks hired in the Refuse
Division and the anticipated new 2,000 garbage accounts
which would impact the workload in the Refuse Division, in
addition to the proposed recycling program. He stated he
believes that service can be provided cheaper by a minority
business. He requested Council direct staff to meet with
him and others to see what they can do to develop an
opportunity for minorities to perform this service. Acting
Mayor Barnett suggested Mr. Pleasant meet with City Manager
Zais and Refuse and Recycling Manager Gaudette in order for
his plan to be considered in the overall recycling plan.
7. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION
AND DEBRIS ABATEMENT PROGRAM
Bob Shampine, Code Administration Manager, stated that the
second name on the list, Lisa Bellinger, 609 N. 4th Avenue,
can be deleted. Resolution No. R -93 -88 having been read by
title, it was MOVED BY SIMS, SECONDED BY SEMON, THAT
THE RESOLUTION BE ADOPTED. The motion carried by
unanimous roll call vote; Beauchamp, Berndt and Buchanan
absent.
RESOLUTION NO. R 93 - 88, A RESOLUTION authorizing the
Code Administration Manager to clear certain weedy lots.
*8. APPROVAL OF RIGHT -OF -WAY USE PERMIT FOR INSTALLATION OF SIGN
REQUESTED BY SCHULTZ FURNITURE
The Right -of -Way Use Permit to install a sign on the corner
of 7 No. 5th Avenue, requested by Schultz Furniture, was
approved.
*9. APPROVAL OF JULY 1993 BUDGET REPORT
The July 1993 Budget Report was approved.

10. CONSIDERATION OF. ORDINANCE, APPROVING TWO -WAY ALLEY
DESIGNATION NORTH OF YAKIMA AVENUE AND "A" STREET, BETWEEN
3RD STREET AND MID -BLOCK
Jim Norman, architect for Washington Mutual Bank which is
relocating to Third Street and Yakima Avenue, stated the
ordinance would allow for two -way traffic in the east /west
alley adjacent to the proposed bank. The staff had
expressed concerned about the two -way traffic pattern
because the alley is narrow; however, the bank would provide
an additional five feet to widen the alley. He acknowledged
the project will generate traffic in that alley, but
believes the two -way traffic in the alley should relieve
some of the traffic on the north /south alley and solve some
of the problems there. Another concern of City staff is
vehicles backing out into the alley. Those parking spaces
would be used by the employees of the bank so there would
not be a lot of backing movement. Another staff concern is
the private access onto Yakima Avenue, mainly allowing left
turns. The bank doesn't see that as a problem, but if it
becomes one, they would work with the City towards a
solution, or circulate the traffic around the bank to only
exit onto 3rd Street.
Dave Hussell, Street and Traffic Operations Manager stated
staff has a difference of opinion concerning the two -way
alley. The staff concerns have been addressed in the staff
report. He referred to a map of the area and pointed out
the traffic congestion that could occur with two -way traffic
in that alley: increased congestion onto Yakima Avenue, a
safety issue if traffic backs up to the crosswalk on 3rd
Street, another safety issue of having vehicles backing into
the narrow alley, the congestion at the intersection of the
north /south and east /west alleys, and the possible use of
the north /south alley as a shortcut to Yakima Avenue.
Mr. Hussell stated staff has received complaints about the
congestion and safety problems in the north /south alley and
those parties were considering petitioning the City to make
that alley a one -way traffic pattern. Mr. Hussell and
Assistant City Attorney Paolella clarified the ordinance.
There was discussion regarding tactics for reducing staff's
concerns about traffic congestion, particularly left turns
into and out of the alley and the bank. Mr. Norman stated
he felt the bank would agree to the signs to prohibit left
turns from the bank onto Yakima Avenue; however, he felt it
was unnecessary for the alley since the bank has agreed to
extend the island on 3rd Street, making it. impossible to
turn left.

Ordinance No 93 -79 having been read by title, it was MOVED
BY SIMS, SECONDED BY SEMON, THAT THE ORDINANCE BE
PASSED. The motion carried by unanimous roll call vote;
Beauchamp, Berndt and Buchanan absent. It was MOVED BY
SIMS, SECONDED BY SEMON, TO RESTRICT LEFT TURNS INTO
AND OUT OF THE PROPOSED. BANK PARKING ACCESS DRIVE TO
YAKIMA AVENUE. The motion passed by unanimous voice vote;
Beauchamp, Berndt and Buchanan absent.
ORDINANCE NO 93 -79, AN ORDINANCE relating to traffic
control; altering the one -way only traffic movement on an
east -west alley located between Yakima Avenue and "A" Street
from North 3rd Street to mid block; and amending Subsection
9.50.290 (12) of the Yakima Municipal Code.
*11. CONSIDERATION OF ORDINANCE AMENDING THE MUNICIPAL CODE TO
ALLOW PARKING ON 8TH AVENUE BETWEEN YAKIMA AVENUE AND
CHESTNUT
ORDINANCE NO. 93 -80, AN ORDINANCE relating to traffic,
prohibiting parking on both sides of Yakima Avenue and
intersecting avenues between First Avenue and 10th Avenue
except South 8th Avenue between Yakima Avenue and Chestnut
Avenue during specified hours, creating handicapped
exemptions, and amending. Section 9.50.060 of the City of
Yakima Municipal Code.

13. EXECUTIVE SESSION REGARDING ACQUISITION OF
PROPERTY /PROSPECTIVE LITIGATION
It was MOVED BY SEMON, SECONDED BY SIMS, TO MOVE INTO
EXECUTIVE SESSION, WITH IMMEDIATE ADJOURNMENT
THEREAFTER TO AUGUST 24, 1993 AT 7 :30 A.M. FOR
.INFORMAL DISCUSSION WITH THE YAKIMA COUNTY
COMMISSIONERS. The motion carried by unanimous voice
vote; Beauchamp, Berndt and Buchanan absent.
14. ADJOURNMENT TO AUGUST 24, 1993 AT 7:30 A.M. AT THE YAKIMA
CENTER TO MEET WITH YAKIMA COUNTY COMMISSIONERS FOR INFORMAL
DISCUSSION
Following the conclusion of the Executive Session, the
