ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members. Clarence Barnett, Bill Brado, Lynn Buchanan, and Skip Semon present on roll call. Council Members Henry Beauchamp and Bernard Sims absent and excused. City Manager Zais, Assistant City Attorney Carberry, and City Clerk Roberts also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Buchanan. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) Council Member Barnett asked staff why the Senior Times is no longer available at the Senior Center. He stated he heard it was because the Senior Times advertises tours, which competes with the tours offered by the Senior Center. Jerry Copeland, Director of Public Works, stated he would research it and report back to Council. Council Member Semon announced that during the informal meeting this morning, it was the general consensus to delay making a decision on the location and bid award for the Police Station /Legal Center for two weeks to allow further discussion and proposals_on locations in the downtown area. Council Member Brado referenced the parking amendments made recently and reported he received several calls from residents on 8th Avenue that there wasn't adequate parking before this parking restriction was passed. They would like to allow that parking again. City Manager Zais stated that staff would prepare the appropriate legislation to make that change. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council to remove Item No. 9 from the Consent Agenda. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY BUCHANAN, SECONDED BY SEMON, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote; Beauchamp, and Sims absent. APPROVAL OF THE MINUTES OF THE JUNE 8, 1993 BUSINESS MEETING The minutes of the June 8, 1993 Business meeting, was approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION A. PRESENTATION ON 1993 AGRICULTURAL SHOWCASE - Glenn Phipps extended his appreciation for the City's participation in the 1993 Agricultural Showcase and for the effort put forth by Assistant City Manager Rice, Community and Economic Development Director Valenzuela, the Police Department and Parks and Recreation Division. He reported that last year there were about 145 -150 exhibitors and at this time they have over 150 international delegates confirmed. A video of the Agricultural Showcase was viewed. He stated the video was taped in three different languages. He spoke about the Council's role in this event which will take place August 24 -27. 7. REPORT FROM REFUSE DIVISION REGARDING AUTOMATED OR SEMI - AUTOMATED EQUIPMENT FOR YARD WASTE COLLECTION Nancy Gaudette, Refuse and Recycling Manager, was available to respond to Council questions. She stated there are two containers in the hallway if Council would like to view them. Following a brief discussion and appearance by Dan Arnett, restating the Chamber of Commerce's position in favor of automated collection, it was MOVED BY BUCHANAN, SECONDED BY BARNETT TO APPROVE THE IMPLEMENTATION OF A YARD WASTE PILOT PROGRAM UTILIZING UNIVERSAL CONTAINERS. The motion carried by 4 -1 voice vote; Semon voting nay, Beauchamp and Sims absent. 8. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND DEBRIS ABATEMENT PROGRAM Bob Shampine, Code Administration Manager, state that the first two properties belonging to Ed and Glennis Trammel, 1108 & 1112 McKinley Avenue, can be removed from the list. There being no citizen present wishing to speak to this issue, and Resolution No. R -93 -83 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SEMON, THAT THE RESOLUTION BE ADOPTED. The motion carried by unanimous roll call vote; Beauchamp and Sims absent. 2 368 AUGUST 10, 1993 RESOLUTION NO. R 93 - 83, A RESOLUTION authorizing the Code Administration Manager to clear certain weedy lots. 9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH CONSULTING VALUE SPECIALISTS, INC. FOR VALUE ENGINEERING SERVICES FOR YAKIMA /I -82 GATEWAY PROJECT Dennis Covell, Director. of Engineering and Utilities, was present . to respond to any questions. The resolution authorizes the Value Engineering Study for Phase 2 of the I- 82 /Gateway project at .a cost of $12,000 plus an estimated $4,000 for travel expenses which will be individually negotiated. He reported he spoke with the Department of Transportation regarding their February 18th letter. They are a great believer of value engineering and want to see the results of that study before they change their current opinion as stated in the letter. They are considering holding back approval of the "J" ramp in Phase 1 and want a supplemental agreement between all the parties to seek further funding sources to fund the entire project before they would release the "J" ramp funding. They have indicated in informal discussion that if the Value Engineering Study says the "J" ramp should be built in Phase 1, that they will seriously rethink their position and possibly will withdraw their funding. Council Member Barnett expressed his concern about what would happen if an agreement for the total project funding is not secured. Mr. Covell stated there really isn't an answer until after the State sees the Value Engineering Study. There was discussion regarding the State's requirement for local participation of 30% match for this project. City Manager Zais stated that if this doesn't work, then we put on hold everything that has been done to this point. We have approved funding for a certain amount of design work and support, through the conceptual phase. If we don't have an agreement proceeding with final design, everything stops; we notify the State we are unable to proceed further and we turn it back. Mr. Covell stated that the State has asked us to pursue all available funds necessary to complete the project. He stated he thinks we can find the money; however, he does not know what the local match requirement will be; nor what the participation of the local match funds will be, it is meant to be negotiated into the Phase 2 contract. Mr. Barnett asked about the status of the Federal aspects. Mr. Covell responded, saying the design report and access report have been submitted to the Federal Highway Administration and we are awaiting a response from them. It may take a long time. Mr. Covell stated there is a steering committee meeting scheduled this Friday to discuss project objectives priorities. Council will then review them 3 369 AUGUST`'10, 1993 before they are submitted to the.value engineering team. It was clarified that design elements are different from objectives. Mr. Buchanan questioned whether the "J" ramp radius is sufficient for 105' trucks. Mr. Covell stated that radius was based on the 1984 AASHTO program, which has not been updated. The specs for the state have been updated based on AASHTO and staff is looking for an answer. It will be built according to current, state -of- the -art DOT standards. City Manager Zais stated he hopes to have the steering committee's report to Council Friday evening, then Council can convene in a special meeting Monday morning at 8:00 a.m. to review the objectives and determine if there are any changes in the priorities. Resolution No. R- 93 -84, having been read by title, it was MOVED BY SEMON, SECONDED BY BARNETT, THAT THE RESOLUTION BE ADOPTED. City Manager Zais stated, for the record, that the engineering firm hired by the JEM Corporation is welcome to participate in the Value Engineering Study. RESOLUTION NO. R 93 - 84, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement with Consulting Value Specialists, Inc. for professional services. *10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LICENSE AGREEMENT FOR GREENWAY PATHWAY WEST RESOLUTION NO. R 93 - 85, A RESOLUTION authorizing the execution of a License Agreement for the Greenway Pathway West. *11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF QUIT CLAIM DEED FOR CLASEN FRUIT RESOLUTION NO. R 93 - 86, A RESOLUTION authorizing the Mayor to execute a Quit Claim Deed to clear title for the Clasen Fruit property located north of Ahtanum Road in Ahtanum. *12. APPROVAL OF RIGHT -OF -WAY USE PERMIT FOR INSTALLATION OF TELEPHONE CABLE AT YAKIMA SCHOOL DISTRICT ADMINISTRATION OFFICE The Right -of -Way Use Permit for Yakima School District No. 7 to install a telephone cable to connect the Administration Building with the Special Education Building and Snyder's Building, was approved. 4 370 AUGUST 10, 1993 *13. APPROVAL OF FINAL CONTRACT PAYMENT FOR 32ND AVENUE AND TIETON DRIVE IMPROVEMENT PROJECT (STANDARD MOTION V - B, ACCEPT PROJECT AND APPROVE FINAL PAYMENT) The report from the City Engineer, dated July 29, 1993, with respect to the completion of the work on the Tieton Drive /32nd Avenue Intersection improvement project, performed by Columbia Asphalt & Gravel, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. *14. CONSIDERATION OF ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION ORDINANCE FOR SUPERVISING SANITARY ENGINEER POSITION A. RESOLUTION AUTHORIZING EXECUTION OF ADDENDUM TO THE 1992 - 1994 COLLECTIVE BARGAINING AGREEMENT`WITH AFSCME RESOLUTION NO. R- 93 -87, A RESOLUTION authorizing and directing the City Manager and the City Clerk of the City of Yakima to sign an Addendum to the 1992 -1994 Collective Bargaining Agreement with the Washington State Council of County and City Employees Local 1122 of the American Federation of State, County and Municipal Employees, AFL -CIO as to the exclusion of the Supervising Sanitary Engineer from the bargaining unit. B. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION SCHEDULE ORDINANCE NO. 93 -40, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective September 12, 1993; amending Subsections 2.20.100 A, 2.20.100 C, 2.20.110 A, 2.20.110 F, 2.20.110 H, and 2.20.110 J, all of the City of Yakima Municipal Code. *15. CONSIDERATION OF ORDINANCES MAKING REVISIONS AND CORRECTIONS TO THE MUNICIPAL CODE (CONTINUED FROM JUNE 22, 1993) A. ORDINANCE RELATING TO CITY BUSINESS HOURS ORDINANCE NO. 93 -41, AN ORDINANCE relating to City administration; updating the Municipal Code by clarifying which City offices must stay open during the lunch hour; and amending Section 1.09.010 of the City of Yakima Municipal Code. 5 371 AUGUST '10, 1993 B. ORDINANCE CORRECTION DESCRIPTION OF LOCATION OF CITY HALL ORDINANCE NO. 93 - 42, AN ORDINANCE relating to city administration; updating and correcting the description of the location of the Yakima City Hall; and amending Section 1.12.010 of the City of Yakima Municipal Code. C. ORDINANCE REPEALING AND AMENDING SECTIONS RELATING TO FIRE RELIEF AND PENSION FUND ORDINANCE NO. 93 - 43, AN ORDINANCE relating to City administration; repealing an outdated provision relating to deductions from firemen's salaries for a pension plan; changing references to the "City Treasurer" to "Director of Finance and Budget "; and amending Sections 1.47.050 and 1.47.060; and repealing Section 1.47.020, all of the City of Yakima Municipal Code. D. ORDINANCE CLARIFYING LANGUAGE REGARDING TENURE OF POLICE OFFICERS ORDINANCE NO. 93 - 44, AN ORDINANCE relating to city administration; inserting clarifying language to a cross - reference; and amending the heading of Chapter 1.48 and Section 1.48.010 of the City of Yakima Municipal Code. E. ORDINANCE CLARIFYING PROCEDURE TO FILL VACANCIES ON THE POLICE RELIEF AND PENSION BOARD ORDINANCE NO. 93 - 45, AN ORDINANCE relating to City administration; clarifying how vacancies to the Police Department Pension Board are filled; amending Section 1.57.010 and adding Section 1.57.015 all of the City of Yakima Municipal Code. F. ORDINANCE REPEALING SECTIONS REGARDING A MUNICIPAL COURT SYSTEM ORDINANCE NO. 93 - 46, AN ORDINANCE relating to city administration; repealing sections of the City of Yakima Municipal Code which provide for a municipal court system, since the City of Yakima no longer operates a municipal court system; and repealing Sections 1.60.010, 1.63.010, 1.63.020, and 1.63.030, all of the City of Yakima Municipal Code. 6 372 AUGUST 10, 1993 G. ORDINANCE CORRECTING AMOUNT OF MONEY CREDITED TO A DEFENDANT IN CUSTODY ORDINANCE NO. 93 -47, AN ORDINANCE relating to city administration; correcting the amount of money to be credited to a defendant in custody, such money to be used to reduce any unpaid fines; and amending 1.66.010 of the City of Yakima Municipal Code. H. ORDINANCE CHANGING REFERENCES OF MUNICIPAL COURT TO DISTRICT COURT ORDINANCE NO. 93 -48, AN ORDINANCE relating to city administration; changing references to "Municipal court" so that they will read "district court "; and amending Sections 1.72.010, 1.72.020, and 1.72.030 all of the City of Yakima Municipal Code. I. ORDINANCE CORRECTING REFERENCES TO THE CITY CHARTER RELATING TO PURCHASE WITHOUT CALLING FOR BIDS ORDINANCE NO. 93 -49, AN ORDINANCE relating to administration; correcting references to the City Charter; and amending Section 1.80.040 of the City of Yakima Municipal Code. J. ORDINANCE REPEALING ORDINANCE DEALING WITH LIBRARY PERSONNEL ORDINANCE NO. 93 -50, AN ORDINANCE relating to personnel; repealing an ordinance dealing with library personnel which is now obsolete, amending a cross - reference in a footnote, and amending the ordinance dealing with retirement plan participation to reflect current practice; and repealing Sections 2.32.010, 2.32.020, 2.32.030, and 2.32.040, and amending Section 2.36.010, all of the City of Yakima Municipal Code. K. ORDINANCE REPEALING SALES AND USE TAX PROVISION ORDINANCE NO. 93 - 52, AN ORDINANCE relating to funds and accounts; repealing sales and use tax provisions, one of I/ which was relevant only to the year 1983 and one of which was predicated on a state law which has since been repealed; and repealing Sections 3.78.055 and 3.78.105, both of the City of Yakima Municipal Code. M. ORDINANCE CORRECTING INTERNAL REFERENCE RELATING TO THE CAPITOL THEATRE FUND ORDINANCE NO. 93 - 53, AN ORDINANCE relating to funds and accounts; correcting an internal reference to another section of the Yakima Municipal Code; and amending Section 3.98.040 of the City of Yakima Municipal Code. N. ORDINANCE REMOVING WORD "VAGRANT" IN TITLE 6 ORDINANCE NO. 93 -57, AN ORDINANCE relating to public safety and morals; removing the word "vagrant" from the section establishing the penalty for violating Title 6; and amending Section 6.020.050 of the City of Yakima Municipal Code. R. ORDINANCE REPEALING SECTIONS TO CONFORM WITH STATE LAW FOR MATTERS MADE A FELONY ORDINANCE NO. 93 -58, AN ORDINANCE relating to public safety and morals; amending an ordinance dealing with the unlawful taking of a motor vehicle and repealing ordinances dealing with the use of a deadly weapon with intent to do bodily harm and promoting prostitution because these ordinances are preempted by state law; amending an ordinance defining rude behavior; repealing an ordinance dealing with unlawful assemblage because it is so vague as to be unconstitutional and repealing Sections 6.04.065, 6.04.383, and 6.04.530 and amending Sections 6.04.027 and 6.04.480, all of the City of Yakima Municipal Code. S. ORDINANCE PROHIBITING PUBLIC URINATION AND DEFECATION AND INCREASING THE PENALTY ORDINANCE NO. 93 -59, AN ORDINANCE relating to public safety and morals; prohibiting public urination and defecation; increasing the penalty to include 10 days in jail; and amending Section 6.04.360 of the City of Yakima Municipal Code. T. ORDINANCE INCREASE MAXIMUM DOLLAR AMOUNT CONSTITUTING CRIME OF PETIT LARCENY ORDINANCE NO. 93 -60, AN ORDINANCE relating to public safety and morals; increasing the maximum dollar amount constituting the crime of petit larceny; and amending Section 6.60.010 of the City of Yakima Municipal Code. ORDINANCE CORRECTING CROSS - REFERENCE IN DEFINITIONS LISTED IN SECTION 6.86 ORDINANCE NO. 93 -62, AN ORDINANCE relating to public safety and morals; correcting a cross - reference to the Revised Code of Washington which is contained in Section 6.86.020 of the City of Yakima Municipal Code; and amending Section 6.86.020 of the City of Yakima Municipal Code. W. ORDINANCE AMENDING PUBLIC HOLIDAYS OBSERVED BY THE CITY ORDINANCE NO. 93 -63, AN ORDINANCE relating to traffic; amending "public holidays" to substitute Martin Luther King's Birthday for Lincoln's Birthday; and amending Section 9.10.060 of the City of Yakima Municipal Code. X. ORDINANCE CORRECTING INTERNAL CROSS- REFERENCE RELATING TO "U" TURNS ORDINANCE NO. 93 - 64, AN ORDINANCE relating to traffic; correcting an internal cross - reference contained in the City of Yakima Municipal Code; and amending Section 9.50.340 of the City of Yakima Municipal Code. Y. ORDINANCE CORRECTING REFERENCES TO THE UNIFORM FIRE CODE ORDINANCE NO. 93 -65, AN ORDINANCE relating to fire and fire protection; correcting references to the Uniform Fire Code because the references contained in the existing ordinances are to a uniform fire code which has since been revised so as to make the references inaccurate; also correcting a reference to the Revised Code of Washington; and amending Sections 10.05.070, 10.05.075, 10.05.080, 10.05.090, 10.10.010, and 10.15.010(6), all of the City of Yakima Municipal Code. Z. ORDINANCE CORRECTING REFERENCES TO THE UNIFORM BUILDING CODE AND UNIFORM PLUMBING CODE ORDINANCE NO. 93 -66, AN ORDINANCE relating to building regulations; correcting references to the Uniform Building I/ Code and the Uniform Plumbing Code; and amending Sections 1 and 5 of the Yakima City Ordinance No. 3396 and amending Section 1 of Yakima City Ordinance No. 3401. • 10 376 AUGUST 10, 1993 AA. ORDINANCE REPEALING CHAPTER DEALING WITH BUILDING LINES ORDINANCE NO. 93 -67, AN ORDINANCE relating to buildings; repealing the chapter dealing with building lines because it is covered elsewhere in Title 15; and repealing Sections 11.12.010 and 11.12.020, both of the City of Yakima Municipal Code. BB. ORDINANCE CORRECTING REFERENCE TO THE UNIFORM BUILDING CODE AND REPEALING SECTION PROVIDING FOR CERTAIN PENALTIES ORDINANCE NO. 93 -68, AN ORDINANCE relating to buildings and apartment house safety; correcting a reference to the Uniform Building Code and repealing a section which provides penalties for violation of Chapter 11.13 of the City of Yakima Municipal Code because the penalty for violation is covered elsewhere; and amending Sections 11.13.150 and 11.13.160, both of the City of Yakima Municipal Code. CC. ORDINANCE PROVIDING FOR FINES AND JAIL TIME FOR VIOLATION OF CHAPTER 13.16. ORDINANCE NO. 93 -69, AN ORDINANCE relating to parks and playgrounds; providing for the imposition of both fines and jail time for a violation of Chapter 13.16 of the City of Yakima Municipal Code; and amending Section 13.16.150 of the City of Yakima Municipal Code. DD. ORDINANCE AMENDING THE MECHANICAL CODE TO CORRECT NUMERICAL ERROR ORDINANCE NO. 93 -70 AN ORDINANCE relating to buildings; amending the Mechanical Code to correct a numerical error and amending Section 11.32.077 of the City of Yakima Municipal Code. EE. ORDINANCE AMENDING THE HOUSING CODE TO INCLUDE OMITTED LANGUAGE ORDINANCE NO. 93 -71, AN ORDINANCE relating to buildings; amending the Housing Code to include omitted language, "requirement to act in compliance with the code at the" in Subsection (2) of definitions of "shall ", and amending Section 11.20.060 of the City of Yakima Municipal Code. 11 377 AUGUST'` 10, 1993 FF. ORDINANCE DELETING SUBSECTIONS RELATING TO PRIVATE DETECTIVES AND MERCHANT PATROLMEN ORDINANCE NO. 93 -72 AN ORDINANCE relating to licenses and business regulations; deleting Subsections (d) & (e), Exempting Private Detectives and Merchant Patrolmen from the business license requirement, and relabeling the subsequent sections; and amending Section 5.52.050 of the City of Yakima Municipal Code. ORDINANCE CHANGING REFERENCES OF CITY CLERK TO DIRECTOR OF FINANCE AND BUDGET RELATING TO GAMBLING LICENSE ORDINANCE NO. 93 -73, AN ORDINANCE relating to licenses and business regulations; changing references to "City Clerk" so that they will read "Director of Finance and Budget ": and amending Sections 5.49.030, 5.49.060, 5.49.080, 5.50.020, 5.50.080, and 5.50.180, all of the City of Yakima Municipal Code. H.H. II. ORDINANCE DELETING REPEALING SECTION 5.42.050 RELATING TO VEHICLES USED TO HAUL JUNK ORDINANCE NO. 93 -75, AN ORDINANCE relating to licenses and business regulations; deleting the requirement that any wagons or other vehicles used to haul junk shall bear signs issued by the City Clerk; and repealing Section 5.42.050 of the City of Yakima Municipal Code. SECOND READING OF ORDINANCE AMENDING THE 1993 BUDGET AND I/ APPROPRIATING FUNDS FOR CAPITOL THEATRE CAPITAL PROJECTS An Ordinance amending the 1993 budget and appropriating funds for additional costs to replace the Capitol Theatre roof, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 93 -78, AN ORDINANCE amending the 1993 budget for the City of Yakima; and making an appropriation of $21,000 in the Capitol Theatre fund for expenditure during 1993 for unforeseen additional costs to replace the Capitol Theatre roof. 17.
