(HLA) in the amount not to exceed $60,000 to provide Engineering Services during construction of the City's Industrial Waste Collection System through Burlington Northern Santa Fe (BNSF) Railway Company Right -of- Way. SUBMITTED BY: Joan Davenport: Interim Community and Economic Development Director Scott Schafer: Wastewater Division Manager Shelley Willson: Utility Engineer CONTACT Shelley Willson /575 -6077 PERSON /TELEPHONE: SUMMARY EXPLANATION: Work was completed on the extension of the City of Yakima's Industrial Waste (IW) Line to the area previously occupied by Boise Cascade, except for a 300 -foot segment that is owned by BNSF Railway Company within "H" St.. On June 11, 2012 the City received a signed pipeline license agreement from BNSF to allow for the installation of the two forcemain IW pipelines. Previous work involving the IW line installation was completed during the Irrigation Project that covered the Fruitvale Canal. The Irrigation Project did not include work through the BNSF Railway Company property, requiring the Wastewater Division to complete this portion as a separate project. HLA originally provided the engineering services for this project with Water /Irrigation through Contract No. 2008 -15. Wastewater recently entered into Contract No.2012 -42 with HLA for Professional Services related to extending the IW line to the vicinity of 23rd Avenue and River Road. The Addendum to the Professional Services Agreement with HLA (Addendum No. 1) is to develop the Plans, Specifications, and Estimate (PS &E), surveying and construction administration and inspection for the IW system improvements that reside within the BNSF Railway property. The terms of Addendum No. 1 would be in an amount not to exceed sixty thousand dollars ($60,000). (See attached Agreement with Exhibit "A" and "B "). Exhibit "A" of the Agreement describes the Scope of Work in more detail. Exhibit "B" of the Agreement describes the Schedule of Rates. R -2012- A RESOLUTION authorizing the City Manager to execute an Addendum to existing Professional Services Agreement 2012 -42 with Huibregtse, Louman Associates, Inc. (HLA), in the amount not to exceed $60,000 for Engineering Services for the construction of the City's Industrial Waste Collection System through Burlington Northern Santa Fe (BNSF) Railway Company Right -of -Way. WHEREAS, City owns and operates wastewater collection and treatment,facilities in accordance with applicable Federal, State and Local regulations; and WHEREAS, the City maintains a roster of consultants whose statements of qualifications represent that they have the expertise necessary to perform the services required by the City; and WHEREAS, the state of Washington requires these services to be performed by a Professional Licensed Engineer; and WHEREAS, the City already has an Agreement 2012 -42 with HLA Inc. for Engineering Services related to the design and construction services on recent Industrial Waste (IW) Line improvements for the City's wastewater system, previously identified to meet regulatory requirements, community growth, replacement needs, and operational efficiencies; and WHEREAS, the City desires to retain HLA Inc., through an Addendum of the existing Agreement, to provide engineering services for the design and construction of the extension of the City's IW line necessary to cross BNSF Railroad Property within "H" St.; and WHEREAS, this section of piping was not included with the original HLA Contract, due to delays in the City obtaining a signed lease agreement from BNSF Railway; and WHEREAS, upon completion, the installation of the IW line allows industries with high strength discharge characteristics the opportunity to locate within the vicinity of the former Boise Cascade Mill site; and WHEREAS, the City Council has determined that it is in the best interest of the City to enter into an Addendum of the existing Professional Services Agreement 2012 -42 with HLA to complete the IW project within "H" St.; now , therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute the attached and incorporated Addendum to existing Professional Services Agreement 2012 -42 with HLA in the amount not to exceed Sixty Thousand Dollars ($60,000), to provide Engineering Services required to design an extension of the City's Industrial Waste Line within BNSF Railway property and to oversee the construction and inspection thereof. ATTEST: Micah Cawley, Mayor Sonya Claar -Tee, City Clerk AGREEMENT FOR PROFESSIONAL SERVICES City of Yakima Contract No. 2012 -42 Resolution R- 2012 -60 Project No. WW2327 ADDENDUM NO. 1 This Addendum, hereinafter identified as Addendum No. 1, is hereby entered into and made a part of the Agreement between City of Yakima, Washington, and Huibregtse, Louman Associates, Inc., for Professional Services first entered into on the 2nd day of May, 2012, by the CITY OF YAKIMA, hereinafter called the "CITY," and HUIBREGTSE, LOUMAN ASSOCIATES, INC., hereinafter called the "ENGINEER." WITNESSETH. That in consideration of the mutual covenants and agreements herein contained, the parties hereto do mutually agree to amend, revise, and /or add the following to the referenced Agreement: SECTION 2 - SCOPE OF SERVICES 2.1 Basic Services: ENGINEER agrees to perform additional work tasks described in the attached Addendum No. 1 Exhibit A: Industrial Waste Line Improvements. Design and Final Plans and Specifications Services During Construction SECTION 5 - COMPENSATION 5.1 COMPENSATION ON A LUMP SUM BASIS: For the services described in the attached Addendum No. 1 Exhibit A for Design and Final Plans and Specifications, compensation shall be for a lump sum fee of $20,200.00. COMPENSATION ON A TIME SPENT BASIS: For the services described in the attached Addendum No. 1 Exhibit A for Services During Construction, compensation shall be on a time spent plus expenses basis with estimated fee 01 530,200 00, at the ENGINEER's normal hourly billing rates shown on Exhibit B. All other provisions, terms and conditions set forth in the underlying City Contract No. 2012 -42 and all approved amendments thereto shall remain in full force and effect unless otherwise amended in writing per the conditions of said underlying contract. Louman, PE Title: City Manager Title: President Date: Date: `/2 542 Attest City Clerk City Contract No. 2012 -42 Resolution No. R- 2012 -60 G:\PROJECTS120121120761APS-Addendum Not - IW Forcomain RR Crossing.doc - 2 - ADDENDUM NO. 1 EXHIBIT A CITY OF YAKIMA — INDUSTRIAL WASTE LINE IMPROVEMENTS SCOPE OF WORK During the term of this AGREEMENT, the ENGINEER shall perform professional services in connection with the following project: City of Yakima — "H" Street Industrial Waste Forcemain BNSF Crossing This scope of work shall include the furnishing of all services, labor, materials, equipment, supplies and incidentals necessary to conduct and complete the work as indicated hereinafter. The work to be performed involves project management, field investigations, design and final plans and specifications, and services during construction. 5. DESIGN AND FINAL PLANS AND SPECIFICATIONS A. The project manager will coordinate ENGINEER'S design team to ensure that the work is • completed on schedule, is technically competent, and meets the CITY'S needs. The project manager will provide overall project management for ENGINEER'S work element, including coordination with subconsultants, progress reports, and ihvoicing. B. Attend up to two (2) project meetings in Yakima with CITY Wastewater Department staff to coordinate the design aspects of the project with the CITY. C. Perform the final design and prepare complete Plans and Specifications for bid call on the proposed work, as authorized by the City. D. Work with BNSF Railroad representatives to include necessary railroad requirements in specifications. E. Furnish the CITY thirty (30) copies of the final Plans and Specifications for bidding and construction. It is anticipated that the ENGINEER will prepare one (1) complete set of plans and specifications for one bid call for this Addendum only, separate from the INDUSTRIAL WASTE LINE IMPROVEMENTS project. The INDUSTRIAL WASTE LINE IMPROVEMENTS project will bid at a separate time. F. Furnish to the CITY engineering data for and assist in the preparation of the required documents so that the CITY may secure approval of such governmental authorities as have jurisdiction over design criteria applicable to the Project. G. Send advertisement for bids to the Paper of Record. ENGINEER shall pay advertisement fee H. Answer and supply such information as is requested by prospective bidders. Prepare and issue addenda, if necessary. J. Prepare the Engineer's Estimate of construction cost. K. Attend bid opening and participate in the bid opening and evaluation process. L. Prepare tabulation of all bids received by the CITY and review bidder's qualifications. M. Make recommendation of construction contract award to the lowest responsible bidder. Furnish the field survey crew necessary to set horizontal and vertical control for the improvements authorized for construction. B. Furnish a qualified resident engineer who shall make construction observations and be on the job at all times that significant work is in progress, whose duty shall be to provide surveillance of project construction for substantial compliance with Plans and Specifications. C. Prepare progress reports on the PROJECT for the days during which a resident engineer is present and file same with the CITY. D. Consult and advise the CITY during construction and make a final report of the completed work. E. The City of Yakima is required to monitor the contractors payment of prevailing wage rates. As part of construction services, HLA will monitor General Contractor and Subcontractor compliance with State labor standards during the construction phase of this project. This work includes checking monthly certified payrolls, conducting employee interviews in the field, and issuing letters of non - compliance and /or letters of missing documents. HLA will perform this task until the PROJECT has been accepted by the City of Yakima. At that time, HLA will turn over all files kept by HLA during the performance of this task to the City of Yakima. It will then be the City of Yakima's responsibility to pursue any outstanding labor issues. F. Review Contractor's submission of samples and shop drawings, where applicable. G. Recommend progress payments for the construction contractor to the CITY. H. Prepare and submit proposed contract change orders when applicable. (. Prepare and furnish reproducible record drawings from as -built drawings furnished by the resident engineer and Contractor. If as -built drawings from the Contractor are not received by HLA within thirty (30) calendar days from the date of the letter of recommendation of project acceptance, HLA will submit reproducible record drawings to the City of Yakima with a note stating that no as -built information was received by HLA from the Contractor. In this case, the as -built drawings will be completed and submitted to the City of Yakima based solely on the resident engineer's field notes.
