The grant funds are being provided by Ecology to assist communities to comply with the provisions of the National Pollutant Discharge Elimination System (NPDES) Municipal Stormwater Phase II permits and to improve and protect water quality. These funds are to be utilized in the planning, implementation, or management of municipal stormwater programs. Stormwater facility construction projects are not eligible. R -2012- A RESOLUTION authorizing and directing the City Manager to execute a Municipal Stormwater Capacity Grant Amendment Agreement with the Department of Ecology. WHEREAS, the City has an extensive stormwater infrastructure to maintain for the collection, transportation, and treatment of surface water (stormwater); and WHEREAS, the City's regulatory obligation with the Department of Ecology (Ecology) is in accordance with the Eastern Washington Phase II Municipal Stormwater Permit and the Underground Injection Control (UIC) Program; and WHEREAS, Ecology has awarded the City an additional $50,000 in grant funds provided by the State Legislature from the Local Toxics Control Account to be used for the Municipal Stormwater Capacity Grant project; and WHEREAS, the grant funds are being provided by Ecology to assist communities to comply with the provisions of the National Pollutant Discharge Elimination System (NPDES) Municipal Stormwater Phase II permits and to improve and protect water quality; and WHEREAS, the grant funds are to be utilized in the planning, implementation, or management of municipal stormwater programs, and, WHEREAS, it is in the best interest of the City to utilize the grant funds to offset current costs in conducting its stormwater compliance activities; now therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to execute the Municipal Stormwater Capacity Grant Amendment Agreement with the Department of Ecology in the amount of Fifty Thousand Dollars ($50,000). GI 100120 BETWEEN THE STATE OF WASHINGTON DEPARTMENT OF ECOLOGY AND CITY OF YAKIMA PURPOSE: To amend the above - referenced grant agreement between the Department of Ecology [DEPARTMENT] and the City of Yakima [RECIPIENT] for the Municipal Stormwater Capacity Grant Project. This amendment is needed to increase budget for Phase II community NPDES Permit Activities by $50,000 and extend the expiration date of the grant agreement. IT IS MUTUALLY AGREED that the grant agreement is amended as follows: PART I. GENERAL INFORMATION 1. The general information shall be modified as follows: a. The expiration date is extended from June 30, 2012 to June 30, 2013. PART IV. PROJECT BUDGET 1.
